The property contain six multi - family units in two buildings, and is located within an RS -2 (single- family) Zoning District. The Comprehensive Plan future land use designation is Residential, Low Density. As such, the existing multi - family use is not consistent with the either the zoning or Comprehensive Plan designation, and is considered by all land development regulations for the City of Atlantic Beach to be a nonconforming use. Based upon the survey and site plan contained in the City's files, the structures are also nonconforming with regard to building setbacks, required parking, impervious surface (as proposed within the amended zoning regulations that will be adopted November 26th) and other site requirements. It also appears the surveyed lot is not consistent with the platted Lot of Record. I cannot explain how these buildings came to exist, but my assumption is that the original structures were built prior to zoning regulations, and were divided into multiple units over time. The multi - family use and structures exist as legal nonconformities, and the renovation to these buildings that occurred over several years time complied with the City's regulations related to improvements to nonconforming uses and structures. Please bear in mind, however, that if more than fifty (50) percent of the value of these structures were to be destroyed or damaged by any means, the future use of this lot would be limited to one single - family residence, and compliance with all applicable land development regulations would be required.
