Dear Mr. Hagmaier:
The Planning and Zoning Department has reviewed your construction plans for four (4) townhouse units proposed
to be located on Ocean Grove Drive. The development area consists of two platted lots within the RG -1 Zoning
District and within a Comprehensive Plan land use designation of Residential, Medium Density. The proposed
four units are in compliance with both the zoning and Comprehensive Plan designations. I wish to make you
aware, however, that in accordance with the City of Atlantic Beach subdivision regulations and Chapter 177,
Florida Statutes, a replat of the subdivision is required in order to divide these four units into fee - simple
ownership lots.
While a condominium form of ownership would not require replatting, it is my understanding based upon your
Building Permit application, that division of the two lots into four lots is anticipated. Please be aware that if these
units are constructed, and the two lots and ownership is subsequently divided in a manner which does not comply
with applicable local and State regulations related to the subdivision of land, the lots would not be considered by
the City of Atlantic Beach to be proper and legal lots of record. As such, the future owners would be unable to
obtain any type of building permit, and future financing and title records could be complicated. Since the
property is now in single ownership, subject to compliance with Building Codes and other applicable regulations,
Building Permits may be issued, and construction may proceed. My recommendation would be to proceed with
