I write in response to your inquiry related to the above referenced parcels, and your intent to develop
these parcels with two -unit townhouses. The subject lots are located within a Residential, Medium
(RM) density future land use designation per the City of Atlantic Beach Comprehensive Plan. As you
know, these parcels are located in the area of the "core city" that has been rezoned from RG -1 (two -
family) to RS -2 (single - family). A special condition was included within the implementing ordinance,
which allows property owners a one -year period of time from the effective date of the rezoning to obtain
permits and proceed with two - family development. For your information, I have provided a copy of
Ordinance 90 -01 -173.
Lots 7 and 9 contain 7500 square feet each; therefore, development of two -unit townhouses on each of
these parcels is consistent with the Comprehensive Plan density limitation, which requires roughly 3100
square feet of lot area per dwelling unit in the RM category. Lot 23 and the west 1 /2 of Lot 21 contain
11,250 square feet; likewise, the development of two dwelling units on this land is consistent with the
Comprehensive Plan.
I have discussed the issue related to the need to re -plat these lots with the City Attorney, and we are in
concurrence that a replat is not required to divide ownership of the lots into fee - simple title interest.
Please keep in mind that Building Permits to proceed with this development must be issued prior to
November 26, 2002, and that development must be in compliance with all other applicable requirements
