ORDER
of the Community Development Board
for the City of Atlantic Beach, Florida
ORDER GRANTING VARIANCE
The above referenced Applicant requested a Variance pursuant to Section 24 -49 and Section 24 -64
of the City of Atlantic Beach Zoning and Subdivision Regulations, such Variance seeking to allow
an eight (8) foot encroachment into a required twenty (20) foot front yard setback to allow
placement of an external elevator shaft in conjunction with the renovation of an existing commercial
structure which shall be used as commercial retail and office space located at 60 Ocean Boulevard,
Lots 5 and 6 and the north 37.0 feet of Lot 7, Block 35, according to the plat thereof as recorded in
Plat Book 5, page 69 of the public records of Duval, Florida.
On August 21, 2001, said request was considered at public hearing by the Community Development
Board for the City of Atlantic Beach. Having considered the application and supporting documents,
the Staff comments and statements made by the Applicant and the Applicant's representatives, the
Community Development Board found that the request complies with Section 24 -49 and Section 24-
64 the City of Atlantic Beach Zoning and Subdivision Regulations, subject to certain conditions as
offered and agreed to by the Applicant.
NOW THEREFORE, based on the said findings, the Community Development Board hereby
GRANTS the request to allow an eight (8) foot encroachment into a required twenty (20) foot front
yard setback to allow placement of an external elevator shaft in conjunction with the renovation of

an existing commercial structure which shall be used as commercial retail and office space, and as
depicted on the site plans as submitted during the public hearing, subject to the following conditions:
1. Existing exterior brick and all simulated brick surfaces to be added,
including that found on the freestanding wall along Ahern Street, shall be
of a color and texture, which to the extent possible, simulates that found on
the Ragtime Tavern and Restaurant located to the south of the subject site
within the same block.
2. Prior to issuance of a final Certificate of Occupancy, the Applicant shall r< v
provide to the Community Development Director a planting plan for the 0 , 0 ra,
site. Trees and landscaping, rather than brick pavers, shall be used where iac .< a � ,;
possible, with trees to installed within certain of the "triangular areas" , ,
formed by the arrangement of parking spaces on the west side of the °� iy-
parking area. Landscaping shall be up- lighted and irrigated, and shall be ° V-, 4)
maintained in a healthy condition.
3. The exterior facade of the elevator shaft shall be of the same simulated
brick surface as described in condition #1, and brick banding shall be
added to provide architectural relief to the elevator shaft.
4. The Variance and the stated conditions is granted transferable, and shall
run with the title to the subject property upon issuance of the final
Certificate of Occupancy.
