Chief of Police Don Ford, Building Official George Worley, Community Development Director DATE: August 18, 1998 BACKGROUND: At the City Commission meeting July 27, 1998, the City Manager was directed, along with staff, to seek various solutions to the 10 Th Street parking problems. The alternatives below include a variety of possible solutions along with the anticipated benefits, problems, and questions (criticisms) for each action. 1. Take No Action The existing problem was created in 1979 when the developer was allowed to convert to townhouses with the full understanding and knowledge that there would be insufficient parking. Although it creates an inconvenience for the residents, they should have recognized this when they bought the townhouses. Residents of the townhouses have had to compete for public, on-street parking, which is a particular problem in the Spring and Summer months when the demand for parking is high. This is largely a seasonal phenomenon, and the residents have apparently adapted to this inconvenience over the years. Benefits: This would not require any action, expense, or risk on the part of the City. It would not create a public relations problem, establish a new precedent for the use of public property, cost money and staff time,reduce available public parking, or generate criticism and conflict with other public agencies. Problems: The residents would have to continue to compete for public parking which is what they have had to do in the past. 2. Reinstate the Parking Permit Program The City could re-adopt a permit parking program similar to the previous one for the city. This would include passing an ordinance establishing the program, issuing stickers citywide for parking, and enforcing the ordinance through police action. Benefits: This would greatly reduce the number of people who could use the public parking spaces. This would make the spaces available for residents at the townhouses for a nominal fee. Problems: There are a variety of problems that may result from this action. Last time we implemented such a program, it drew criticism from Jacksonville and the media. A new permit program would open the door to requests for permit spaces throughout the city. The last time the City did this, we received requests throughout the city for permit spaces, and we added permit spaces to such areas as Poinsettia Street behind the school. If we do this for people in one area, then we will be expected to do it for other people throughout the city. Such a program will require city hall staff time for permits, law enforcement for the spaces, and public works time and materials for marking spaces. All of this will be utilized to accommodate a small number of citizens with a seasonal problem. We can also expect criticism from other Atlantic Beach residents who feel that the parking near the beach is already too restrictive, and such a program will adversely affect their ability to find a public parking place. 3. Lease Spaces to the Residents Another possible solution would be to lease the spaces to the residents. The City could identify one or more spaces for this purpose, establish a lease rate, and allow people to lease one or more spaces. Benefits: This would provide some revenue to the city for the use of these spaces. It would also allow residents to be assured of having a parking space where they could park without having to compete with the public. Problems: A variety of challenges surface when trying to implement this project. There are many decisions that will have to be made, and each decision brings potential conflict and criticism. For instance, how many spaces will be made available, and where will they be located? Will a lease be monthly? Annually? Paid in full monthly?Annually? Will the leasing be available to all city residents? Jacksonville residents? Is the City going to offer this privilege to other condos, townhouses, apartments, residences, and/or businesses? Why or why not? Will the program expand to require significant commission and staff time to administer? How will the enforcement take place since the police don't enforce parking on private property? What are the residents of the townhouses putting into this project... after all they bought the townhouses and they have the problem? This will reduce the number of public parking spaces, and it is likely to bring criticism from Jacksonville, Atlantic Beach residents, and others. 4. Selling Spaces to Homeowners Since the homeowner's association is not active in the townhouses, it will not be feasible to sell a block of spaces to the association. For this reason, the sale of these spaces would essentially have to be handled through negotiations with individual homeowners. The city could have the property appraised and negotiate the sale of the spaces if they chose to do so. Benefits: The city could generate some revenue by selling spaces, and the townhouse residents could purchase a space if they were inclined to do so. Problems: The problems with this are numerous. Similar to number 3 above, there are many questions that will bring potential criticism. How much will the spaces cost? Will spaces be offered to all Atlantic Beach residents? Jacksonville residents? Will anyone pay a fair market value for the property? If purchased, will they be allowed to use the property for other purposes? How will they be purchased or financed? Will we set a precedent to allow other residents and businesses to purchase City property for parking? Public parking will be reduced, which will bring criticism from Atlantic residents, Jacksonville, and others. 5. Parking Meters Parking meters were suggested at one time to help with parking problems near the beach, but there is no apparent advantage to the residents if this is done. Benefits: If meters were placed on 10 Th Street, then some people would seek other places to park. Problems: The problems are numerous. However, the bottom line is that they will not provide additional parking for residents. They will be expensive, they will require enforcement and maintenance, and they will have to be spread throughout the city to avoid claims of favoritism. Considering the number of spaces available in Atlantic Beach for this purpose, it would be a financial drain on City resources, and it would not generate enough revenue to cover its costs to the City. This would also create problems for townhouse residents who would have to feed the parking meters every few hour to park their cars. 6. Take Out the Courtyard Area at the Townhouses and Add Parallel Parking on their Private Property If the courtyard area was removed from the townhouses, then parallel parking could be marked on the private property in front of their townhouses. The other side of the roadway(South side) could be changed to angle parking so that the decrease in parking spaces is not too dramatic. Benefits: The private parking would be on private property, and the residents would be required to pay the expenses necessary to make the changes. Spaces would have to be aligned with the individual units. It would not require City resources for enforcement, marking, or administration. The private citizens would be taking care of a private problem with their private funds. Problems: It is very doubtful that the residents at the townhouses would agree to giving up their courtyard areas and fence. It would not be a very aesthetically pleasing solution. It will probably create great conflict among the residents, assuming that any of them would actually want to do this. There would be some cost to the City to re-stripe the roadway, and some citizens would undoubtedly contest the loss of public parking spaces that would result. Additionally, the parking would be private, and it would not be subject to enforcement by the Police Department. It could be marked as a"tow away"zone by the residents, and it would be enforced privately. 7. Remove the Fence and Courtyard Area and Allow Straight or Angle Parking in Front of the Townhouses, and Mark Angle Parking on the South Side of the Street This would remove the fence and courtyard areas so that most of the cars using the spaces would be on private property. Benefits: Most of the cars parked in front of the townhouses would be on private property, which would not allow the public to park in the spaces. Problems: Similar to number 6 above, it will not be attractive, we doubt that many residents at the townhouse would be willing to do it, and it would eliminate public parking which would result in criticism. It would also result in part of the cars extending onto public property. Additionally, the angle parking on the South side of the street would be backing into the roadway while vehicles from the North side would be backing into the same area. This would create a traffic hazard. It would necessitate back-up all the way to Beach Avenue if no turn around space is provided. Creating a turn around area would reduce the number of parking spaces. 8. Contract with Cloisters or Sea Place for more Parking The townhouse residents could contact the Cloisters and Sea Place to see if the residents could lease space in the nearby parking lots. Benefits: This would allow the residents to have parking nearby without eliminating public parking spaces. It would also be a private solution for a private problem. It would not cost the City in terms of staff or money, and it would avoid the criticisms discussed in many of the alternatives noted above. And, the condos might be able to generate some revenue in the process. Problems: The nearby spaces would not be in front of the townhouses, and they would require a brief walk from the parking lots. The Cloisters is already limited relative to parking... 1.5 spaces per unit is already non- conforming under our code, and they have recently installed gates because of people inappropriately using their parking area. It is doubtful that they would be willing to lease spaces. Sea Place is further away from the townhouses than the Cloisters, which makes their parking less desirable. This would also require permitting through the City Clerk. This could be interpreted as running a business by leasing or renting parking spaces, and this would require an appropriate permit. This would be further complicated by the fact that the condos are required to provide at least 2 spaces per unit under the City Code, and they would not be allowed to reduce that number to a non-conforming level. Summary: In the previous discussion with the City Commission, the Commission indicated that it wanted to look at alternatives beyond#1 above. The City Commission also requested a staff recommendation as to which of the remaining alternatives would be preferred or recommended. After discussing the various choices, the staff committee recommended the implementation of#3, leasing spaces. The recommendation includes identifying a maximum of ten(10) spaces (one per townhouse) to lease to the townhouse owners at a rate of$500 per year. Ideally, it would be to the City's advantage to deal with a homeowners' association to rent a block of spaces. However, since there is no active homeowners' association, this does not appear to be a feasible option. If the demand from individual homeowners does not commit all ten (10) spaces to leased parking, then the remaining spaces would remain public. This will leave a minimum of fourteen(14) spaces open for public parking, and in all probability, there will be more than fourteen(14)public spaces. The spaces should be grouped together at the West end of the on-street parking area. Trying to mark individual spaces scattered throughout the parking area would be confusing and problematic. Spaces should be marked by the City to assure that they are clearly and properly signed and painted. In addition, the leases should include a statement that the use of the spaces will be in compliance with all local codes and state laws. Enforcement will require the active participation of the leaseholders. Since the police will have no way of knowing what vehicles are authorized to park in the spaces, the leaseholders will have to call the police when an unauthorized vehicle parks in one of the spaces. The leasing rate is less than the$60+per month that is charged by Jacksonville for premium parking garage parking spaces downtown, and this fee will help to defray the expenses of planning, advertising, marking, and enforcement. If residents are not willing to pay for this special privilege, then the spaces should remain open to the public. The $500 should be paid in a lump sum, and it should be non-refundable. The City should consider this a unique solution to address a unique problem. With this understanding, the City may be able to avoid requests from businesses, residents, etc. throughout the city from making similar requests. RECOMMENDATIONS: Since the City Commission has already indicated that#1 is not acceptable, the recommendation from staff is for the City Commission to consider #3 above. ATTACHMENTS: We recommend that the City Commission direct the City Attorney to draft a City Ordinance which authorizes the City to lease public, on-street parking to property owners at the townhouses at the end of 10 Th street. Thompson, rector of Public Safety DATE: July 21, 1998 BACKGROUND: The Parking problem has existed at the 10th Street end zone for many years, and it has been discussed, researched, and debated repeatedly in the past. It has also come before the City Commission several times in the past. The following summary is intended to provide general, background information relative to the history of the problem. The existing townhouses at the end of 10th Street do not have any on-street parking. They have a few parking spaces at the West end of the complex, but there is not nearly enough parking to meet the needs of the residents. The parking in the front (south side) of the complex is public parking. As with other areas near the oceanfront, this parking is quickly filled in the warmer months by members of the public. When the spaces are filled,there is nowhere for the residents to park. There have been several changes in the complex over the years. At one time, it was an apartment complex(Bikini Apartments). Originally, there were fewer dwelling units, and there was more parking to the West. Later, about 20 years ago, a building expansion eliminated some of the parking, and the developers were told that the residents would not have enough dedicated parking, but the project was approved and built. This added more dwelling units and eliminated parking spaces. For years, the residents put up signs along 10th Street identifying spaces as private property and tow-a-way zones. However, these signs were removed because the parking was not the property of the residents. It was public parking. Many of the existing residents who purchased the townhouses, were unaware that they did not have any private parking. They were either led or allowed to believe that the spaces in front of the building were for their use. Now, they do not have private parking, and they have to compete for public parking spaces. In the early 1990s,the City adopted a permit parking program. This program established parking spaces in various areas of Atlantic Beach that were restricted to residents only. Residents were required to purchase an annual sticker for their car, and it allowed them to use the permit parking spaces. Most of the spaces on 10th Street were identified as permit parking spaces. Six(6) spaces were still available for public parking, but the other twenty(20) spaces were restricted to permit parking. This allowed the residents to use the majority of the spaces, and they only had to complete with other city residents with permit stickers. The program excluded competition with non-residents. When the permit parking program came before the City Commission for renewal, no action was taken and the program was"sunseted." At the present time, the problem remains unsolved. The housing units were built with the understanding that there was no private parking. The demand for parking is very high in their area, and residents must compete for parking near their residences. Dates and details can be compiled, if requested, relative to the events discussed above. Public Hearing - PUD - Mr. & Mrs. Dan Siakel and Mrs. Audrey Parcel - Ocean 10 Mayor Howell explained that a request had been made by Mr. and Mrs. Dan Siakel to change the apartments at the foot of 10th street and Beach Avenue into townhouse condominiums to be sold individually. The chair recognized Mr. and Mrs.Parcel to present the plans. Mr. Parcel explained that they planned to completely re-design the 10 units zoned for the piece of property, and sell them as townhouses in fee simple, including a common wall. The Mayor then announced the request was now open for a Public Hearing and invited the audience to examine the plans and offer comments from the floor. As no one spoke for or against, Mayor Howell declared the Public Hearing closed. The Mayor inquired how many water meters they planned to install, and Mr. Parcel stated that each unit would have a meter. The Mayor also reminded Mr. Parcel that 10th Street was a Public street and could not be reserved for the owners of the townhouses. A discussion followed on parking spaces recommended by the Planning Board; refuse containers which will be separate containers to be. picked up at the corner of 10th and Beach, and the assurance from the Parcel's that a five foot easement would be deeded to the City at the rear of the property. You will recall this concerns the parking problem at Tenth Street. Mr. Bonner told me the "short answer" to this problem is that if parking places are lost, they need to be replaced with other parking places. However, he indicated if parking spaces have been created in the past, they could be exchanged for the parking spaces that were lost. I mentioned to Mr. Bonner that I would show that an additional 10 parking spaces were created since 1980, and he indicated this would be acceptable. As far as the Corps doing a study, Mr. Bonner indicated the Corps may not have money in their budget at this time to conduct a study, but that he thought the course of action indicated above would be the right course to take. The police department began a traffic/speed analysis on 10'h Street on 4-18-03 to determine the situation. This analysis was conducted from 4-18-03 to 4-29-03. During the analysis, 4982 vehicles were tracked and their speeds monitored. Of the total number of vehicles tracked,not one vehicle was traveling over 15 Miles Per Hour. This is a 20 Mile Per Hour speed zone. BUDGET: No budgetary impact RECOMMENDATION: The traffic/speed analysis does not show any excess speeding problem,however,the police department will monitor this area in the future to insure speeds to no increase as the Core City Project progresses to completion. SECTION 2. Residential Parking Sticker Program: "SECTION 21-27 . Residential Parking Sticker Program: (1) Definitions : (a) "Residential parking street" shall mean a street or portion thereof where curbside parking is limited to vehicles properly displaying a residential parking permit authorized by this Ordinance . Designated streets will be enumerated by resolution of the City Commission and amended from time to time by said body. (b) "Resident" shall mean any person who resides in or pays real property taxes to the City of Atlantic Beach on real estate or on a structure approved for residential occupancy and who is the owner of such structure or tenant therein, or who can demonstrate some other indication of exclusive right of occupancy . (2) Designation of Residential Parking Streets . A street or a portion thereof may be designated as a residential parking street by the City Commission acting on its own upon public notice and hearing , or upon request by residents , provided that any request by residents shall be in a petition form suitable to the City Clerk and filed with the City Clerk, signed by at least fifty percent (50%) of all residents 18 years of age or older who reside on the street or portion of the street under consideration. After advertisement and notice to all property owners of proposed residential parking street or portion thereof , the petition shall be placed on the agenda of a regularly scheduled meeting of the City Commission. The Commission shall then decide on whether or not to designate the street or portion thereof as a residential parking street , provided the City Commission makes at least the follow findings : (1) it has sufficient information to make such decision; (2) designation of the proposed residential parking street or portion thereof is in the best interests of the public health, safety, and welfare ; and (3) at least fifty percent (507) of the residents 18 years of age and older to be affected by said designation are in agreement therewith. (3) Withdrawal of designation of residential parking street . The City Commission may, at any time , upon petition as aforesaid or on its own motion, upon public notice and hearing , withdraw the designation of an .existing residential parking street . Such withdrawal shall become effective thirty (30) days after such vote . (4) Posting of residential parking permit signs . Following the City Commission' s vote to designate a residential parking street , parking signs shall be erected on said residential parking street . The signs shall inform vehicle operators that curbside parking on the street is restricted unless said vehicle displays a residential parking permit authorized by this Ordinance . Additionally , each parking space shall be painted and/or especially marked to reflect an area for residential parking permit only. Vehicles exceeding the boundaries of the parking spaces so marked will not be allowed. (5) Residential parking permits . The applicant for a residential parking permit must be a resident of the City of Atlantic Beach, and the vehicle to which said permit is to be affixed shall be owned , leased , or in the case of a company car issued to , a resident of the City of Atlantic Beach. Any resident over the age of sixteen (16) may apply for a residential parking permit by completing an application therefore prescribed by the City Manager , which application shall be designed to provide the following information: the name and residential address of the owner of the vehicle ; the name , residential address and drivers license number of the principle operator of the vehicle ; the make , model and registration number of the vehicle . The drivers license and vehicle registration must be presented with the application. Whenever the Director of Finance or his designee finds that the applicant qualifies under this chapter for residential parking permit for the vehicle described in the application, he or she shall , upon payment of the fees set forth herein , issue one residential parking permit in the form of a sticker or other method prescribed by the City Manager. The fee for a residential parking permit shall be five dollars ($5) for the first year and one dollar ($ 1) for each year thereafter payable at the time of the submission of the application for the permit . The fee shall not be prorated and no portion of 'any fee shall be refundable . (6) Renewal or transfer of permits . A holder of a valid permit from the previous year shall be entitled to a new residential parking permit for the current year upon payment of the annual fee and submission of evidence to the Director of Finance or his designee that the holder is still qualified for residential parking permit . For the purposes of this program, an annual year shall be comprised of the dates between January 1 and December 31st . The holder of a valid residential parking permit shall receive a new residential parking permit for the purpose of transferring the same to another qualifying vehicle upon completion of a new application and payment of fee as here before provided. (7) Use of residential parking permits . A parking permit shall not guarantee or reserve a parking space nor shall it excuse the observance of any traffic parking regulation. It shall be a violation of this Ordinance for the holder of a residential parking permit to use said permit when the permit holder no longer fulfills one or more of the applicable provisions of this Ordinance. It shall be a violation of the Ordinance for any person to represent , in any fashion, that a vehicle is entitled to a parking permit authorized by this Ordinance when in fact it is not so entitled . The display of a parking permit on a vehicle not entitled to such a permit shall constitute a violation of this Ordinance . It shall be a violation of this ordinance for any person to duplicate or attempt to duplicate a residential parking permit or to display on any vehicle such a duplicate parking permit . It shall be a violation of this Ordinance for any vehicle to park in a designated permit parking space on a residential parking street without a valid parking permit issued by the City of Atlantic Beach. (8) Violations and penalties . The parking of any vehicle in a manner contrary to the residential parking provision established herein shall be subject to the penalties and laws provided within the Code of Ordinances with the City of Atlantic Beach. The use of any residential parking permit in a manner contrary to the provisions established herein is prohibited and the same is declared to be unlawful in addition to those penalties dictated above , the City Manager or designee shall have the responsibility and authority to revoke the residential parking permit of any resident for the abuse of or use of a residential parking permit in a manner contrary to the provisions established in this section. Revocation of the residential parking permit or conviction of a violation may be considered just cause for denial of future residential parking permits to such resident . The parking of any vehicle in a manner contrary to the residential parking provision established herein shall be subject to the penalties provided in SECTION 21-38 (1 ) of the Code of Ordinances of the City of Atlantic Beach , as set forth in the schedule attached hereto . (9) Severability . The provisions of this ordinance are separable and if any provision, clause, sentence , subsection, word or part thereof is held illegal , invalid or unconstitutional, such an illegality , invalidity , unconstitutionality or inapplicability shall not affect or impair any of the remaining provisions , clauses , sentences , subsections , words or parts of the regulation or their application to other persons or circumstances . It is hereby declared to be the legislative intent that this Ordinance would have been adopted if such illegal , invalid or unconstitutionally provision, clause , sentence , subsection, word or part had not been included therein and if such person or circumstance to which the Ordinance or part thereof is held inapplicable had been specifically exempted therefrom. (10) This ordinance is hereby repealed effective twleve o ' clock (12 : 00) midnight on February 23 , 1994 . Prior to the repeal hereof , upon review by the City Commission, this Ordinance May be extended as deemed appropriate by the City Commission. SECTION 3. The next item on the agenda was a request from Mr. Richard Hamilton for sewer and water service to 1609 Beach Avenue, north of the City Limits of Atlantic Beach. After lengthly discussion, Mayor Howell stated that he did not think the City could continue to allcw this particular thirx3 because the City will wind up with in- dividual sewer lines running up to North Atlantic Beach, outside of our City Limits, and it will create a maze of sewer lines all over the place. Mayor Howell suggested that the City Manager handle this until some master plan is worked cut that will be satis- factory with the City. Commissioner Fogg moved, seconded by Com- missioner Rosborough and carried that Mr. Hamilton be allowed to get with the City Manager to do whatever the circumstances justify. Mayor Howell stated that since Mrs. Mary Pace's appointment was for ono year there was now an opening on the Advisory Planning Board for a four year term of office. Mr. Moss replied that the zoning in that district has always been single family. He quiered how it came to be a duplex. Commissioner Johansen remarked that it was grandfathered in 1959. Mr. Moss remarked that while he had no dispute with that, the building permit shows a single family home. There was no later building permit to remodel, nor to remodel as a duplex.. A general discussion ensued regarding the criteria applied in determining a legal duplex being grandfathered in, and maintaining that status. Also discussed was the concept of using a duplex in the European manner by renting a room and providing one meal (breakfast) to a visitor for one night, one week;whether or not this would constitute a business and require a license. The comm- ission determined that this use would constitute a business and require a license. This use would not be allowed in a residential area. Mr. Lewis asked that the commission resolve his request. Recapping, Mr. Moss was to obtain Mr. Andresen's thoughts on that particular stretch of land and report back Monday night. Commissioner Jensen stated that the commission had to look beyond just the ware- house; the whole shopping center must be considered. Commissioner Johansen thought that the highest designation the commission would approve would be Commercial General (CG), determined on the basis of Mr. Moss's report from Mr. Andresen. Mr. Lewis quoted Florida Jurisprudence Volume 35, which pertains to zoning. Several excerpts from that volume were read by Mr. Lewis. Particularly "All that one plans to use his property in accord- ance with existing regulations in entitled to assume is that such regulations will not alter to his detriment, unless the change bears a substantial relation to health, morals, 0_1 welfare, or safety of the public." Commissioner Johansen remarked that Mr. Lewis hit it right on the nose; stating that is why that zoning designation was changed because people that live there complained bout the conditions. Commissioner Jensen stated that regard- less of any change, Mr. Lewis would still be able to use what is there now. Established use was then discussed. Mr. Lewis was invited by Commissioner Gulliford to bring this up Monday night. The distance requirement regarding bars would also be brought up Monday night. Commissioner Gulliford informed Mr. Lewis that this meeting is strictly a workshop. The commission is not empowered to act on anything. The matter had to be resolved when the commission sat, in session, as a commission meeting and not a meeting of the committee of the whole. Mr. Moss stated that Sevilla is not shown on our map and suggested that the lines be drawn in as an RG-3 designation, compatible with the existing use, or as a PUD. Mr, Moss was not sure if that development came in as a PUD. Commissioner Van Ness stated that it did come in as a PUD and once it gets that PUD, it keeps that designation. Mr. Moss replied that premise is applied if the project is under development to retain it's PUD designation. However,everything else has had the zoning changed, otherwise we'd have PUD's throughout the city. Commissioner Gulliford remarked that Mr. Bull is still de- veloping it. The commission clarified that Sevilla would be shown as a PUD. Mr. Moss stated yes; PUD designation would be shown for Sevilla. Commissioner Van Ness stated that she would like to discuss that block between 10th & I.lth Streets, on the east side of Beach Avenue. Presently, it is proposed as an RG-3 zone. The current usage consists of: The Bikini Apartments (Island Club) and Mr. Johnson, on the next lot over, has six (6) units in that house with inadequate parking. Other than that, the situation is duplex all down: the street. Commissioner Gulliford queried Mrs. Van Ness about down zoning it to RG-2. No, Commissioner Van Ness stated, it should be cut back down to RG-1. She didn't know how it.got to be RG-3 to begin with, however, that whole block is not currently being used to conform with an.RG-3. The Mayor stated that it was his understanding that folks who live in that block want it as RG-3. Page 5 MINUTES OF COMMITTEE- OF THE WHOLE ZONING WORKSHOP JULY 8, 1982 Commissioner Van Ness agreed, however, the people that live on the west side of the street don't like it at all. Commissioner Jensen suggested that the Planning Board be asked about that also. Commissioner Van Ness suggested that the boundry line be drawn just north of the Bikini Apartments and Mr, Johnson's place would just have to be grandfathered in. As far as Commissioner Van Ness was concerned, if he met the existing code, he has got to meet the existing parking requirements. Commissioner Jensen interjected if Mr. Johnson's place was legal now. The general feeling was that Mr. Johnson's place might be in violation now, as far as parking in concerned, under the RC zoning. A discussion ensued regarding where the boundry line should be drawn. The commission agreed with Commissioner Van Ness's suggestion. Further discussion took place on the existing zoning, and the proposed zoning, 'and the events leading up to this point in so far as alternate proposed zoning designations considered. Commissioner Gulliford stated thatthecommission would have to vote on every individual issue anyhow Monday night, and this item could be discussed then. Commissioner Gulliford indicated another area on the map that should be discussed; the area west of Mayport Road. Mr. Moss asked if everyone was comfortable with Section "H", stating that 19 building permit requests have been received attempting to get in under the wire with the old zoning. Mr. Moss felt that 19 duplexes constitutes a development. To be consistant with our previous policies, there should be some type of requirements for this development. Mr. Bull had to go through a 60 day process with 10 lots. Permits written for Section "H" have absolutely no requirements; none for sewer/water lines or streets. A general discussion ensued regarding the appropriate ,,. actions needed in that area. Mr. Moss suggested that it be mandatory to hook—up to city water and sewer and to put in streets. Provisions were discussed to require this under the existing ordinance. "Acceptable". sewer facilities and streets are included in the proposed ordinance. Mr. Moss suggested that he tell the builder that the matter has been taken under advisement, awaiting a legal opinion. Commissioner Van Ness felt that they would have to trust in the good judgement of the Health Department regarding septic tanks. Mr. Moss then asked if the commission was. confortable with. the RS-2 designation. The consensus of the commission was yes. The chair recognized Mr. Kelly Amber of 79 Saratoga Circle South, whose concern was addressed to seven (7) lots which he owned in Atlantic Beach Villa Unit #2 that fronted on Mayport Road. (Lots 29 &30, Block 3, and Lots 1, 2, 21 & 22 of Block 4, and Lot 1, Block 3) Mr. Amber applied for commitments for the Veterans Administration, which were rejected. The reason for the denial of mortgage commitments was the fact that the lots were within 150' of Mayport Road. Mr. Amber requested a zoning designation change be considered by the commission for these properties which would allow professional offices. He had approached the City Commission approximately eight (8) years ago to request this same consideration, to which the commission would. not respond unless Mr. Amber could state specifically what use he desired for his property. Mr. Amber later approached the commission with the use designated for the tax collector's office. The commission indicated some resistance to that idea. As the property is presently zoned, the land is not usable. Without attractive types of financing, such as VA or FHA, the land is difficult to sell. Commissioner Van Ness questioned Mr.. Amber if he wanted a CL type of zoning. Mr. Amber replied that would be favorable for Mayport Road. Commissioner Johansen remarked that Mr. Amber knew the lots to be within 15W of Mayport Road when he bought them. Mr. Amber was asking the commission to intrude on a residential neighborhood with a commercial zoning. Commissioner Gulliford reminded the commission that the intent of Commercial Limited was to provide a buffer zone adjacent to a residue. ential district. Crofton Mr. Fred Lewis Mr. Dutton Mr. Ken Amber PURPOSE: Review of Proposed Zoning Ordinance Commissioner Van Ness, acting as the senior member of the Commission, called the meeting to order at 6:44 PM. Mayor Persons and Commissioner Jensen, Mayor Pro Tem, arrived late. Commissioner Van Ness requested Commissioner Gullifords' report on his meeting Saturday with the Saltair residents. Commissioner Gulliford replied that residents had requested two lots on the northwest side of the north end of Poinsettia retain the old zoning (i.e. single family - RS-2) , rather than duplex (RG-1) as proposed under the new zoning. The residents also requested that the twelve (12) lots between Pine Street and Magnolia Street, proposed as duplex zoning, revert to the single family zone as they had been zoned. After a general discussion, the motion was made by Commissioner Gulliford to redraw the duplex zone in the Saltair subdivision to conform with the old boundry line, thereby reducing the number of duplex lots as pro- posed, and maintaining the existing conformation of the neighborhood. The motion was seconded by Commissioner Johansen and passed unanimously. The chair recognized Mrs. Ann Bledsoe, owner of undeveloped property south of Cornell Lane and east of the Atlantic Garden Apartments. Mrs. Bledsoe requested a zoning change for her property from the proposed RS-2 (single family) to a higher density zoning such as RG-2 or 3. Mrs. Bledsoe's request Iwas based on the nature of the developments ad- jacent to her property: the Atlantic Garden Apartments to the west and commercial develop- ments to the south. She further cited the impracticality of single family residences Abutting these types of developments. After a lengthy discussion of the request, and consideration of the most appropriate zoning designation to assign these properties (i.e. desirable density), Commissioner Van ;'fess requested a suggestion, in the form of a motion, to present to the Commission Monday night. The commission felt that Mrs. Bledsoe's request had merit, therefore, Commissioner Jensen made the motion to change the zoning designation to RG-2, which Commissioner Gulliford seconded. The motion was approved unanimously. The borders of this new RG-2 zone are as follows; iaest of the Aquatic East property; north of the commercial zone which fronts Atlantic Blvd.; east of the Atlantic Garden Apartments; and south of Cornell Lane/rear lot lines of those properties on the south side of Saratoga Circle South. Page 2 MINUTES OF COMMITTEE OF THE WHOLE ZONING WORKSHOP JULY 8, 1982 The chair then recognized Mr. Ronald L. Crofton, a developer proposing 130 units (7.5 units per acre) of patio homes to be .located just north of the Aquatic East Club. Commissioner Van Bess informed the commission that this property has a pro- posed zoning designation of RG-2, which is cousistant since Mr. Crofton's parcel abuts the Canterbury Court Apartments. The Mayor clarified with Mr. Crofton that the proposed zoning presented no problems. Mr. Crofton assured the Mayor that RG-2 is no problem, however, if the commission desired a PUD for this development, his staff would be in- structed to submit a PUD. Commissioner Johansen replied that while he appreciated Mr. Crofton's attitude, he felt a PUD was more restrictive and afforded the commission more control since the entire project must be submitted for consideration. Commissioner Gulliford demurred, remarking that the whole reason for this (zoning) is to eliminate a certain amount of individual evaluation. If the criteria is met as set forth by the proposed zoning, an individual can do whatever he wants. Commissioner Gulliford didn't feel strongly about PUD, stating that the commission probably was trying to get away from it to some degree. Commissioner Van Ness reiterated that Mr. Crofton's development would conform with proposed zoning requirements. Mr. Moss confirmed that should Mr. Crofton not bring his project in as a PUD, commission control would be lost. The only controls would be density and construction requirements under the building codes. There would be no control on quality although Mr. Moss felt that the development could be effectively controlled, administratively, to conform compatibly with the area. Commissioner Gulliford remarked that Mr. Crofton was kind enough to preview his plans for the commission, when he could have waited until the proposed zoning passed and proceeded with his plans under the RG-2 zone. Mr. Crofton shouldn't be singled out because he came forward with his plans at this particular time. The Mayor responded that, under the current zoning law (proposed), Mr. Crofton would have to go PUD anyway. A general discussion took place regarding proposed developments under PUD or RG-2. Commissioner Jensen remarked that under the old zoning, three or more units must apply for a PUD, with no restrictions of the existing zone. He suggested that the commission may want to add this to the proposed zoning ordinance. Commissioner Van Ness clarified the land area requirement .under the proposed zoning ordinance was two (2) acres. Mr. Moss stated that Mr. Crofton would be subdividing the land, therefore the commission would have control over any subdivision. A lengthly discussion ensued regarding the density and lot area requirements under the proposed zoning (RG-2), the intent to avoid future PUD's on smaller lots, Mr. Croftons' proposed tennis courts and parks and comm- ission control to ensure compliance for these items, streets and ingress/egress patterns. Commissioner Gulliford remarked that rather than belabor this matter all night, he suggested that this discussion had brought up a general point as to whether or not the commission wants to have the right to refuse, through a PUD and its' requirements, tracts like this in the future with respect to this type zoning. This would have to be de- termined Monday night (July 12, 1982) and researched as to what zoning determination would affect that specific project. The commission noted this subject for further discussion Monday night. The chair then recognized Mr. Fred Lewis, whose main concern was that commercial property east of Mayport Road and just north of Plaza Drive, known as the M & L Shopping Center. Mr. Lewis felt that the proposed zoning (CL) was inappropriate and incompatible for the current usage. The past zoning (BB) allowed any business, except junk yards, and the proposed zoning limits that usage. Commissioner Van Ness stressed that that particular area (shopping center) abuts a residential area which did not lend itself to a "bar" type situation. Commissioner Gulliford remarked that the same situation occurs of Atlantic Blvd. & Royal Palms Drive, abutting an RS-1 district to the north. Commissioner Van Ness remarked that is not precisely correct, clarifing the property off Cavalla Road is zoned RG-2, which acts as a buffer zone. Commissioner Gulliford felt that the RG-2 zoning was in response to existing. development. Commissioner Van Ness remarked that the Page 3 MINUTES OF COMMITTEE OF THE WHOLE ZONING WORKSHOP ^. JULY 8, 1982 board had tried to avoid that. Mr. Lewis interjected that the previous zoning would be compatible with Commercial Intensive (CI). Under the present proposed zoning, Mr. Lewis would not be allowed to continue the use of his warehouses should he lose a tenant. A license would not be issued for a new tenant. Commissioner Johansen replied that the use of the building is grandfathered. Mr. Lewis contradicted Commissioner Johansen, stating that the business use is grandfathered. Mr. Moss clarified that should Mr. Lewis have a tenant. . .say a barber shop.. .and that tenant leaves and another tenant wants to have an auto repair. . .that would not be allowed under that zoning. Mr. Moss remarked that he would have to research whether or not this would be a discrepancy. Commissioner Jensen remarked that Commercial Limited wouldn't prevent the use of the building, rather it would have to be a use allowed under the existing (proposed) ordinance. The Mayor confirmed that Mr. Lewis may not be able to put the same type of tenant back. Mr. Lewis insisted that this would restrict him on tenants since it would be hard to find an attorney who wanted an office in a warehouse. Commissioner Gulliford stated that the intent of Commercial Limited was low intensity commercial uses and business and profess- ional offices which are suitable within close proximity to residential districts. Mr. Lewis maintained that the property on Mayport Road is not suitable for those uses as specified in Commercial Limited, such as art galleries, medical or. dental offices, professional offices. Mr. Moss remarked that the purpose of this zoning is also to project Atlantic Beach twenty (20) years down the road. A lengthly discussion took place regarding the grandfathering of a bar that' had gone out of business and another bar wanting to come in the same place; the uses allowed under CL & CG; those uses that would be grandfathered in; the circumstances under which grandfathering status could be retained. Commissioner Van Ness remarked that another important factor to consider regarding CL, as opposed to CG, is that CL would not have that same usage for on and off traffic on Mayport Road as would occur under CL. Commissioner Johansen remarked that he didn't want to intensify the usage, however, he didn't see how the use allowed could be lowered. Commissioner Van. Ness remarked that the CG zoning on the west side of Mayport Road was retained due to the stop light at Plaza Drive, whch. allows ingress and egress for the entire CG zone. Commissioner Johansen felt that retaining the CL zoning would be penalizing that particular area. Mr. Moss remarked that although. he wasn't part of the conversation to determine a zone designation for that area, he felt that, in his experience, it was the rationale to an existing situation which has, been totally dia ruptive to the neighborhood: To the person, we hear every week., complaints regarding that area, and that the Advisory Planning Board probably felt that the use as it now exists is not only not compatible, but the present owners.have not even attempted to make it compatible. Commissioner Gulliford felt that John Andresen"s opinion on the board's reasoning should be gotten and a report given to the commission Monday night. Mr. Moss stated he would report back Mr. Andresen''s opinion. Commissioner Johansen had two (2) questions which he would like answered., 1) Mr. Bull made the remark that there were no provisions whatsoever for a repeal of any decision of the Administrative Official, Mr. Moss. Commissioner Jensen responded by referring Commissioner Johansen to Page 1-1, Paragraph B which states "The City Commission has the authority to hear appeals on any decisions...'•'. Commiss.-ioner Johansen was satisfied with that and proceeded to his second question. 2) 1160 Beach Avenue, Candy & Jean Nordhann. They maintain their duplex is grandfathered in, even though- it has not been used as a duplex. Commissioner Johansen asked for clarification from Commissioner Jensen regarding a grandfathered in use which has not been in use as. .specified; that the grandfather clause would no longer apply. Commissioner Jensen felt that would not be correct. Mr. Moss remarked that the existing ordinance says that, however, the proposed ordinance says that if it is not used for a .period of six (6) months, then it would revert back to the current zoning for that district.. Commissioner Johansen reiterated that the grandfather clause would not apply. Commissioner Jensen felt that if the rental part of Page b MINUTES OF COMMITTEE OF THE WHOLE ZONING WORKSHOP JULY 8, 1982 Mr. Amber that he does have the right to request rezoning formally after this zoning ordinance passes. Since no decision could be made tonight, Commissioner Johansen felt that would be more advisable. Commissioner Van Ness pointed out that it is a lot easier to change something now than to come back later. Mr. Amber felt that the concern for traffic was not valid when Third Street through Neptune Beach and Jacksonville Beach managed very well with commercial properties fronting on Third Street. Mr. Amber reiterated his concern and request to be able to use his property to some advantage. Mr. Moss suggested to Mr. Amber that if a use could be found that he (Mr. Amber) felt would be acceptable to the surrounding residents and to the city commission, then a formal request for rezoning should be submitted. The consensus of the city commission agreed with this suggestion. Commissioner Gulliford questions a remark which Mr. Bull made concerning Mr. Moss's dictatorial powers on Page 3-1, which says the "Administrative Official appointed by the City Commission shall have the following powers and responsibilities. ..". The Commissioner pointed out that Mr. Bull assumes that the City Manager is in fact the Administrative Official. That Administrative Official could be anyone that the City Commission chose to appoint. In fact, we could appoint the Building Inspector as the Administrative Official. Commissioner Van Ness stated yes. A building official, per se, that would cover the whole department. Commissioner Gulliford stated that that indiv- idual could accomplish all the administrative actions required by this code. Mrs. Kerber interjected that "he (the building official) could hire "x" number of -people to help him administer it" so we would in fact have another layer of bureaucracy in our little city hall. Commissioner Gulliford stated that the way the code is written, it does not automatically assume that the City Manager is, in fact, the Administrative Official. Mr. Bull, in his attack, made that assumption. Mayor Persons felt that the whole code is very technical as far as how things are done; who has. what power.. Mr. Moss remarked that, in terms of practicality, you have one City Manager, and a couple of secretaries. He did not know where the bureaucracy could be. The Mayor remarked that the bureaucracy is that within the code, not necessarily Mr. Moss. The Mayor projected five years from now, we have another city manager who goes by the letter of the code. Then we'd have a problem. Mr. Moss remarked that presently we have a subdivision coming of more than 100 units. A subdivision doesn't get reviewed in one day. The potential is there for doubling the city in a relatively short time. The control of the bureaucracy in the budget process, Mr. Moss asserted. The Mayor felt that there was a distinct similarity between this code and the code of Federal Regulations. The alternative the Mayor felt would be to simplify the code. Also, the thirty-three (33) pages of definitions could possible be a future source for conflict, and possibly litigation. Commissioner Van Ness remarked that without the definitions, we'd be flying by the seat of our pants. Mrs. Kerber questioned what was wrong with the old code, Mr. Moss replied that the old code didn't require anything. Commissioner Gulliford felt that it was important to have something definitive. He trusted the political system, and trusted that system to monitor the growth of this city. However, the Commissioner felt that a group of people in this city on the commission acted totally and completely irresponsible in allowing Selva Marina streets and the fact that they are not suitable for the city to accept dedication of those streets. This will cause severe problems in the future for this city. The Mayor indicated some concern regarding the variances allowable under this code. Commissioner Gulliford disagreed with that, in that the way the code is written, it is extremely tight and very limited. Also the definition of variance on Page 2.24. Mr. Moss remarked that the Board of Adjustments is provided for by State Statues and seems to be compatible with those Statues. Page 7 MINUTES OF COMMITTEE OF THE WHOLE ZONING WORKSHOP JULY 8, 1982 A general discussion ensued regarding past public hearing that both the Advisory Planning Board and the City Commission had held. Reference was made to Jiffy Mart selling beer illegally. A lengthly discussion took place regarding the ordinance proposed to allow the sale of beer& wine. Sewer rates were discussed and the impact on all citizens in Atlantic. Impact fees were not assessed before 1977. It was determined that the height of 35' would be applicable to Commercial and Industrial districts also. The definition of alteration was questioned. Commissioner Gulliford stated that this sould be more definitive. ".Aa alteration" should be changed to "Any substantial alteration" or "Any material alteration". Mr. Moss remarked. that the guide is actually the building code since that is more definitive. No change was determined. Mr. Moss suggested that the committee might want to take a ride out to the Community Block Grant area and review the accomplishments of the grant. The Capital Improvements are finished, however, the remodeling is not finished yet. There being no further business to discuss, the Mayor adjourned the meeting at 10:06 PM. Rob rt B. Ann Moench Re: Variance on Lots 5 & 6 Block 39 Atlantic Beach Mrs. Moench requested a variance on Lots 5 & 5 Block 39 Atlantic I Beach replatting in order to create a lot facing 11th Street. Mr. Vogel stated that if the variance is granted it would be in viola- tion of Section 28-5 (d) of the Code of the City of Atlantic Beach. It was moved by Commissioner Rosborough, seconded by Commissioner Fogg and carried that this request be denied. Duval County School Board Re: Water & Sewer for New Junior High _ Mayor Howell stated that the Duval County School Board is investi- gating the possibility of connecting to the City of Atlantic Beach water and sewer treatment plants when the new Junior High School is built. The Junior High School will be located outside the city limits. Mr. Vogel stated that he had talked with Mr. Parks, City Engineer, and he will have plans finalized for the commission at the next meeting. Mayor Howe11 stated that several weeks ago the city passed a resolution requesting the City of Neptune Beach and the City of Jacksonville Beach to join with the City of Atlantic Beach, the "lead" city, in making an application to the Environmental ,-, Protection Agency for a grant in order to come up with the pre- liminary study on what the cities are doing with their effluence. I MINUTES APRIL 26, 1975 PAGE THREE This study will enable the city to be in a position to expand the sewer plant. So far, neither Neptune Beach or Jacksonville Beach have responded. under tha present EPA requirements, where we have to act as a district or a single entity, the city is totally stymied. The results could be that a Junior High School will not be built. The City of Atlantic Beach will be able to handle the water service to the new Junior High School, but the sewage is out of the question. The city has done everything that can be done to attempt to solve this problem. The other beaches are not co- operating. Mr. Vogel stated that the city should reply to the School Board's letter and tell them exactly what the commission have discussed tonight. Commissioner Rosborough stated that the City Manager should inquire about the other beaches lack of response to the city's proposal. He suggested that the City of Atlantic Beach go ahead and have engineering reports submitted. Mr. Vogel stated that he would contact the Department of Pollution Control and ask them if the city can go ahead and engage a planner. Seventy-five percent of the cost will be rebated back to the city by the Federal Government. Mr. Hilliard wanted clarification on whether or not the city is obligated to furnish water to property owners outside the city limits if the ownership changed hands. Mayor Howell stated that request for water service outside the city limits is not assignable. A statute of limitation, i.e. a reasonable length of time, is im- posed on letters written by the City Manager. Lot 147 Saltair Section 2 Appraisal Mr. Ball, City Attorney, stated that Lot 147 Saltair is located next to the tennis courts on Seminole Road. The owner of this lot is now completely surrounded by city property. He stated that two or three months ago he received a letter from Harry Mahon, attorney, concerning this lot, Mr. Ball called the attorney and told him that the city would be interested in buying Lot 147. Mr. Mahon employed an appraiser for the property. The appraiser stated that the property has a fair market value of $4000.00. The owner also insist that the City of Atlantic Beach pay the cost of the apprai- sal. Mr. Ball stated that the owner does have the ability to go into court and file an inverse condemnation suit. The city does have knowledge that the citizens are using this lot to park while playing tennis. Mr. Ball recommended that a committee be formed to study this problem and recommend a fair market value: recognizing that it would cost a few hundred dollars more if the owher does go to court. MINUTES APRIL 28, 1975 PAGE FOUR After lengthly discussion, it was moved by Commissioner Rosborough, seconded by Commissioner Minton and carried to authorize the City Attorney to offer $3100.00 for Lot 147 Saltair. Health and Accident Insurance, Call for Bids Mr. Vogel stated that at the last meeting he had given the city commission new specifications for the health and accident insurance. With no objections from the commission, Mr. Vogel will call for bids on those specifications. Commissioner Rosborough stated that there were some questions he had regarding the specifications. He stated that with the present specifications the city is going to be in the same position as with the first bid. The first bid was confusing because of the lack of being explicit. On the luny sum benefits, the specification should read "lump sum benefits - $8000.00 to age 65 and at age 65 drop to $4000.00. Mayor Howell stated that what the city,;is trying to do is get an initial low bidder and then the other litems can be negotiated= i.e., benefits, Major Medical and deductibles. Commissioner Fogg stated that the specifications should state that a semi private room be based on the prevailing rates at the time of entry into the hospital. After lenghtly dis- cussion, it was moved by Commissioner Fogg, seconded by Commissioner Minton and carried to instruct the City Manager to call for bids on the health and accident insurance and that the specifications should read "life insurance will be $8000.00 up to age 65 and then drop to $4000.00 for all those over 65 years of age. P.E.P Employees Re: Workman's Comp. , etc. Mayor Howell stated that it has become necessary to place the federal employees that are working under the Public Employee Program on the City of Atlantic Beach's payroll. These employees are under our supervision and jurisdiction. It was moved by Commissioner Rosborough, seconded by Commissioner Fogg and carried that the Public Employees be placed on the City of Atlantic Beach's payroll. These monies to be refunded by the City of Jacksonville Beach, the disbursing agent for the federal government. Chief Stucki requested that the City Manager write the Department of Transportation about the possibility of placing a traffic signal at Mayport Road (AIA) and Plaza. The City Attorney was instructed by the Mayor to prepare the ordinance. Commissioner Minton read the following petition that was presented to him. "Vie the undersigned, being the citizens and taxpayers and active tennis players in Atlantic Beach, due to overcrowded conditions at the Seminole tennis courts due to people from out of town using them, hereby, petition the city commission to take such action as is necessary to place a sign "these courts are available to Atlantic Beach residents and their invited guest only". He stated that approximately 25 names appeared on the petition. Commissioner Rosborough stated that he would like to expand the facilities at the tennis courts by building an additional court and installing a rest room for ladies and men. it was moved by Commissioner Rosborough, seconded by Commissioner Minton and carried to turn these request over to a com.ittee for study and report back at the next meeting. The chair recognized Mr. and Mrs.Parcel to present the plans. Mr. Parcel explained that they planned to completely re-design the 10 units zoned for the piece of property, and sell them as townhouses in fee simple, including a common wall. The Mayor then announced the request was now open for a Public Hearing and invited the audience to examine the plans and offer comments from the floor. As no one spoke for or against, Mayor Howell declared the Public Hearing closed. The Mayor inquired how many water meters they plannad to install, and Mr. Parcel stated that each unit would have a meter. The Mayor also reminded Mr. Parcel that 10th Street was a Public street and could not be reserved for the owners of the townhouses. A discussion followed on parking spaces recommended by the Planning Board; refuse containers which will be separate containers to be picked up at the corner of 10th and Beach, and the assurance from t Parcel's that a five foot easement would be deeded to the City at the rear of the property. I once again have been able to purchase water meters from Rockwell Inter- national under Jacksonville laid No. S-0573-79 at less than $30.00 a piece. Prior to this, the City of Atlantic Beach was paying substantially more for the same meter. Please authorize me to purchase 50 3/4" meters for stock at the purchase price of $1,487.50. The City's engineer, Mr. Parks, has advised me that some time ago he was instructed to give consideration to increasing the capacity of drainage where the lagoon system crosses under Seminole Road, The Plaza E Ilth Street. Mr. Parks is requesting permission to proceed with this endeavor at this time. (See letter attached) r� Several weeks ago, you authorized me to check with the University of Florida Division of Population Studies for the purpose of determining a correct census for Atlantic Beach. I have done this and have been advised that due to an error in the 1970 base data for Atlantic Beach a special census is the only course of action that can be fnllowed. Since this would entail a minimum of six to ten enumerators to be paid for by the City, and since a 10-year census is due in 1980, 1 recommend that we do not pursue this special census. Jul Ann Siakel re addition to 55 10th Street Mrs. Siakel requested the Commission's approval for a variance t _ to construct a two-car garage on the west side of the property. She stated all the requirements of the Board of Adjustment had been met, including acquiring a list of neighbors who stated they had no objections. As the Board of Adjustment have only two members because of resignations, Mrs. Siakel felt the proper course of action would be to request per- mission from the Commission for the variance of two feet. The Mayor asked Mr. George Bull, Jr. , one of the two remain- ing members for his opinion. Mr. Bull stated that since Mrs Siakel had presented the aforementioned list, he felt the Board would have approved the variance, particularly in view of fact that adjacent property being located almost to the 'property line.
