I am a bit unsure of the purpose of some of the notes you have made on the drawings, but based upon our phone conversation, your question is whether your new house can be connected to the existing garage apartment (carriage house). Your property consists of two lots, but these are in the RS-2 Zoning District, which is limited to single-family residences. If a solid roof connects the garage apartment and the new house, they become one structure, and that structure would be considered a Duplex. Duplexes, or two-family dwellings, are not permitted in the RS-2 Zoning District. The two buildings can, however, be connected by an open walkway or breezeway. Dwelling Units attached by any type of solid, continuous or connected roof, however, shall be considered as a Two-family Dwelling or a Townhouse and shall be permitted only within those Zoning Districts where Two-family Dwellings and Townhouses are permitted and in accordance with applicable Density limitations. (d) Adjoining Two-family or Townhouse Dwellings Units shall be constructed of substantially the same architectural style, colors and materials. (e) Adjoining Two-family or Townhouse Dwellings Units shall be constructed at substantially the same time or in a continuous sequence unless an existing Structure is being renovated within the same Building footprint. Sec. 24-88. Garage Apartments (as allowed in combination with Private Garages). In any residential Zoning District, where a Lot has a width of fifty (50) feet or more and extends from Street to Street (or Street to Ocean front in the case of ocean-front Lots), a single Garage Apartment in combination with a Private Garage may be constructed on such double frontage Lots (See Section 24-84.) subject to the following provisions. (a) The permittee shall carry out the construction or activity for which the permit was granted in accordance with the plans and specifications which were approved by the Department as part of the permit. Any deviation therefrom, without written approval from the Bureau, shall be grounds for suspension of the work and revocation of the permit pursuant to Section 120.60(7), Florida Statutes, and may result in assessment of civil fines or issuance of an order to alter or remove the unauthorized structure, or both. No other construction or activities shall be conducted. No modifications to project size, location, or structural design are authorized without prior written approval from the Department. A copy of the permit, notice to proceed, any modifications, time extensions, or permit transfers shall be conspicuously displayed at the project site. (b) The permittee shall conduct the construction or activity authorized under the permit using extreme care to prevent any adverse impacts to the beach and dune system, marine turtles, nests and their habitat or adjacent property and structures. (c) The permittee shall allow any duly authorized member of the staff to enter upon the premises associated with the project authorized by the permit for the purpose of ascertaining compliance with the terms of the permit and with the rules of the Department, until all construction or activities authorized or required in the permit have been completed, and all reports, certifications, or other documentation of project performance are received and accepted by the Department. (d) The permittee shall hold and save the State of Florida, the Department, its officers and employees, harmless from any damage, no matter how occasioned and no matter what the amount, to persons or property which might result from the construction or activity authorized under the permit and from any and all claims and judgements resulting from such damage. (e) The permittee shall allow the Department to use all records, notes, monitoring data and other information relating to construction or any activity under the permit, which are submitted, for any purpose it may deem necessary or convenient, except where such use is otherwise specifically forbidden by law. (f) Construction traffic shall not operate and building materials shall not be stored on vegetated areas seaward of the control line, unless specifically authorized by the permit. If, in the opinion of the Bureau staff, this requirement is not being met, positive control measures shall be provided by the permittee at the direction of the Bureau staff. Such measures may include temporary fencing, designated access roads, adjustment of construction sequence, or other requirements. (g) The permittee shall not disturb existing beach and dune topography and vegetation except as expressly authorized in the permit. Before the project is considered complete, any disturbed topography or vegetation shall be restored as prescribed in the permit, with suitable fill material or revegetated witF appropriate beach and dune vegetation. (h) All fill material placed seaward of the control line shall be sand which is similar to that alread, existing on the site in both coloration and grain size. This certification shall also specify the actual pile tip and pile head elevations and any grade beam or cap elevations. Any deviation from the foundation location and elevations as permitted shall be clearly noted and described in detail as part of the certification. Construction shall stop and the certification shall be submitted and accepted prior to proceeding with further vertical construction for each and every phase of a multiphase project where construction above the foundation of one or more structures occurs prior to completion of AU foundation work. The Bureau shall notify the permittee of approval or rejection of the certification within seven (7) working days after staff receipt of the certification. All survey information upon which the certification is based shall be made available to the Bureau upon request. Permits for repairs or additions to existing structures with nonconforming foundations are exempt from this condition. (s) For major structures the permittee shall provide the Department with a final report certified by an engineer or architect registered in the State of Florida within thirty (30)days following completion of the work. This certification shall state that: all locations and elevations specified by the permit have been verified; that all major structures are specifically constructed in accordance with Section 16B-33.007(4)(b), Florida Administrative Code; other construction and activities authorized by the permit have been performed in compliance with the plans and project description approved as a part of the permit, and all conditions of the permit; or shall describe any deviations from the approved plans, project description or permit conditions and any work not performed. M S Y N Commissioner Edwards inquired whether the city needed to request proposals for engineering services under the Consultants Competitive Negotiation Act for these projects. It was determined that the Regulus Drive job was a major project and should be handled separately and would need to be bid out; however, the improvements to facilitate the change over to the Atlantic Beach system could be approved as a change order to the Sea Gardens lift station project. Commissioner Fletcher inquired into the urgency of the projects and the City Manager responded that while there was no mandate to change the Oceanwalk area over to the Buccaneer system, the city was trying to work as diligently as possible on the change over. Mayor Gulliford, however, cautioned about hastily approving a project because of perceived urgency. Motion: Authorize the expenditure of $7,750.00 for Edwards x engineering design work in connection with Regulus Fletcher Drive sewer replacement and sewer and water line Tucker improvements to facilitate the change over of the Waters x Oceanwalk area to the Atlantic Beach system Gulliford Further discussion ensued regarding the advantages of proceeding with these projects to take advantage of contractors which are already working for the city on other projects. Alan Potter, member of the Utilities Committee, said he was in favor of proceeding with the Oceanwalk change over project, but he felt there was no urgency for the Regulus Drive project. After further discussion of the matter Commissioner Fletcher asked for confirmation that the "Miscellaneous Utility Improvements" at $1,800.00 in the Gee & Jenson proposal was for engineering services in connection with the Oceanwalk change over, following which he offered the following substitute motion: Substitute Motion: Approve only Item 12 on the fee schedule Edwards x in the Gee and Jenson proposal, for engineering Fletcher x x services in connection with the change over of the Tucker x x Oceanwalk area to the Atlantic Beach utility system Waters x Gulliford x No further discussion before the vote. The motion carried unanimously. F. Discussion and related action regarding fence on right—of—way on Beach Avenue and Sixth Street City Planner George Worley explained Mr. & Mrs. Papazian, owners of the property on the southeast corner of Beach Avenue and Sixth Street, were proposing to install a brick and chain link fence around the north and east perimeter of the property. Along Beach Avenue the fence would be on the property line; however, there was a number of trees along the property line on Sixth Street and the PAGE SIX V V MINUTES NAME OF NOVEMBER 11, 1991 COMMRS. M S Y N Papazians had requested permission to install the fence approximately one to two feet onto the Sixth Street right-of-way. Barbara Bonner, 463 Selva Lakes Circle, said she was opposed to any loss of right-of-way property. She said there was already inadequate parking space on the street ends at the beach and was opposed to further reduction in the city's right-of-way. Ms. Bonner also inquired into progress being made in connection with a parking study which had been requested earlier. The City Manager said he would present a report to the City Commission in the near future. After further discussion, Commissioner Fletcher requested action on the matter be deferred until the following meeting to allow him time to visit the site. The Commission concurred and Mayor Gulliford requested that the City Manager also have a survey of that portion of Sixth Street available at the next meeting. G. Appointment of Code Enforcement legal counsel The City Attorney explained that he served as advisor to the Code Enforcement Board but he recommended that a different individual serve as prosecuting attorney. The current prosecuting attorney had served without a contract since the inception of the board and Mayor Gulliford said he felt the city needed to advertise this position and formalize a contract of specific duration with the attorney selected. City Manager reports and/or correspondence: The City Manager confirmed that each commissioner had received a copy of his recommendations regarding the handicapped beach ramps. He said he had met with the Beaches Council for Disabled Persons and it was the general consensus beach ramps would be difficult to maintain and would only have minimal use since wheel- chairs are difficult to operate in sand. However, he advised the Beaches Council for Disabled Persons had a PVC wheel chair with balloon tires which they requested the city store at the lifeguard station and issue to disabled persons as needed. The City Manager said he would consider installing a ramp and handicapped parking at the lifeguard station. Fire Lt. James Hill said a ramp wide enough to accommodate a vehicle would be beneficial to emergency crews wishing to gain access to the beach. After further discussion Mayor Gulliford requested that a representative from the Beaches Council for Disabled Persons be in attendance at the next meeting to give further direction to the city commission on this matter. CITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Fence on R-O-W Beach and Sixth SUBMITTED BY: George Worley, City Planner DATE: November 20, 1991 BACKGROUND: Mr. and Mrs. Papazian, owners of the property on the southeast corner of Beach Avenue and 6th Street, are proposing to install a brick and chainlink fence around the north and east perimeter of the property. The Papazians desire to install a chainlink fence along the 6th Street side of their property but, in order to avoid the removal of a number of trees growing on the property line, they propose to place the fence approximately one to two feet onto the 6th Street Right-of-Way. The Papazians have expressed their desire to encroach as little as possible onto the City' s property. The purpose of the fence is to provide security for the Papazians property. The Right-of-Way of 6th Street is shown on our Plat Maps as 40 feet wide. The actual pavement width is approximately 12 to 15 feet. RECOMMENDATION : Staff opposes the removal of the trees along the 6th Street Right-of-Way. Staff recommends that, if it is the Commissions desire to grant this request that the amount of encroachment be minimized as much as possible and that care be taken to assure that no precedent be set. Staff also recommends consulting the City Attorney regarding possible liability of the City if damages or injury occur in connection with the fence.
