After our deck was completed, we were informed by Mr. Fred Mills, the Building Inspector, that we needed a building permit. We did not realize that we needed a permit for an open, uncovered structure, and we regret not having looked into this beforehand. Later we were told that we would also need a variance. We had naively assumed that we were not violating any setback regu- lations, since the deck does not come closer to the property lines than the existing structure, and we apologize for our mistake. We built the deck because we wanted a comfortable, safe outdoor environ- ment for our family. As the parents of a new baby, we wanted to create an area that is free of hazards for a very young child. As our deck is now, our son can crawl freely, without fear of harm coming to him. We hope the board members will take a personal look at the deck. We think that they will find it to be an attractive, well-crafted structure which enhances the aesthetics of our property and our neighborhood. It is placed discreetly in our yard so that it does not jut out beyond the front of our house. From Beach Avenue it is not readily visible and as one walks down 6th Street it is not apparent unless one looks over into our yard. Our deck does not obstruct the view of any property owner or beachgoer and its design maintains the open air atmosphere of the neighborhood. In contrast to a closed structure, it does not violate air space. When Mr. Fred Mills, Building Inspector, looked at the deck, he instructed us in how to improve the two footings for the upper deck as to comply with the Southern Standard Building Code. This was the only change which March 26, 1982 Page 2 he required at that time. We judged it proper to wait for the board's action before making this change. When we bought our house three years ago it was an eyesore. Now we receive frequent compliments about our home improvements, especially the deck. We would like to ask the board to continue the grandfathered setbacks to include our deck. The deck makes a major contribution to the enjoyment of our family life. We hope that you will grant us this variance. The portion to be removed and reconstructed sits 6" from one property line and 216" from another property line. The yard requirements for the district in which the property is located mandates a minimum side yard of 5' and minimum rear yard of 20'. I reviewed Section 24-85 of the Atlantic Beach Code of Ordinances, Nonconforming Unes or Buildings, to determine whether certain statements therein applied to this property. Section 24- 17: Definitions, states "nonconforming uses or buildings shall mean the use of a building or portion thereof, or land or portion thereof, which does not conform with the use regulations of the district in which the building is located, the use of which was legally established and existed prior to the effective date of such regulations". This building is located within an RS-2 district and the use regulations for these districts include single-family dwellings, accessory uses, planned unit developments and government buildings and facilities, along with several uses by exception. Since this building is a single-family dwelling and the use regulations of the district permit single family dwellings, Section 24-85 would not apply to this property. I know of no provision in the Atlantic Beach Code of , Ordinances that would allow me to issue a building permit to construct or reconstruct a building closer to the property line than the distance established by the minimum yard requirements for the district in which it is located. The Novembers applied for a zoning variance for this property last year but withdrew their application prior to a decision by the Board. I reviewed Section 24-85 of the Atlantic Beach Code of Ordinances, Nonconforming Uses or Buildings, to determine whether certain statements therein applied to this property. Section 24- 17: Definitions, states "nonconforming uses or buildings shall mean the use of a building or portion thereof, or land or portion thereof, which does not conform with the use regulations of the district in which the building is located, the use of which was legally established and existed prior to the effective date of such regulations". This building is located within an RS-2 district and the use regulations for these districts include single-family dwellings, accessory uses, planned unit developments and government buildings and facilities, along with several uses by exception. Since this building is a single-family dwelling and the use regulations of the district permit single family dwellings, Section 24-85 would not apply to this property. I know of no provision in the Atlantic Beach Code of , Ordinances that would allow me to issue a building permit to construct or reconstruct a building closer to the property line than the distance established by the minimum yard requirements for the district in which it is located. The Novembers applied for a zoning variance for this property last year but withdrew their application prior to a decision by the Board. After our deck was completed, we were informed by Mr. Fred Mills, the Building Inspector, that we needed a building permit. We did not realize that we needed a permit for an open, uncovered structure, and we regret not having looked into this beforehand. Later we were told that we would also need a variance. We had naively assumed that we were not violating any setback regu- lations, since the deck does not come closer to the property lines than the existing structure, and we apologize for our mistake. We built the deck because we wanted a comfortable, safe outdoor environ- ment for our family. As the parents of a new baby, we wanted to create an area that is free of hazards for a very young child. As our deck is now, our son can crawl freely, without fear of harm coming to him. We hope the board members will take a personal look at the deck. We think that they will find it to be an attractive, well-crafted structure which enhances the aesthetics of our property and our neighborhood. It is placed discreetly in our yard so that it does not jut out beyond the front of our house. From Beach Avenue it is not readily visible and as one walks down 6th Street it is not apparent unless one looks over into our yard. Our deck does not obstruct the view of any property owner or beachgoer and its design maintains the open air atmosphere of the neighborhood. In contrast to a closed structure, it does not violate air space. When Mr. Fred Mills, Building Inspector, looked at the deck, he instructed us in how to improve the two footings for the upper deck as to comply with the Southern Standard Building Code. This was the only change which f March 26, 1982 Page 2 i he required at that time. We judged it proper to wait for the board's action before making this change. i When we bought our house three years ago it was an eyesore. Now we receive frequent compliments about our home improvements, especially { the deck. We would like to ask the board to continue the grandfathered c setbacks to include our deck.
