Dear Sir,
It has been reported to me by the Atlantic Beach Police Department that there are repetitive
incidents of your security alarm being activated . The police as well as the alarm company have
been unable to contact you . We respect your right to have a security system however it does
entail a responsibility on your part to maintain the equipment in good working order . False alarms
are a distraction for the police from other emergency calls . It is also a violation of the city noise
ordinance.
I encourage you to have your alarm system checked for any defects and have them corrected
immediately . Continued violations can result in this matter being brought before the code
enforcement board.
F1 Statute 162 allows for fines of up to $ 250 per day for a first violation and $ 500 per day for a
repeat violation.
Your cooperation in this matter is appreciated.

Dear Mr. Davis:
This letter is written in accord with our discussion some time ago
with regard to the erection of a stairs from ground level to a sun deck
on the north side of 1058 Beach Avenue, Atlantic Beach, Florida. I have
attached a drawing (Attachment A) which locates the proposed stairs with
respect to the house and the property boundaries.
With regard to the recreation (accessory) building in the back
yard, I would request your permission to leave it in the present loca-
tion for the following reasons;
1. There is no drainage on adjoining property (as the edge of the
roof is 10 inches inside my fence) .
2. The corners are 4" x 6" and 4" x 4" treated timbers sunk in
the ground 2-3 feet.
3. The floor joists are 4" x 6" and 2" x 6" rough timbers on 13"
centers joined with 4-1/2" lag screws.
4. Compliance with Atlantic Beach specifications for accessory
buildings would be complied with as the building is finished.

In response to your letter of June 29, 1978, received in this office
on July 10, please be advised that the City of Atlantic Beach has no
provision Within its ordinance code to grant a variance as you have
requested. There exists every possibility for you to construct outside
stairs to the upper floor of your two-story home but not in the location
you have shown. Emergency conditions, such as fire, etc. , would require
adequate access to both sides of your property which you do not have
now on the north side of your home.
I have no alternative but to request you to immediately remove the
outside stairs from their present location.
Should ,you still desire to construct stairs, please get in touch with
this office and secure a building permit beforehand.

Ladies and Gentlemen:
We bought the property at 1058 Beach, Atlantic Beach.
At the time of purchase I talked to the Atlantic
Beach Building Inspector and I told him I just didn't
like a two story house without stairs outside to the
second story. This was in the summer of 1977. He
ad0sed me this was no problem and if they cost under
*200-00 the cost of the permit would be *5-00. We
bought the house and all winter drew plans, had plans
drawon for the stairs but when I retired in April
from-Bide Cross & Blue Shield Insurance after 29
years I started the stairs.
We certainly never meant to not get a permit, it
is just an oversight and we are sorrys
We respectfully request a variance for our stairs.

Police Officer Charlie Greene, I re-tagged the building with a notice
to contact City Hall regarding the lack of a building permit in
connection with the above construction.

Subject: Code Violations
Dear Mr. Johnson:
Our records indicate you are the legal owner of the property described
as 1058 Beach Avenue.
On April 5, 1979, a building permit was issued to you to allow for the
construction of a 9' x 12' accessory building in the backyard. The permit
application indicated the building would be set back 5' from the side lot
line and 5' from the rear lot line. That was in accordance with the zoning
ordinance in effect at that time.
From visual inspections by our staff, it appears the accessory building
has been constructed less than five feet from the side lot line. Addition-
ally, it appears the building has been expanded without a building permit.
The accessory building is in violation of the City's Zoning Code. We must
therefore require that the accessory building be removed and relocated in
accordance with the permit application. We will allow a period of thirty
(30) days for you to remedy the code violation before pursuing compliance
through appropriate legal channels.
Please advise at your earliest convenience should we be in error regarding
the setbacks or if the City has previously authorized a variance for which
we have no record.
It has also been reported to this office that there may be more than one
family living at the above referenced address. For your information, we
advise that the 1058 Beach Avenue is located in a single family district.
A single family is defined as "One or more persons, related by blood,
adoption or marriage, living and cooking together as a single housekeeping
unit, exclusive of household servants. A number of persons, but not exceeding
two (2) living and cooking together as a single housekeeping unit, though not
related by blood, adoption or marriage, shall be deemed to constitute a
family."
