Swimming Pools and ornamental pools shall be located, designed, operated, and maintained so as to minimize interference with any adjoining residential properties, and shall be subject to the following provisions. (a) Lights: Lights used to illuminate any Swimming Pool or ornamental pool shall be arranged so as not to directly illuminate adjoining properties. (b) Setbacks: The following setbacks shall be maintained for any Swimming Pool or ornamental pool: (1) For Swimming Pools, the front Setback shall be the same as required for a residence located on the Parcel where the Swimming Pool is to be constructed,provided, that in no case shall the pool to be located closer to a front line than the Principal Building is located; except that a pool may be located in either Yard on a double frontage Lot along the Atlantic Ocean and provided that no pool on such Lots is located closer than five(5)feet from any Lot Line. Design and Construction Standards for Two-family (Duplex) Dwellings and Townhouse Units (a) Development of Two-family (Duplex) Dwellings and Townhouse Units, occurring after the initial effective date of these Land Development Regulations, shall be allowed only where Lot Area is in compliance with the Density limitations as set forth in the Comprehensive Plan, unless otherwise determined to be a Vested Development in accordance with the terms of this Chapter. Within areas designated by the Comprehensive Plan for High Density residential Development, a minimum Lot Area of 2175 square feet shall be required for each Dwelling Unit. For areas designated as Medium Density, a minimum Lot Area of 3100 square feet for each Dwelling Unit shall be required, and within areas designated by the Comprehensive Plan as Low Density, a minimum Lot Area of 7250 square feet for each Dwelling Unit shall be required. (b) Two-family and Townhouse Dwelling Units shall be separated by a firewall which shall meet the Florida Building Code firewall separation requirements for Multi-family construction. (c) Dwelling Units separated by a breezeway,or similar type connection, shall not be considered as Two- family Dwellings or Townhouses, and shall be required to meet regulations applicable to Single- family Dwellings. I have lived at 1373 Beach Ave. since 1974 (28 years). Never in all my years of construction and living in Atlantic Beach, have I been so insulted as I was today, December 3, 2002. My wife and I went to breakfast this morning in her car and when we returned home at approximately 9:30am, a painter employed by Duncan Painting Inc. was spray painting white lacquer paint within 15 feet of the front of my Ford Explorer. In addition, he was doing the painting on the city right-of-way, not on the Easton's property. I said good morning, and I said he shouldn't be spray painting so close to the cars. Basically I was told by him "f...you, you have no right to tell me what to do". He said he was not using paint (what is the difference between white lacquer and paint?) and that he had put a 4' x 4' piece of visqueen to protect my car and he started back painting again. I objected again and he then went and talked to the homeowner and the contractor. I also went to the contractor and told him that I wanted my car and my wife's car covered. I was not going to move the cars since the painter and the contractor did not ask me before they started to paint. page 2 of 4 Then the painter said in front of the contractor and Mrs. Easton that "At my time of life I should be taking it easy and not telling other people how to do their job." He was insinuating that I was old and was discriminating against my age in front of Mrs. Easton and the Contractor. Because of the age discrimination comment and being sworn at by Mr. Duncan's employee, the Contractor should have removed him from the job. Instead, the painters went on and painted the rest of the day. No tax paying resident of Atlantic Beach should have to put up with such disrespect and insinuating threat that I'm old. The Contractor should have removed the painter immediately and stopped spray painting on the city right of way. I am insisting that Duncan Painting Co.. have their permit or occupational license revoked for doing painting in the City of Atlantic Beach. This is an intolerable situation and one that should not have happened and I don't think a written apology is acceptable under this situation. ITEM NUMBER 2: Back in April or May 2002, the footer contractor ran a front end loader across the front of my yard making 8 distinctive ruts into my front yard. I have photos showing the damage done. My wife, trying to be a good neighbor to the Eastons said she would wait until the Eastons started landscaping their yard to have the ruts taken care of. Mrs. Easton canceled the meeting in October and in light of what happened this morning, I wanted Mrs. Easton and the contractor to go out and look at the front of my yard. Mrs. Easton was too busy to walk to the ocean side and look at our problem. The contractor, my wife, and I went to the front yard where the contractor had had two day labors spend a half hour back in September throwing a couple of shovels of dirt in the ruts. page 3of4 Since May when the ruts were created, the natural wind and rain have caused the ruts to not be as bad as they were before and the contractor said it was not his responsibility to fix the ruts and it was the landscapers responsibility. In all my years of contracting, it has always been the general contractor as the person of final responsibility for the job. I don't know if Atlantic Beach has a separate permit for landscapers, but according to the State of Florida the General Contractor has the final responsibility for everything that happens on the job site. In addition, there was a boulder, 2 feet long and 10 inches high thrown in my yard from the Eaton's property. The contractor said it was not his responsibility but he removed it at my instance. I'm tired of all the ill regard that the contractor has had saying that it is not his responsibility about the front end loader that crossed my yard and caused the ruts. I want you to come out and make an appointment and meet with me regarding both of these items. Because the contractor told me it was not his responsibility to fix every rut in my front yard. As a tax payer in Atlantic Beach, I want my yard fixed now. It will have to be filled in by hand, raked, and rolled. There will be no machines on my property. And again I know the contractor is liable for damage done to my front yard. At 11 am today the contractor said he didn't know the name of the landscaper and was going to call my wife or me with the date of when the repair work was going to be done. He was to call us by 6 p.m. today the time the repair work would be done. At 6:30 this evening, the contractor and Mrs. Easton met on the street. Mrs. Easton said they do not have a landscape contractor, they have two bids. Therefore, there is no firm date when the landscaping will be done. This is very unprofessional and the contractor should be fined accordingly. page 4 of 4 And again I have photos of my yard and also a photo of the wind blowing the paint over to my cars.
