This will confirm our telephone conversation this date wherein
I advised you that we represent John G. McGiffin, III, with regards
to the above matter. This will confirm your kind agreement to
postpone the public hearing set for July 6, 1989, to a mutually
agreeable date to be determined by us in the future.
In the meantime, I would appreciate it if you could send me,
at your earliest convenience, a copy of the cited statutes which
Mr. McGiffin has allegedly violated. Also, I would appreciate it
if you could advise me in writing as soon as possible as to what
alleged violations the City of Atlantic Beach presently plans to
pursue at formal hearing.

Our records indicate that you are the owner or occupant of the
above referenced property in the City of Atlantic Beach, Florida.
Investigation discloses and we have found and determined that you
are in violation of Chapter 12, Sections (1), (2), (3), (6) and (8)
of the Code of Ordinances of the City of Atlantic Beach in that:
A wooden fence along the north property line has become
structurally unsafe and delapltated; and
piles of palm fronds, wood, grass clippings, leaves and other
vegetative material is being stored on the property, and has
become vermin infested; and
the un-trimmed palm treesthroughout the property may also be
vermin infested.
You are hereby notified that unless the condition above described
is remedied within fifteen (15) days from the date hereof, the
city will remedy this condition at a cost of - the work plus a
charge equal to 100% of the cost of the work to cover city
administrative expenseso, which will be assessed the property
owner or occupant. If not paid within thirty (30) days after
receipt of billing, the invoice amount plus advertising costs,
will be posted as a lien on the property.
If you feel your property is not in violation of Chapter 12 you
must file a written appeal to this office within fifteen ( 15)

Dear Mr. McGiffin:
The City and our Code Enforcement Officer appreciate the start you have
made in clearing and cleaning your oceanfront lot. Not only will this
action contribute to the increased value of your own property but it can
only result in the creation of goodwill between you and your neighbors
and the general improvement of the whole neighborhood.
Evaluation of the efforts you have made so far indicate you have still
quite a way to go. Specifically, you need to continue your efforts to
clear out all of the debris along the fence line and underneath the trees
to the front of your house down to the solid ground underneath. The
conglomeration of leaves and other material are creating a compost pile
in a sense, which encourages the proliferation of rats, snakes and other
vermin. Some attention should be given to 6ving the trunks of the Palm
trees scraped to remove all of the dead material which in turn will
destroy the habitat of nesting rats and mice.
Again, we thank you for your initial efforts and hope you will continue
to prosecute the clean-up of the property just as rapidly as humanly
possible.
