Harris : As you may or may not be aware, this firm has the honor and pleasure of representing James and Susan Shepherd in a dispute they had with their next-door neighbors, William and Mary Cook, regarding the shared property line. This is to advise you that the boundary dispute has been settled amicably, out of court, resulting in the execution of the enclosed documents . Specifically, the dispute arose over the discovery that certain portions of land plotted within the legal description of 1325 Beach Avenue had actually been used by the various owners of 1335 Beach Avenue for approximately thirty-plus years . This occurrence is apparently rather common along the oceanfront on Beach Avenue, and is an ongoing problem with some of the other neighbors on that street at this time. In order to resolve their dispute, the Shepherds and the Cooks entered into the enclosed Settlement Agreement, as well as executed the enclosed Quit-Claim Deed and Ingress/Egress and Maintenance Easement Agreement . These documents give the property owners at 1335 Beach Avenue easements, and thus the right to use, certain City of Atlantic Beach Building and Zoning Department October 30, 2001 Page 2 of 2 portions of property legally owned by 1325 Beach Avenue. We are providing you copies of these agreements, and ask that you please put a copy in your files for each of the above addresses . We are aware that your department issues various permits which could be affected by the enclosed agreements . For example, it would be improper for your department to issue a fence permit to either of the property owners which violates the terms of the Settlement Agreement. As part of the Settlement Agreement, the fence located closest to the ocean separating these two properties is limited in its height and type of material that can be used to construct such a fence. The fences as they currently exist are in compliance with the Settlement Agreement, and we are sending you these documents to ensure that future permits for either of these two properties comply as well . It is our recommendation that, to assist your department as well as the current and future owners of these properties, that before any permits are issued for these properties which may affect the enclosed agreements, that all parties be given notice of the pending permit and an opportunity to review the same before it is issued. The parties have worked diligently to reach this agreement, and appreciate any assistance you can give to them to ensure that it is followed in the future.
