RE, Proposed Remodeling of a Non-conforming Structure at 1546 Beach A.venue,

Dear Sonya:
You might recall that I am attempting to remodel the above referenced house
under the non-conforming structure rules,the most pertinent rule being that"Ifflfty(59)
percent ofthe structurefor the nonconforming use is destroyed, the structure'shall not
be reconstructedfor any nonconforming use."You,Don Ford and I discussed my
submitting the appraised value of the structure to.serve as the basi.9 for calculating the
50%.
Following our discussion about the projec�currently in the design phase, I
studied the applicable ordinance again,specifically See.24-95(a)(3)(attached), and
believe a different interpretation is more fair. Specifically,I see this 1940's,off-grade
wood framed house as Structural Systems, comprised basically of tour parts as follows-
1. Roof System 25%
2. Wall Systerns(Int& Ext) 20%
3. Floor System 30%
4 Foundation System 25%
Total 1000/0
In order to build the two story plan I showed you as a remodel of the existing one
story house,my plan would be to remove the roof and most of the walls,repair and
strengthen the Floor and Foundation Systems resulting in totally"destroying'only 45%
of the nonconforming structure.This may seem like splitting hairs,but I have actually
designed my construction techniques to comply with 50%Me as close a possible.

The successful result of this remodel,as proposed,would be to allow the owners,
Lavinta& Brad James to continue using the structure as a single fimily home without
takiDg up more land area or violating the,50%rule,consistent with the Code.
