My husband and I, and our designer,Kevin Mullican, appreciate all the help and information that Mr. Ford has provided to us in developing these plans. Mr. Ford took over the position of acting Community Development Director after we proposed our intentions to Mr. Whorley, who was also very specific as to the building codes that would affect our garage addition. I have provided the information and documentation that we discussed today in our conversation. Our hope in this matter is: because Mr. Ford acted in good faith by honoring his predecessor's directives to us on how to design our addition within code guild lines and within his capacity as acting Community Development Director approved our plans,and that we acted in good faith in meeting those guild lines,that we be allowed to proceed with our permit application by virtue of our entitled vested rights. We have incurred significant design and landscaping cost towards our garage addition acting on the verbal and written advice of the city's past-current and acting-Community Development Director and request our permit be vested as evidenced by this ongoing relationship that began two CDD tenures ago. Our only wish is to finish this project that is truly a collaboration of highly experienced code enforcement officers, design professionals, and us,the homeowners. I hope you will help us. Enclosed please find the timeline and sequence of decisions that has brought us to this point. Please know that we sought the council of your office to try and eliminate any problems in the permitting of this construction. Additionally, during this time we were aware that Mr. Mullican(our designer)worked directly with Mr. Whorley and Mr. Ford on another garage apartment building together,permitted by Mr. Ford,that has subsequently been built and that overcame the exact design issues that we encountered. (Such as square footage limits, height limits, installation of dormers, and setback requirements). We all felt that implementing Mr. Whorley's and Mr. Ford's advice would work towards the completion of our project,not deny it. Now that the end of the calendar year approaches, it is imperative that this issue be resolved before new building codes go into effect. Our plans have been available to your office since at least July 03, 2001. If these plans must be held in abeyance for any reason, I will assume unless notified otherwise that they are vested and therefore not subject to any new city or statutory codes. I am very sorry to clutter your office with the details of this permit issuance, but it is so important to us that this building be erected. We love our home in Atlantic Beach and want to continue to enhance our property with no infringement to our neighbors. My wife and I want to erect a building on our lot behind and attached to the carport that Peter Coalson built for us 2 years ago. I have preliminary plans as well as a survey, etc. that I will attach to this email but can also drop by your office to look at. Before we instruct the architect to proceed with the drawings I wanted to get your preliminary approval. Basically it's a detached building (detached from the main house), respecting the side and back setbacks, and no taller than the main building. It will house a cabana/great room downstairs with a bathroom, closet and sink-counter top area(not a kitchen). Upstairs is one large room with dormers which will be used as an office. Peter Coalson took care of all these things when we did the initial project and so this is uncharted territory for me. Any advice you can give me or direction as to procedure would be appreciated.
