Dear Bill:
I have reviewed the file in this matter, the plans prepared by the
Public Works Department for completion of the walkway, and met with
the City Manager and visited the site with him. I agree with you
that we would like to resolve all matters involving the property
and completing the access. The City Manager and I would like to
accomplish the following:
1. The dune system adjacent to Beach Avenue on the south
side of the walkway and at the westerly end of the oceanfront lot
shall be restored to as close to its original condition as
possible. I realize you may wish to build some type of a retaining
wall along and close to the north side of your garage to protect
that wooden structure from the sand, now that you have completed
the repairs to that side of your garage. In the event you are in
doubt regarding the original condition of that dune, I have several
photographs in my possession reflecting its original condition.
2 . The lot west of the oceanfront lot shall be restored to
as close to its original condition as possible as well. The debris
needs to be cleaned up from that lot, including the tree stumps and
pieces of tree trunks, pieces of concrete, concrete block, and the
like. Again, we have pictures of that property as well.
3 . The walkway for beach access would be completed. I would
suggest that the way it was originally built down to the paved
street, which has since been removed, would be the better way to
construct the access in that individuals driving north on Beach
Avenue would have a clear view of the steps, thereby providing
better safety for people using the walkway. However, as an
alternative, the walkway would be completed in substantially the
same fashion as shown on the enclosed drawing prepared by the
Public Works Department, making sure that no trees are removed.
You will note that there are no platforms in this proposal.
Construction on the walkway in either of the above fashions must be
commenced and completed as soon as possible.

4 . Upon reaching any final agreement resolving all issues,
the stop work order issued by the City will immediately be lifted.
5. Any and all work you perf orm which requires a permit from
the City will be properly permitted. For example, the fence which
you recently installed along the west edge of the oceanfront lot
will need to be removed in order to restore the dune and then
permitted by the City as necessary. Any permits required from
other governmental agencies will be obtained as well.
6. Upon reaching a final agreement resolving all issues, the
City will take no further action regarding any code violations or
other authorized action as long as the walkway is in place and the
City is able to maintain it.
7 . 1 would like for you to confirm in writing the clarifica-
tion of the previous agreement and understanding between yourself
and the City, as requested in my letter of July 23 , 1992 . This
confirmation was never received from you. I enclose another copy
of that letter for your information.
Please let me hear from you at your earliest convenience so that
hopefully we can resolve all of the above matters. We both agree,
I believe, that it is in everyone ' s best interest to get these
matters behind us and hopefully we can do so quickly.
Finally, this letter is written for the purposes of settlement and
compromise of apparently disputed claims between yourself and the
City of Atlantic Beach. Neither this letter nor any statements
contained herein may be introduced in any action between yourself
and the City.

I am in receipt of a copy of your letter of July 22 , 1992 , to Don
Ford. I want to clarify the agreement and understanding reached
between you and the City of Atlantic Beach because it is not
accurately reflected in your letter.
The stop. work order as set forth in Mr. Ford' s letter to Richard
Skinner dated July 21, 1992 , is in effect. The understanding and
agreement made between you and the City on July 21, 1992 , was that
you could proceed tc pour the concrete footers, which had already
been dug, as inspected and approved by Mr. Ford and thereafter no
further work would be done. There was absolutely no discussion
regarding the new CCCL requirements of the DNR, especially since
when our understanding and agreement was reached, the Cabinet had
not yet even voted on any new requirements.
I I would appreciate you immediately confirming, , in writing, this
clarification of the agreement and understanding.
The City will proceed to resolve the remaining aspects of your
situation expeditiously.

in violation of City of Atlantic Beach Ordinance Chapter 12, Section 12-1-6 -Accumulation
of building debris, i.e., on the north property line there remains a decaying sheet of plywood;
on the west side along Beach Avenue there is an accumulation of building debris buried and
exposed. Please correct this situation as soon as possible within the time allotted.
You are hereby notified that unless the conditions above described are remedied within
thirty (30) days from the date of your receipt hereof this case will be turned over to the Code
Enforcement Board.
Under Florida Statute 162.09, the Code Enforcement Board may impose fines of up
to $250.00 per day for a first violation and $500.00 per day for a repeat violation.
