He stated he would prefer to pay mitigation into the Tree Fund since it would cost him more to plant 4"oaks on his property. He also requested that he have until the issuance of the Certificate of Occupancy to pay into the fund. A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy, and unanimously carried to direct the Building Official to issue a permit for the removal of a 27" live oak and a 25" live oak to be mitigated with 26" to be paid into the Tree Fund at$117 per inch at the time of the issuance of the Certificate of Occupancy. 4) Part of Lots 8 and 9, Block 1, Ocean Grove Unit 1 (corner of Dewees Ave. and Beach Ave.): Mr. Brian Platock addressed this application. He stated that he would attempt to relocate the 7.6" live oak. In addition, he stated that they would not remove any trees for the walkway, that they would work around them. A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy, and unanimously carried to direct the Building Official to issue a permit for the removal of 20.6" of palm to be mitigated with a 21" palm on site. 5) 435 Atlantic Boulevard: Mr. Wade Olszewski and Mr. Mike Urchuk of CPH Engineering, and Mr. Tim Darnall of McDonald's Corporation, introduced themselves. Mr. Olszewski summarized for the Board the building permitting process that occurred and explained how the trees were inadvertently removed without a permit. He stated that they have revised the landscape plans to include sabal palms, chordgrass and indian hawthorn to tie in with the landscaping at Town Center. Board Member Shaughnessy suggested that crape myrtles not be planted because they were not considered trees. Mr. Olszewski advised that they removed 76" of oak, 50"palm and 5" of spruce. The Board determined that they would not require mitigation of the 5" spruce and, since only 10"of palm removed was protected, they would only require 10"of palm to be planted back on the site. The Board corrected the Existing Tree Legend to reflect the correct trees that were removed. In addition, the Board requested that the wax myrtles located in the back of the lot not be removed. Within all residential Zoning Districts, the maximum amount of Impervious Surface area allowed is fifty percent (50%). Within all commercial and industrial Zoning Districts, the maximum amount of Impervious Surface area allowed is seventy percent (70%). The Zoning regulations define Impervious Surface as follows: Impervious Surface shall mean those surfaces that prevent the entry of water into the soil. Common Impervious Surfaces include, but are not limited to, rooftops, sidewalks, patio areas, driveways, parking Lots, and other surfaces made of concrete, asphalt, brick, plastic, or any surfacing material with a base or lining of an impervious material. Wood decking elevated two or more inches above grade shall not be considered impervious provided that the ground surface beneath the decking is not impervious. Pervious areas beneath roof or balcony overhangs that are subject to inundation by stormwater and which allow the percolation of that stormwater shall not be considered impervious areas. Swimming pools shall not be considered as Impervious Surfaces because of their ability to retain additional rain water, however, decking around a pool may be considered impervious depending upon materials used. Information verifying Impervious Surface must be provided prior to issuance of Building Permits whenever new construction, including building renovations or additions, new driveways, decks or porches involves any increase in Impervious Surface area.
