WHEREAS, John C. Landon, the owner of the real property
described in this order have applied to the Community Development
Board for a zoning variance to construct a single family dwelling
with a 10' rear yard in an RG-1 zoning district; and
WHEREAS, the Community Development Board hag considered the
application and rendered an opinion; and
WHEREAS, taking into consideration the above opinion, the
Community Development Board finds that the granting of such
variance will not be contrary to the public Interest and owing to
special conditions a literal enforcement of the provisions of the
Zoning Code will result in unnecessary and undue hardship; now,
therefore,
BE IT ORDAINED BY THE COMMUNITY DEVELOPMENT BOARD THAT:
Section 1. Variance Granted Subject to Conditions. The
owner/s of the real property described in this order are hereby
granted a zoning variance from the requirement of Chapter 24 of
the Ordinance Code of the City of Atlantic Beach permitting
construction of a single family dwelling with a 10' rear yard,
subject however to the condition that said variance shall be
transferable and shall run with the title to the property
described in this order and subject further to the condition that
said variance shall be commenced within one year from the
effective date of this order.
Section 2. Owner and Description. The land as to which a zoning
variance is granted by this order is owned by John C. Landon
and described as follows:
PART OF TRACT 4, NORTH ATLANTIC BEACH UNIT NO. 1
(See Attached Exhibit A)
Section 3. Effective Date. This order shall become effective
upon it 's execution.

Chairman McCaulie called the meeting to order at 7:00 p. m. He
asked for additions or corrections to the minutes of the meeting
of February 16, 1968. There being none, Mr. Tappin motioned that
they be approved as presented. Ruth Gregg seconded the motion
which carried unanimously.
NEW BUSINESS
A. APPLICATION FOR ADMINISTRATIVE APPEAL TO ALLOW AN ACCESSORY
STRUCTURE IN THE FRONT YARD; 410 OCEANWALK DRIVE SOUTH BY
PAUL CHIARAVALLE
Mr. Bill Watson, 14130 Crystal Cove Road, Jacksonville, stated
that he represents Mr. Chiaravalle. Mr. Watson stated that the
gazebo would be a very open structure and that view from the main
house would not be obstructed. The slab had been poured and the
four corner beams, and possibly part of the roof structure had
been constructed when the building inspector stopped the work.
He stated that the developer had approved the plans and thought
the City had also.
Ed Barbarito, 2225 Oceanwalk Drive West, lives 50 yards from the
subject house. He asked the Board members to go out and look at
the house before making any decision. He stated that he was
vehemently opposed to the gazebo.
Laura Miller stated that she owns the lot across the street. She
stated that she was opposed to the mustard-gold, red and black
color combination.
Jenny Reese, 2340 Beachcomber Trail, stated that the house is not
in keeping with the rest of the neighborhood and that she is
totally opposed to it. She felt they would have to live with the
house since it had been approved, but that the gazebo is a
seperate structure and should not be approved.
Don Gaperwill, 375 Fourth Street, stated that he owns a lot in
Oceanwalk near the Chiaravalle house and that if the gazebo is
anything like the main house, he was against it.
Chairman McCaulie advised the members of the audience that the
Board had no control over aesthetics, that it was up to the
developer to approve such things as design and color
combinations.
Mr. Mullis stated that the Building Official has interpreted the
structure as an accessory building, and an accessory building
must be in the rear yard. He felt the Board's responsibility was
to determine whether the Building Inspector was arbitrary,
capricious, or wrong in his interpretation of the law.
Mr. Tappin stated that he been out and looked at the structure.
He motioned to deny the appeal and uphold the decision of the
Building Inspector. Ruth Gregg seconded the motion. The motion
carried unanimously.
B. APPLICATION FOR SEPTIC TANK VARIANCE LOT 6, BLOCK 39, SECTION
H; BY STEPHEN H. MABRY
Chairman McCaulie opened the public hearing and asked for
comments on the application. There was no one present to discuss
the application. Mr. Tappin motioned to recommend denial of the
application, as no hardship has been presented. Ruth Gregg
seconded the motion which carried unanimously.
APPLICATION FOR REAR YARD VARIANCE, A 50'X 50' LOT BEING PART
OF TRACT 4, NORTH ATLANTIC BEACH, UNIT NO. 1; BY JOHN C.
LANDON (ANNEXED FROM JACKSONVILLE, JANUARY 1987)
Mr. Landon stated that he was requesting relief from the 20' rear
yard requirement so that he could construct a garage-apartment-
type building on the small lot that has been in his family since
1943. He added that he owns the lot across the street and one of
the two lots that back up to this lot. Mr. Landon felt he could
not build without relief from the 20' yard requirement.
There being no one else present to discuss the item, Mr. Bass
motioned to approve the application. Ruth Gregg seconded the
motion. The Board considered the findings of fact and determined
that a hardship exists In that Mr. Landon could have built on his
lot with a 10' rear yard prior to annexation. The vote was
called. The motion to approve the application carried
unanimously.

in attached legal was zoned Residential General (RG-A) in the consoli-
dated City of Jacksonville .
As this property was recorded prior to September 5 , 1969 , making it
a lot of record , a single family dwelling could have been built
on this lot provided it met the set backs .
The setbacks for building on this lot would be 20 ' front yard ,
combined 15 ' side yard (5 ' on one side and 10 ' on the other and a 10T
rear yard) . These could be reduced to 10 ' front , 4 ' on either side
and 5 ' rear yard with a yard modification signed by all contiguous
property owners .

WHEREAS, Developer plans to develop said land by constructing
buildings,' residences and/or other improvements
thereon consisting of' ' '

WHEREAS, City is the owner of water and sewage treatment plants and
water distribution and sewage collection systems in the vicinity of the
property described above; and
WHEREAS, Developer desires that City provide water and sewage

collection service to said property and City desires to furnish same;
and
to them and to their occupants water and sewer service subject to all
terms and conditions of this Agreement; and
WHEREAS, in order to provide water and sewer services to Developer
it has been or will be necessary- for City -to enlarge and expand its
offsite water and sewer. plants and facilities and it is the desire and
intent of Developer to contribute financially to the costs of building
such additional offsite water and sewer plants and facilities and to
reserve capacity in City's water and sewage treatment plants so that
City can provide service to the Development without imposing a burden on
its existing customers;
NOW, THEREFORE, in consideration of the premises and other good and .
valuable considerations and in consideration of the mutual covenants and
conditions hereinaf ter �contained, subject to any necessary approval by
other governmental agencies having jurisdiction, it is agreed by the
parties hereto as follows:
1. Developer agrees that City shall have the exclusive right to
furnish water and sewer service to the real property described above and
hereby grants to City , this exclusive right.to provide water and sewer
service for all uses within all structures now or hereafter constructed
on the real property described above.
2. City agrees that after Developer has connected to the systems
of City, City will provide at its own cost and expense, water and sewer
service to Developer's property in a manner conforming to the reasonable
requirements of public or governmental agencies or parties having
jurisdiction over City's water and sewer operations; provided, however,
that such service shall be in accordance with other provisions of this
Agreement, including City's rules and regulations and rate schedules.
3. In the event that Developer or assigns fails to complete
construction of all improvements required to be built by Developer and
Agreement under this provision, City reserves the right to negotiate
with Developer a new agreement for any additional sums to be paid by
Developer to City as plant capacity and service availability charges,
fees or other charges base d upon increases in tile cost of living and/or
such other factors as relate to tile cost of supplying water and sewer
service.
4. All taxes or charges imposed upon the property described above
by any governmental entity or agency shall be paid , by Developer except
such part thereof that has been deeded to the City In accordance with
tile terms of this agreement.
5. The rates charged by City for water and sewer service shall be
in accordance with its rate schedule which shall be subject to change .
from time to time.
City shall have the right to determine reasonable meter size
and location.
6. Developer will grant to the City, at Developer's expense,
adequate easements for water and sewer lines, for access to lift
stations and water stations and related appurtenances. Said easements
shall be transferable. Developer will also furnish title evidence
satisfactory to the City that said easements are superior to mortgages
or other interest in the land., and Developer shall cause any such
mortgages to be released or subordinated to said easements. Easements
will also be furnisiled to provide for onsite water distribution lines,
including meters and sewage collection lines. Sites for lift stations
and water stations and related appurtenances shall be conveyed by
warranty deed in fee simple by Developer.. to City. Developer will
furnish City a warranty deed, title evidence satisfactory to City and
any releases from lien holders for any sewaqe vumving statinn wid
to said state road right-of-way. Developer shall further grant to the
City, its successors , and assigns, the exclusive, perpetual right,
privilege and easement to construct, reconstruct, operate, maintain,
repair, replace, improveP alter, remove, relocate and inspect water
transmissions and distribution mains, sewer collection mains, sewer lift
stations, pipe lines, lateral lines, valves., connections and appurtenant
equipment over, across and under the Developer's property, including the
right to ingress and. egress to eacl.i of the building sites on Developer's
property which are served' by City. All such easements shall have a
.width which is acceptable to the City.
7. City .does not guarantee an uninterrupted supply of water,
or water at any particular pressure, and reserves the right to shut off
the water in its main at ally time for the purpose of making repairs or
extensions of for providing temporary or emergency water supply. City
will not be responsible for any damage caused by low pressure or
interruption of service. Neither Developer nor any of its successors or
purchasers shall discharge into the sanitary sewer system water from
11non-domestic" drains including without limitation swimming pools, air
conditioning condensation lines, cooling lines or other discharge from
ally type of equipment. . City shall-not be obligated to furnish ally water
or sewer service to any building whicli is built on Developer's property
to which the Cit does not have access. The Developer hereby agrees and

warrants that the City will not be held responsible for flooding
problems which may result from the failure of sewer line back flow
preventor valves on Developer's property. The Developer hereby agrees
to hold harmless and indemnify City for all costs and damages resulting
from flooding due to .back flow preventor valve failure.
8. The construction and des,ign of all facilities to be
Developer or its contractor. Developer will pay the cost of all such
construction. The Developer's engineer shall incorporate into the
Developer's engineering design, plans and specifications tile applicable
standards and specifications of the City.
9. A. If the Developer modifies his development plans for
Developer's property which would require greater water usage, greater
fire flows, additional water facilities, greater sewage flows, or
additional sewage facilities. than the water and sewer demands previously
approved by the City, then the Developer must obtain approval by the
City for the construction of such additional water or sewer facilities
which shall meet all City and governmental design requirements. The
Developer shall pay all additional contributions and fees as Play be
authorized by the City's- service availability policy wilicil is in effect
on the date said new agreement is executed.
B. In addifion to paragraph 9A above, any other change order
between Developer and its utility contractor issued after City approval
of original plans must be approved by the City before the change order
is put into effect.
C. City shall have the right to review the systems design
drawing and specifications to ensure that they meet the requirements of
tile City. The systems design drawing ai.id specifications are to be in
accordance with the City of Atlantic Beach requirements unless otherwise
.specified by City or its engineer.
D. The City also reserves the right to approve the utility
contractors to which construction bids are sent by Developer as well as
the contractor to which the award is made.
E. A representative of City or its engineers will be the
.inspector of the project alonR with the DevP1n1iPrin Pno4ripar ii,it. r;f,
absolute and exclusive owner of the facilities of said water and sewer
systems whether located on, under, above or outside of the property
described and regardless of who may have installed or constructed same
to the extent described below:
A. All water mains, pipes, valves and fittings and
appurtenances up to and including all meters shall be dedicated to and
will be owned., operated and maintained by City.. All water pipes on the
customer's side of the meter shall be owned., operated, and maintained by
the customer or its assigns.
B. All sewer mains., manholes, pumping stations, force mains
and appurtenances, including service pipes in public right of ways and
dedicated easements, shall be owned, operated and maintained by the
City. Except as provid.ed in paragraph 9C, all sewer lines on the
customer's side of the property line shall be owned, operated and
maintained by the customer or its assigns.
C. With reference to any blanket easements for multi-family
projects such as apartm ents, mobile home developments, condominiums and
PUDIs or for commercial developments, all water mains to and including
the water meter, all sewer mains, force mains and manholes in such
blanket easements over private- property allowing utility operations
shall be dedicated to and shall be owned, operated and maintained by t1lb
City except that the full length of sewer services from the sewer main
or manhole shall be owned and maintained by the customer. All such City
lines shall terminate with a manhole.
D. By these presents, Developer hereby transfers to the
City, the title to the water distribution a nd sewer collection systems
to be ins tal I ed pursuant to this Agreement, such . conveyance to - take
effect without further action upon the completion and acceptance by City
11. Developer shall pay .the City upon, execution of this Agreement
the sum of 10� per water connection per
equivalent residential connection (ERC) , as an advanced deposit to cover
engineering, plan review, inspection, test, legal and administrative
expenses of City in connection with this Agreement. Developer shall
also pay to City upon execution of this Agreement the sum of
io� per sewer connection per ERC as an advanced
deposit to cover engineering, plan review, inspection, tests, legal and
administrative expenses of City in connection, with this Agreement. The
charges for engineering and legal expenses and for engineer's inspection
and plan review. fee, for non-residential units shall be based upon
estimated cost to City Actual cost will be determined and a refund or
additional charge will be made for the difference between the advanced
deposit as calculated above and actual costs.
City agrees to provide water and sewer service to the
Developer's property in consideration for plant capacity charges, fees
and other charges to be paid by Developer as follows:
A. A water plant capacity charge at the rate of
$20.00 per fixture unit. Such charges shall be due and payable as
provided in paragraph 12.
B. A sewer plant capacity charge at, the rate of
onethousand thi-rty, five dolla-rs (s 1 03S.00 per single
family unit. Such charges shall be due and payable, as provided in
paragraph 12.
C. A sewer plant capacity . charge for any commercial
customers on the land as described above at. the rate of

installation (but not including curb stop or meter box) according to the
City's service availability policy at the time of installation which

1. Developer recognizes that water or sewer utility

that Developer is obligated to refund a said prior developer"Developer's
share of the cost of said main exte' nsion. or other improvements.
Accordingly, Developer shall pay its pro rata share of the cost of said'
main extension or other iniprovements to City. Said pro. rata share shall
be based oil Developer's percentage of the hydraulic capacity of said
extension or other improvements. For tile purpose of this Agreement, tile
cost of Developer's said hydraulic share shall be $
payable upon execution' of this Agreement.
2. With respect to utility facilities installed by
Developer to which future developers connect directly, and I n
consideration for manies expended by Developer toward said facilities
City shall refund to Developer, or Developerls 'successors or assigns,
solely from monies collected from said future developers, said future
developer's pro rata share of the cost of said facilities. Said refunds
shall be calculated oil the basi,s of the iiydraulic capacit y and demand of
said future developer whenever .feasible. The refund obligation of City
hereunder and the benefits to Developer related thereto shall expire,

13. City agrees to connect individual buildings and structures on
the developed property upon application by �the builders, plumbers or
individual owners subject to the operating rules and regulations of the
City and payment of all fees and charges in effect on date of
application and compliance by Developer with all provi.Lsions of this
Agreement.
14. The charges, costs and fees for any separate emergency fire
protection water systems. for subject project will be subject to
negotiations between City and Developer. If buildings of more than two
stories are a part of the project, Developer shall furnish at its
expense water pumps and other appurtenances as necessary for pumping
water above.
15. All plant capacity and service availability charges, fees and
other charges as outlined above are based on normal domestic sewage
defined herein as containing not more than three hundred (300) parts per
million biochemical oxygen demand or three hundred (300) parts per
million suspended solids. Whenever water which contains more than these
amounts is to be admitted to the sewers, both the City and the pollution
control agencies must specifically agree to the connection. An
additional charge will be calculated in direct proportion to strength at
seventy-five cents ($0.75) for each part per million of either
biochemical oxygen demand or suspended solids over three hundred (300)
parts per million. All such connections shall provide for a suitable
point for the waste to be sampled by the City or the regulatory
agencies. An additional charge equal to the pro rata share of any
additional sewage treatment plant costs. above ninety percent (90%)
treatment, and of the cost of any additional required outfall pipes to

subordinated to the terms of the Agreement and easements required herein
prior to any acceptance of the tacilities by the City'.
17. Upon application by owners, builders or their authorized
representatives, the City agrees to coni.iect tlie requested dwellings or
structures on the said property at no additional connection fee (i.e. ,
in addition to those provided for above in this Agreement) , but subject
to the continuing operating rules and regulations of the City including,
without limitation, the periodic payment of the water usage and sewer
usage charges in effect on the date of such application or thereafter
reflected in the City's rate schedule.
18. This Agreement shall be binding upon and shall Inure to the
benefit of the Developer, City and their successors and assigns.
However, in the event the Developer has not paid and delivered to the
City the plant capacity and service availability charges, fees and Other
charges provided to be paid to ti te City by Developer under tho terms of
..this Agreement, and all easement and conveyances required by this
Agreement, then this Agreement shall. not inure to the 'benefit of the
successors or assigns Of the Developer.
19. It shall be the responsibility of Developer to locate for
builders any water and sewer taps or lines necessary In conjunction with
residential or commercial construction.
20. Unless the damage to any onsite Improvements. are the result of
the negligence or willful act of the City, its officers, or employees or
authorized agents, the owne.r or Developer of such property upon which
the damage occurs shall be responsible for the payment to the City of
such damage to City's property in,cluditig all pecessary and reasonable
repairs which must be. made by the Cit or independent contractors
prior hereta, for the payment of such necessary and reasonable costs and
expenses for effecting such repairs and restoration to such onsite
facilities located upon the owner's or Developer's property. Notice of
such lien or claim on lien describing - the real property and the amount
owed may be filed within ninety (90) days of I the date from the last date

bring. an action for the foreclosed under the laws of Florida.
21. Prior to final acceptance of the utility and other public
facilities improvements by tile City the following requirements must be
met at Developer's expense:
A. If the property is platted, one copy of the recorded plat
shall be furnished to tile City.*
11. "As built" drawings of utility improvement shall be
furnished one week prior to final inspection. "As built" drawings shall
be certified by a registered engineer with the cost being borne by the
Developer. Two mylar and three printed copies, of said drawing shall be
furnished to City#

company or its engineer can, upon receipt of "as built". draw ings, verify
the marked water and/or sewer services as to location and depth. In
addition, for purposes of locating and protecting installed service

in the manner as shown on the design drawings and specifications.

(1) year period after acceptance.

This letter is to confirm the information regarding the
Hawkes lot on the west side of Beach Avenue. My conversation
with City Attorney Alan Jensen verified that the motion to
grant the variances to permit the construction on the
substandard lot , permit encroachment into the rear yard setback
area, and to permit the building height to exceed 17 feet, were
granted in language which allows them to transfer with the
property. A purchaser will have the same rights as were
granted to Mr. Hawkes .

Re: Status of Variances at 1778 Beach Avenue for parcels located directly west of
oceanfront Lots 36 and 37 of North Atlantic Beach, Unit Number 1
Dear Mr. Cromer:
The purpose of this letter is to clarify the status of previous Zoning Variances, which have
been granted to your property on Beach Avenue. As you know, the history of the Variances on
these lots is rather complicated and now dates back over a decade ago. Based upon City
records, your above referenced property consists of two 50 x 50-foot lot on the west side of the
1700 block of Beach Avenue. The southern lot is currently vacant, and the northerly lot
contains your single-family residence. These lots are recognized as nonconforming, but
legally established, Lots of Record.
Your existing residence was constructed with a Variance approved March 15, 1988 (No. V-88-
3-C), which allowed for a rear (west side of lot) yard setback of ten (10) feet and a maximum
height of twenty-five (25) feet. A later Variance applying those same rear setback and height
standards was approved February 08, 1993 for the adjoining 50 x 50-foot lot. This later
Variance, however, has not been used for development of this lot.
As we have discussed, under current Land Development Regulations, construction pursuant to
a Variance must commence within 365 days of a Variance order; otherwise, the Variance
expires. Such time limitations, however, were not in effect in 1993. Information contained
within the property file maintained by the Office of the City Clerk seems to establish an intent
that this Variance was granted transferable without respect to when construction occurred. I
have discussed this Variance with City Attorney Alan Jensen, and it is our concurrence that the
Variance approved February 08, 1993 should be considered as transferable to run with the title
to the property.

In summary, the terms of that Variance, which allow a structure (a garage apartment was
specifically addressed within the Variance) with a rear yard setback of ten (10) feet and a
maximum height of twenty-five (25) feet, remain valid. Future development of the property
shall be subject to all other applicable Land Development Regulations.
With regard to potential to redevelop your property (both lots) with a two-family dwelling,
with only 5000 square feet of lot area, the property is not of adequate size to construct a
duplex. Further, duplex use would not be consistent with Section 24-85 (enclosed), which
limits Nonconforming Lots of Record to a single-family dwelling only.
Please retain a copy of this letter for your records, and I would suggest that you provide a copy
of this letter along with any future application for building permits. You may call me at 247-

Hawkes-owner)
Geor%e Worley, City Planner, reported Townsend
Hawkes was the owner of an oceanfront home at 1771
Beach Avenue and a 501 x 50' lot directly across
Beach Avenue . Mr. Hawkes desired to construct a
freestanding building containing two living floors
Yabove a garage level . The proposed structure would
encroach to within ten feet of the rear property
line. The proposed use of the building would be
the primary residence for Mr. Hawkes. Mr. Worley
stated a 501 x 50' lot was a substandard lot and
required a variance for any construction thereon.
In addition a variance to the rear setback
requirement was also needed and the building height
limitation was reduced in direct proportion to the
reduced size of the lot.
It was explained the original request to construct
the building was denied by the Community
Development Board. The Board felt the lots had
originally been platted to provide additional
parking for the oceanfront homes and not intended
for the construction of homes. The Board also
expressed great concern for the potential adverse
impact of additional traffic and restriction of
parking in that vicinity.
Hans Tanzler, a lawyer representing Mr. Hawkes,
reported Townsend and Virginia Hawkes wished to
supplement their income with the rental property.
He explained property owners in the area, formerly
known as Seminole Beach, were told prior to their
agreeing to annexation that their right to develop
property would not be more restrictive under
Atlantic Beach than it was under Jacksonville. The
rear setback would have been only 10 feet when the
property was part of Jacksonville and the structure
could have been constructed.
Alan Jensen, City Attorney, advised that because of
the promise that was made prior to annexation, and
the fact that other property owners in that area
had been granted variances based on similar logic,
a denial of this request would not be defensible in
court.

Commissioner Fletcher was concerned with the
height of the structure as well as the precedent
the structure would set. He added the City had a
substandard zoning code for a reason and that was
to limit the density in certain areas. Mayor
Gulliford felt the Commission should be fair and
even-handed. He added beach communities were dense
by nature.

7B. Appeal of variance denial by Community
Development board to keep a screened enclosure
(Laurie Hesketh)
George Worley reported Gudron Morrison, represented
by LoriHesketh, constructed a screened enclosure
at the rear of her home at 403 Seaspray Avenue in
violation of the required rear setback.' Ms.
Morrison applied for a variance to keep the
structure as built. The Community Development "
Board discussed the fact that no permit was pulled
and that the violation could have been avoided had
the normal process been followed.
EXHIBIT A-ORDINANCE NUMBER: 90-03-184
Sec. 24-85. Nonconforming Lots, Uses and Structures
(a) Intent. Within the established Zoning Districts, there exist Lots, Structures and Uses of Land that
were lawful prior to the adoption of these Land Development Regulations. Such Lots, Uses and
Structures would be prohibited, restricted or regulated through the provisions of this Chapter or the
adopted Comprehensive Plan. It is the intent of this Section to recognize the legal rights entitled to
property owners of existing Nonconforming Lots, Uses and Structures, and to permit such non-
conformities to continue in accordance with such rights, but not to otherwise encourage their
continued survival. Furthermore, the presence of any nonconforming characteristic shall not be
considered as justification for the granting of Variances, and any Nonconforming Structure or Use,
which is made conforming shall not be permitted to revert to any Nonconforming Structure or Use.
(b) Nonconforming Lots of Record.
(1) Where a Lot or parcel of Land has a Lot Area or frontage that does not conform with the
requirements of the Zoning District in which it is located, but was a legally established and
documented Lot of Record prior to the adoption of this Code or previous Codes and applicable
City of Atlantic Beach ordinances, such Lot or parcel of Land may be used for one Single-family
Dwelling in any residential Zoning District, provided the minimum Yard requirements for that
residential Zoning District are maintained, or provided that the owner of said Lot has obtained a
Variance from the Community Development Board, in accordance with the requirements of
Section 24-64 of this Chapter.
(2) In any residential Zoning District, on a legally established and documented Nonconforming Lot
of Record that existed prior to the initial effective date of these Land Development Regulations, a
Structure may be expanded or enlarged provided such expansion or enlargement complies with
other provisions of this Chapter, including Yard Requirements or with the terms of a valid
Variance.
(3) After the initial effective date of these Land Development Regulations, no Single-family,
Townhouse, Two-family (Duplex) or Multi-family Structure shall be allowed on a Single-family
Residential Lot or a combination of such Lots unless the total Lot Area proposed for
Development complies with the regulations as set forth within this Chapter and with the Density
limitations as set forth within the Comprehensive Plan, unless otherwise exempted in preceding
paragraph(1)or in accordance with a valid unexpired vesting determination.
(4) After the initial effective date of these Land Development Regulations, no Lot or parcel in any
Zoning District shall be divided to create a Lot with area or width below the requirements of this
Chapter and the Comprehensive Plan.
(c) Nonconforming Structures.
(1) No Nonconforming Structure shall be expanded or enlarged unless such expansion or
enlargement complies with other provisions of this Chapter, including Yard Requirements, or
unless a Variance has been obtained from the Community Development Board, in accordance
with the requirements of Section 24-64 of this Chapter.
