This property is a portion of a large lot that was originally platted as Lot 60 of the North Atlantic Beach subdivision. This lot has, over time, been subdivided and developed in a manner that is not consistent with the adopted Comprehensive Plan or the City's Subdivision regulations. I cannot explain how these divisions occurred, since they seem to have taken place a good many years past. The City's building permit files indicate that there are two duplex structures (a total of four units) located on this roughly 100-foot by 100-foot parcel. Amendments to the City's Land Development Regulations, which became effective January 01, 2001, addressed existing duplex structures. I have enclosed a copy of these provisions as contained within Section 24-86. In summary, this provisions allows for the reconstruction of lawfully existing duplexes (meaning constructed with proper Building Permits) within their original building footprint, subject of course, to compliance with applicable Florida Building Codes including required fire-wall separation. While this provision addresses reconstruction of lawful duplexes, it does not provide for the subdivision of lots in a manner inconsistent with the Subdivision regulations. Section 24-255 of the Subdivision regulations (below) requires new lots to contain 7,500 square feet of lot area and a minimum width of 75 feet at the Building Restriction Line. Unfortunately, your property is not of sufficient size to meet this requirement. Sec. 24-255. Lots. (a) General. Lot size, width, depth, shape and orientation, and the minimum Building Setback lines shall be appropriate for the location of the Development and for the type of development and Use proposed. Lot arrangement and design shall be such that all Lots will provide satisfactory and desirable Building sites. In no event shall a residential Lot created after Page two Ms.Clark January 22,2003 the initial effective date of these Land Development Regulations have a width of less than seventy-five (75)feet at the Building Restriction Line, or shall it contain less than seven thousand five hundred (7,500) square feet unless approved as part of a Planned Unit Development. I am aware of no current process, other than approval of a subdivision waiver by the City Commission, that would allow you to divide this property into two 50-foot by 100-foot lots. I must advise frankly, however, that because the existing development exceeds the density limitation of the Comprehensive Plan, it would be difficult for staff to support a property division that would have the effect of increasing the Comprehensive Plan nonconformance. Any construction that exceeds the existing footprint shall be in compliance with all applicable provisions of this Chapter including minimum Yard Requirements. Design and Construction Standards for Two-family (Duplex) Dwellings and Townhouse Units (a) Development of Two-family(Duplex)Dwellings and Townhouse Units, occurring after the initial effective date of these Land Development Regulations, shall be allowed only where Lot Area is in compliance with the Density limitations as set f orth in the Comprehensive Plan, unless otherwise determined to be a Vested Development in accordance with the terms of this Chapter. Within areas designated by the Comprehensive Plan for High Density residential Development, a minimum Lot Area of 2175 square feet shall be required for each Dwelling Unit. For areas designated as Medium Density, a minimum Lot Area of 3100 square feet f or e ach Dwelling Unit shall be r equired, a nd within areas designated by the Comprehensive Plan as Low Density, a minimum Lot Area of 7250 square feet for each Dwelling Unit shall be required. (b) Two-family and Townhouse Dwelling Units shall be separated by a firewall which shall meet the Florida Building Code firewall separation requirements for Multi-family construction. (c) Dwelling Units separated by a breezeway, or similar type connection, shall not be considered as Two- family Dwellings or Townhouses, and shall be required to meet regulations applicable to Single- family Dwellings.
