This illegal "work" slanders the title of my clients, the Russells. Additionally, it appears that this improper activity is a part of your long standing harassment of the Russells which has become so overt that it is actionable in law. We insist that all of your encroachments be dismantled and the 40 feet be reestablished immediately. Present for the meeting were John McManus and his attorney, Steve Durant. Representing the City were City Manager Richard Fellows and Community Development Director Rene' Angers. Also present were Ruth Gregg and Kathy Russell, both of the Community Development Board. The City Manager opened the meeting and for the record, stated that the proceedings would be very informal and asked Rene' Angers to present the facts in the case. Ms. Angers reported the City had come into information showing what appeared to be a violation of fence height along the northeast quadrant of the fence line owned by McManus, and across a portion of the front of the property. Research of the Jacksonville fence Ordinance indicated fence heights of no greater than eight feet along the back and sides, and four feet from the side yard opposite the front of the building across the front of the house. The existing fence is 7.9 feet more or less on the south and west sides, and along the north side, the fence in some places, exceeded ten feet in height. Some discussion ensued with comments from Mr. McManus and Mr. Durant relative to the basic reasons for the establishment of fence heights, etc. Following this discussion the City Manager summarized the existing situation to which all parties appeared to concur. The summary was: 1. McManus built the fence without permits for the foundation part; 2. Portions of the fence along the northeast quadrant and in front were constructed after the property became annexed to the City of Atlantic Beach and therefore, rightly, should come under the City of Atlantic Beach Ordinance which requires back and side fences no higher than six feet and front yard fences no higher than four feet. There was a general discussion concerning the problem following which the City Manager stated it was not his authority to grant any relaxation of the terms of the Ordinance, and without other alternatives the homeowner, McManus, would be required to reduce the fence heights which were constructed while the property was in the City of Atlantic Beach to conform with the Atlantic Beach Ordinance. He did suggest that some relief from the situation might be given if Mr. McManus wished to file an application for a variance after the fact with the Community Development Board and that he would be willing to stay any further action until that decision were made. However, he asked that a time certain be established during the hearing when a decision would be made by McManus and his attorney as to the actions they wish to take. Following further discussion, Attorney Durant, on behalf of Mr. McManus, stated that on or before September 30, 1988, the homeowner would either cut the fence down and come into compliance with the Ordinance, or would have filed the necessary papers for applying for a variance with the Community Development Board.
