Murray Benz 1955 Beacbside Court Mlantic Beacb, FI., 32233 To: Tree Board Atlantic Beach This letter is to explain the circumstances surrounding the situation which resulted in our removal of five palm trees from the backyard of our property at the address shown above without application from the City of Atlantic Beach for a permit for tree removal. In August of this year,my husband and I arranged to take time off from our jobs to go to the office of Building and Permits at City Hall because we had several questions that we wanted clarified regarding covenant restrictions,building codes and tree permit requirements. We were told that Don Ford was not in,and were referred to Ms. Sonya P. Doerr to answer our questions. Ms. Doerr was very pleasant and explained that she had just been hired by Atlantic Beach,coming to her new job from St. John county. On the day that we were in her office, she was still unpacking boxes. Ms. Doerr answered the questions we asked about tree permit regulations,i.e., did we have to have a permit to remove palm trees from our property. She informed us that Atlantic Beach required a tree permit for hardwood trees, but not palm trees. She appeared to be confident of this information and my husband and I had no reason to question information passed along to us by someone in her position with the City. Subsequently, we took bids on our pool and selected a contractor. The plans were submitted to the City for approval and in October,we contacted Tree Masters, Inc.,and had five palm trees removed from our backyard,which is completely enclosed by fencing,in preparation for construction of our pool. Neither Surfside Pools(who handled our other permitting)or Tree Masters ever asked us about a tree permit, which supported our belief that it was not required in Atlantic Beach. After the pool construction had started, an Atlantic Beach building inspector contacted us on behalf of Don Ford and inquired whether or not we had applied for a permit for removal of the palm trees. I explained our earlier visit to the Building and Permits office and produced Ms. Doerr's business card on which I had taken notes of our conversation. The inspector said he would advise Mr. Ford of the circumstances,but suggested I also contact him and explain what had happened. I did this,and Mr. Ford stated he was sorry for the confusion and believed what we had told him because Ms. Doerr had quoted the rules that applied to St. John county tree permits. Mr.Ford suggested that we go ahead and complete an application for removal of the trees,provide a letter from Tree Masters describing the trees that were removed, and he would verify our explanation to the tree board. Our pool construction is now complete and we have replaced all five palm trees. My husband and I regret the apparent violation of the requirements,but hope the Board understands that it was certainly our intention to move forward with our pool project in total compliance with all requirements and gave it our best effort. We find it surprising that a simple question regarding tree removal is not included in the permitting process,which would safeguard the citizens of Atlantic Beach from contractor oversight. Present were Chairperson Mae Jones, Richard Bell, Camille Hunter, Judith Jacobson, Building Official Don Ford and Susan Dunham. 1. Call to Order Chairperson Jones called the meeting to order at 7:35 p.m. 2. Recognition of Visitors None. 3. Approval of Minutes of Meeting of August 6, 2001, and August 11, 2001 A motion was made by Board Member Jacobson,seconded by Board Member Hunter and unanimously carried to approve the Minutes of the Tree Conservation Board Meeting of August 6, 2001. A motion was made by Board Member Jacobson,seconded by Board Member Bell and unanimously carried to approve the Minutes of the Tree Conservation Board Meeting of August 11, 2001. 4.A. Old Business/Tree Removal Applications 1) The north 40' of Lot 5,together with the south 40' of Lot 4,Block 130, Section H: Mr. Buddy Martin introduced himself. Mr. Martin advised that the company they hired to clear lots 3 and 4 mistakenly cleared a good portion of this lot. He further stated that the survey included with their application was completed prior to the clearing of the lot. Board Member Bell expressed his concern that the survey for this site might be inaccurate since the survey for agenda item 4.A.2)Lot 6 together with the south 10' of Lot 5 was inaccurate. Mr. Martin stated that he disagreed that the survey was inaccurate because he personally verified the survey. The Board reviewed Sec. 23-17(g)(3)(c), page 1359, of the Tree Ordinance. Mr. Martin stated this section of the Ordinance would only pertain if the Board members were unable to determine the trees that were removed; he has a survey which shows the trees on the property. The Board agreed that an inch-for-inch replacement penalty was adequate. A motion was made by Board Member Jacobson, seconded by Board Member Bell and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for the removal of 28" of protected oak to be replaced with 28" of oak in light of the fact that the oaks were cut down before the permit was issued. 2) Lot 6 together with the south 10' of Lot 5, Block 130, Section H: Mr. Martin stated that he believes this survey is also correct. Board Member Jacobson stated she found a 13.37"pine tree that was not shown on the survey. Chairperson Jones stated that the maple cluster located to the back of the lot on W. 6'h Street is 30"and the 3"and 7"maples are not maple trees. Discussion was held with regard to the survival rate of the trees in the lower portion of the lot if the lot were built up. Board Member Hunter stated that the applicant could not fill the lot with any dirt if he expected the trees to survive. Board Member Bell suggested moving the trees in this lower portion to another part of the lot. Minutes of Tree Conservation Board DRAFT August 20, 2001 Page 2 Building Official Ford advised that the side yard setback for a corner lot is 15 feet so the applicant would have to move the house 4.2 feet to the north of its current proposed location. Board Member Bell stated that moving the structure to the north could possibly affect the double pine. Building Official Ford stated that the applicant has room to move the structure to the north and the west. The Board discussed other inaccuracies of the survey. Board Member Bell stated that there are more trees in the southwest corner of the lot by the maple cluster. Chairperson Jones stated that the 3"maple and the 7"maple were not maple trees but she was unsure of the correct species. Board Member Bell advised that the 6"oak cluster is actually an 8"oak cluster. The Board determined that the applicant needs to mitigate for a 27"maple, a 10"maple and a 22"pine for a total of 59"of hardwood. A motion was made by Board Member Hunter, seconded by Board Member Jacobson and unanimously carried to approve the application and direct Building Official Ford to issue a permit for the removal of 59" of hardwood to be mitigated by 29.5" of hardwood which 23" has been identified on site leaving 6.5" of hardwood to be identified on site, planted on site or pay into the Tree Fund. Discussion was held with regard to whether or not the applicant could move trees from one lot to use as mitigation for the other lots. A motion was made by Board Member Jacobson, seconded by Board Member Hunter and unanimously carried that the 28" of protected oak required as mitigation for the protected trees removed on the north 40' of Lot 5,together with the south 40' of Lot 4,Block 130, Section H, can be mitigated anywhere on this lot or on Lots 1, 2 or 3, Block 130, Section H. 5.A. New Business/Tree Removal Applications: None. 6. Reports and Announcements: The Board discussed lyme disease. Chairperson Jones requested bug suits for all the Tree Conservation Board members. Building Official Ford stated that the City wants to protect the Board members and he would order the bug suits. Discussion was held with regard to the Board members becoming weary of having to correct inaccurate surveys. A motion was made by Board Member Jacobson, seconded by Board Member Bell and unanimously carried that the Tree Conservation Board establish standards of accuracy effective August 20, 2001, for tree surveys submitted with applications. These standards are determined by the requirements as set forth on the application and in the Tree Ordinance. These standards include but are not limited to the placement of the tree(s), size of the tree(s), indication of the lot line, relative position of the tree(s) and the marking of the tree(s). If a total of three standards are not met on any survey, Tree Conservation Board members will reject the survey as inaccurate and communicate the survey's inaccuracy to the Building Official or at the Tree Conservation Board meeting. Present were Richard Bell, Judith Jacobson, Barbara Mears, Carol Rockwood, Maureen Shaughnessy, Building Official Don Ford and Susan Dunham. 1. Call to Order The meeting was called to order at 7:36 p.m. 2. Recognition of Visitors None. 3. Approval of Minutes of Meeting of November 19, 2001 A motion was made by Board Member Shaughnessy, seconded by Board Member Rockwood and unanimously carried to approve the Minutes of the Tree Conservation Board Meeting of November 19, 2001. 4.A. Old Business/Tree Removal Applications None. 5. New Business A. 715 Seminole Road: Mr. Chris Lambertson introduced himself to the Board and stated that he would like permission to plant a few trees required for mitigation in the City right-of-way in front of this house. He stated that the land available for planting is very limited and he would not be able to plant trees ten feet apart. Building Official Ford advised that he spoke with the Public Works Director who has no issues with planting trees in the City right-of-way. However,the Public Works Director would like to see a landscaping plan prior to planting. Mr. Lambertson advised that he would like to plant oak and pear trees and would need to plant approximately 18"in the City right-of-way. . A motion was made by Board Member Jacobson, seconded by Board Member Mears and unanimously carried to approve the request as submitted. B. Tree Removal Applications 1) 3317 th Street: The applicant was not present to address this application. The Board determined that the trees numbered 5 and 21 are actually one double trunk China Berry tree and tree number 13 is an 18" palm. It was determined that the applicant needs to mitigate for 28"of palm, 22.8"of Chinaberry and 16.56"of magnolia. A motion was made by Board Member Rockwood, seconded by Board Member Mears and unanimously carried to approve the application and direct Building Official Ford to issue a permit for the removal of 28" of palm and 39" of hardwood to be mitigated on site with 14" of palm and 19.5" of hardwood. Staff is to research China Berry trees and if they are considered nuisance trees, then the hardwood mitigation requirement is to be reduced by 11". 6. Reports and Announcements: A. Update on 371 8th Street: Building Official Ford advised that upon receipt of the letter from Early Piety dated October 31, 2001, he advised the applicant that the 24"maple tree could be removed. Board Member Mears requested that an expedition in the woods be organized to assist the Board members in identifying different species of trees.
