As per the instruction manual, the cooktop was installed incorrectly. Heat reflective tape must be applied around the cutout to protect the granite surface. The brackets, which were included, must be used to attach to the burner box. The downdraft must be tightly secured, including using the enclosed hardware, or it will rattle and make it unusable when turned on. The granite slab is presently floating above the 2x4 wood frame underneath. The wood frame underneath must be properly leveled to support the granite slab, or any heavy weight applied to that corner in the future will crack the granite. Bottom line, please, please, please read all the manuals before installing any of the appliances to make sure they are properly installed. The short amount of extra time doing so will be well worth not having to repeat the previous steps, setting you further behind. We spent a great deal of money on this kitchen. We don't want any problems with these appliances requiring repairs 5 years down the road because things were not installed properly the first time. Please use your best workmanship, which we know you are capable of. It should be a beautiful kitchen when completed and should be an outstanding advertisement of your work and abilities. The deadline of February 1, 2003 has long since past and I estimate that your work is only about 25% complete at best. It also appears that you have completely abandoned our project since you left for your unannounced Colorado ski trip Feb 1, 2003. You left our kitchen in an unsafe and unlivable condition. You have clearly breached the terms of our contract dated 12/3 and 12/6/02. Therefore, let this letter serve to formally terminate our contract to remodel our kitchen. There are three key issues I need to address. First, you understood the crucial importance of completion of this project by Feb 1, 2003 as stated in our contract. My wife's due date for our baby was Feb 7, 2003 and we wanted all the work completed to assure we had a functional kitchen, a clean, quiet, and safe house for our two childrea, and freedom from many various workers in our house after my wife returned from the hospital. We included a clause of completion by February 1 with a $1000 late fee which we hoped would motivate you even more to complete on time. You reassured us multiple times that you would have the project completed. You understood that we would wait until long after the baby was born to attempt this project if there were any concern that you could not complete it in time. You gave us a construction schedule (see enclosed) which you never followed. You spent a bare minimum of your own time at our house and would go many days without showing up until I would call you to come by. Then you would make a five minute appearance and claim that you were working on cabinets at home, which we have yet to see. You hired an electrician who would come to our house after his regular 9-5 job 2295 Oceanside Court Atlantic Beach, FL 32233 with the city to work part time at our house. You had a painter who alone was supposed to come to our house to paint on Feb 1, 2003. He had "car problems" so he rescheduled to the second, then the third, and when he finally showed up the morning of the fourth, we were in the hospital delivering my newborn. He called me on my cell phone at the hospital and we rescheduled for that evening at 5PM when I would be home. He then called me at home that night to say he could not make it then either but wanted to reschedule again. He also asked me how long it would take for him to paint and if I would pay him when he was done. At that point I told him not to come. I called another painter who had worked for me in the past and he with three other workers had the whole area sanded, painted, and cleaned as well as repair drywall and popcorn that your other subcontractors had missed, in time for my wife's return home from the hospital in two days. It seems that you overextended yourself with 4 other construction projects that you were completing, which seemed to take priority over ours and you hired cheap, unreliable workers to come to our house whenever they could make it. You never had any intention of meeting our deadline. Of second importance, is your willingness to cut corners and sacrifice safety, not to mention sacrificing quality of your work. You broke away a supporting wall and did not support it properly and more importantly, covered it with sheetrock before the building inspector, Mr. Higgins could inspect it. He came in on 2/7/03 and said we will have to break away the drywall for him to properly inspect it and then drywall over it again. I have also notified our architect Mr. Bull on this issue. When you broke that wall, you also left an open fall hazard 12 feet to the granite floor below and half covered it with plywood attached to wall only on one side and flopping in the breeze on the other, which a serious hazard for our 2-year old. I have taken pictures of that hazard and documented it with Mr. Higgins (see enclosed) before I corrected the hazard myself. When you started installation of our cooktop, you refused to put in the metal attachment hardware which was required as clearly stated in the installation manual, and told my wife that it was only needed for wood countertops. When we expressed our concerns about using the aluminum foil tape around the granite countertop as the installation manual clearly requires, you told me that you called the company and they told you it was not needed for granite. We checked up on that and called them ourselves and they stressed the importance of using that tape around the edges of the cooktop to protect the granite as stated in their manual. I worked with Dan the electrician to make sure they were removed from direct contact, but the cabinet will still need more structural support lower down. Mr. Higgins has cited that the stovetop and vent are still not installed properly as per the manufacturer's instructions. When our oven and microwave oven were to be installed, the electrician used a one circuit and undersized cable for the two ovens when two separate circuits and cables are required. It was only after my wife, an engineer, read that installation manual, that she convinced the electrician that it would not be safe to use a smaller circuit and could pose a fire hazard. Mr. Higgins also recommended an electrical safety inspection to insure it has now been installed correctly. When the plumbers cut the old drainpipe from inside my house, they wanted to cap off the open pipe on the roof. You told them not to do it. It has been almost a month and it has not been capped yet, in spite of recent heavy rains. I called Darryl Smith the plumber myself to have him come out and cap it before the rains do water damage to my walls and beams. He apparently had trouble collecting payment from you and had to send his workers to your house to collect payment. Although you are a carpenter by trade, you have manufactured cabinets that are not flush at top and will not evenly support the weight of the overlying granite and might cause the granite to fatigue and crack after years of stress. You promised we would be able to reuse a substantial amount of our old oak cabinets and you would restore them to bring them up to the quality of the new cabinets you would make. You, however tried to install my old cabinets that were split in the back. I had to run to Scotty's late one night to buy some plywood for you to reinforce the backs of those old cabinets so they would hold up with the new manufactured cabinets. Of final importance is your downright dishonesty. You have repeatedly lied to us, telling us that workers were coming to install appliances, that you had people lined up to bring the refrigerator upstairs, that workers were on their way to paint the walls and ceiling, and that you would have all the new cabinet work completed by February 1 . We have repeatedly waited at home waiting for these phantom workers who never seem to appear. We have documented many of your lies. For instance, you told us that our granite contractor Hani could not come on schedule to install the granite, when instead, you did not have our cabinets ready for him. We signed our contract with you on December 6, 2002 and gave you $8800.00 up front as a deposit and told you to order the balusters immediately because it would take 4-6 weeks to have them ready from our experience ordering them 2 years ago. When I spoke to you on January 27, 2003, you asked for a sample of that baluster. When my wife asked you with concern whether you already had them, you lied and said they were ready and your wife was picking them up January 29, 2003. Your half-brother informed me on February 2, 2003 that they have just been ordered and won't be ready for another 4-6 weeks. You even bragged to my wife how well you lied to a previous client. When that client complained that you painted her garage door the wrong color, you quickly lied that the color was a "primer" and the real paint would be applied over it. I could go on with an exhaustive and documented list of your lies to us. Suffice it to say that you did not plan to inform us that you were running away on a Colorado ski trip on February 1. You tried to have your stepbrother and the electrician cover for you with yet another preposterous lie, but we didn't fall for it. You left your stepbrother John (who describes himself as "Steve's flunky") in charge. He came to our house February 2, 2003 reeking of alcohol and could not tell us how to reach you, where our cabinets were, or if any further contractors would be by to do any work. Of note, the sheetrockJwall floater man came to my house that day to pick up the check you promised him. Your brother told him that you left him without any money to pay the subcontractors. Since you were away, I have had the work area sanded and painted ($975) and had movers get the refrigerator out of my garage ($642). I have had to pay top dollar to get people at the last minute to come in and finish the project piecemeal, rather than price it out which I would normally do, if I were in a better position and not left stranded. I will settle in full all claims against you under the following terms only: 1) Return of al! my old oak cabinets including the doors and one old baluster which you presently have in your possession, as well as all the new wood doors and panels which I purchased on January 21, 2003 with the $2288.98 change order. It will need to be brought to my garage and every wood panel must be accounted for. If I do not have them in my possession by February 18, 2003, then 1 will assume that you wish to keep them and I will be forced to repurchase new material in order to complete my project soon. I will not accept them after that date. 2) $5000 (cashier's check only) refund from my initial $8800 deposit. When my project is completed as per our initial contract, I will seek in court restitution for damages in the amount that the project costs to complete above the $17,600 initially agreed upon. So far I have spent $8800deposit + $2288.98 change order + $975 painting + $642 moving + $1515.12 sink, faucet, garbage disposal as per our contract (so far totaling $14221.10). I can assure you it will be much more expensive to piecemeal the rest of this project until completion, especially if I have to repurchase wood materials. 2) I will pursue fraud charges against you personally. 3) I will pursue a full investigation and hopefully suspension of your CGC license with the Department of Business and Professional Regulation (construction industry licensing board). If you settle with me personally before February 18, 2003, then I will drop the above suit for damages, your license investigation, and my complaint to the Better Business Bureau. It's up to you, but you better act fast. This offer will no longer be available after February 18, 2003 Finally, for the record, I am far from naive to the construction process. I completely renovated my first house in Oregon while living inside. I have done extensive remodeling work on my present house. I have purchased vacant land from a developer on which I have built a 5500 square foot commercial office building in which I now work. And as I told you, before my father died, he owned a granite and marble company. I am well aware of the patience required to undergo the remodeling process. Our expectations were quite realistic. My wife and I were more than patient with moving all our possessions out of the kitchen and relocating our billing office so that you could work. We survived almost three weeks without a sink, cooktop, or oven. W I T N E S S E T 11 WHEREAS, Developer owns land in Duval County, Florida, more particularly described as Lot 23 Unit I Beachside refer to acreage, plat engineering 1964 Beachside Court drawings, or legal description as Exhibit A and WHEREAS, Developer plans to develop said land by constructing 1 buildings,' 1 residences and/or other improvements thereon consisting o£' " Single Family and WHEREAS, City is the owner of water and sewage treatment plants and water distribution and sewage collection systems in the vicinity of the property described above; and WHEREAS, Developer desires that City provide water and sewage collection service to said property and City desires to furnish same; and t to them and to their occupants water and sewer service subject to all terms and conditions of this Agreement; and WHEREAS, in order to provide water and sewer services to Developer it has been or will be necessary for City -to enlarge and expand its offsite water and sewer plants and facilities and it is the desire and intent of Developer to contribute financially to the costs of building such additional offsite water and sewer plants and facilities and to reserve capacity in City's water, and sewage treatment plants so that City can provide service to .the Development without imposing a burden on its existing customers; NOW, THEREFORE, in consideration of the premises and other good and , valuable considerations and in consideration of the mutual covenants and conditions hereinafter contained, subject to any necessary approval by other governmental agencies having jurisdiction, it is .agreed by the parties hereto as follows: 1. Developer agrees that City shall have the exclusive right to furnish water and sewer service to the real property described above and hereby grants to City. this exclusive right-to provide water and sewer service for all uses within all structures now or hereafter constructed on the real property described above. Z. City agrees that after Developer has connected to the systems of City, City will provide at its own cost and expense, water and sewer service to Developer's property in a manner conforming to the reasonable requirements of public or governmental agencies or parties having jurisdiction over City's water and sewer operations; provided, however, that such service shall be in accordance with other provisions of this Agreement, including City's rules and regulations and rate schedules. 3. In the event that Developer or assigns fails to complete construction of all improvements required to be built by Developer and Agreement under this provision, City reserves the right to negotiate with Developer a new agreement for any additional sums to be paid by Developer to City as plant capacity and service availability charges, fees or other charges based upon increases in the cost of living and/or such other factors as relate to the cost of supplying water and sewer service. 4. All taxes or charges imposed upon the property described above by any governmental entity or agency shall be paid by Developer except such part thereof that has been deeded to the City in accordance with tho terms of tills agreement. S. The rates charged by City for water and sewer service shall be in accordance with its rate schedule which shall be subject to change • from time to time. City shall have the right to determine reasonable meter size and location. G. Developer will grant to the City, at Developer's expense, adequate easements for water and sewer lines, for access to lift stations and water stations and related appurtenances. Said easements shall be transferable. Developer will also furnish title evidence satisfactory to the City that said easements are superior to mortgages or other interest in the land, and Developer shall cause any such mortgages to be released or subordinated to said easements. Easements will also be furnished to provide for onsite water distribution lines, including meters and sewage collection lines. Sites for lift stations and water stations and related appurtenances shall be conveyed by warranty deed in fee simple by Developer • to City. Developer will furnish City a warranty deed, title evidence satisfactory to City and any releases from lien holders for any sewage pumping station and water 4 to said state road right-of-way. Developer shall further grant to the City, its successors and assigns, the exclusive, perpetual right, privilege and easement to construct, reconstruct, operate, maintain, repair, replace, improve, alter, remove, relocate and inspect water transmissions and distribution mains, sewer collection mains, sewer lift stations, pipe lines, lateral lines, valves, connections and appurtenant equipment over, across and under the Developer's property, including the right to ingress and.egress to each of the building sites on Developer's property which are served by City. All such easements shall have a .width which is acceptable to the City. 7. City does not guarantee an uninterrupted supply of water, or water at any particular pressure, and reserves the right to shut off the water in its main at any time for the purpose of making repairs or extensions of for providing temporary or emergency water supply. City will not be responsible for any damage caused by low pressure or interruption of service. Neither Developer nor any of its successors or purchasers shall discharge into the sanitary sewer system water from "non-domestic" drains including without limitation swimming pools, air conditioning condensation lines, cooling lines or other discharge from any type of equipment. City shall not be obligated to furbish any water or sewer service to any building which is built on Developer's property to which the City does not have access. The Developer hereby agrees and warrants that the City will not be held responsible. for flooding problems which may result from the failure of sewer line back flow preventor valves on Developer's property. The Developer hereby agrees to hold harmless and indemnify City for all costs and damages resulting from flooding due to .back flow preventor valve failure. 8. The construction and design of all facilities to be Developer or its contractor. Developer will pay the cost of all such construction. The Developer's engineer shall incorporate into the Developer's engineering design, plans and specifications the applicable standards and specifications of the City. 9. A. If the Developer modifies his development plans for Developer's property which would require greater water usage, greater fire flows, additional water facilities, greater sewage flows, or additional sewage facilities than the water and sewer demands previously approved by the City, then the Developer must obtain approval by the City for the construction of such additional water or sewer facilities which shall meet all City and governmental design requirements. The Developer shall pay all additional contributions and fees as may be authorized by the City's' service availability policy which is in effect on the date said new agreement is executed. B. In addition to paragraph 9A above, any other change order between Developer and its utility contractor issued after City approval of original plans must be approved by the City before the change order is put into effect. C. City shall have the right to review the systems design drawing and specifications to ensure that they meet the requirements of the City. The systems design drawing and specifications are to be in accordance with the City of Atlantic Beach requirements unless otherwise .specified by City or its engineer. D. The City also reserves the right to approve the utility contractors to which construction bids are sent by Developer as well as the contractor to which the award is made. E. A representative of City or its engineers will be the inspector of the nroiect along with the I)PvPIlnirarle absolute and exclusive owner of the facilities of said water and sewer systems whether located on, under, above or outside of the property described and regardless of who may have installed or constructed same to the extent described below: A. All water mains, pipes, valves and fittings and appurtenances up to and including all meters shall be dedicated to and will be owned, operated and maintained by City. All water pipes on the customer's side of the meter shall be owned, operated and maintained by the customer or its assigns. , D. All sewer mains, manholes, pumping stations, force mains and appurtenances, including service pipes in public right of ways and dedicated easements, shall be owned, operated and maintained by the City. Except as provided in paragraph 9C, all sewer lines on the customer's side of the property line shall be owned, operated and maintained by the customer or its assigns. C. with reference to any blanket easements for multi-family projects such as apartments, mobile home developments, condominiums and PUD's or for commercial developments, all water mains to and including the water meter, all sewer mains, force mains and manholes in such blanket easements over private property allowing utility operations shall be dedicated to and shall be owned, operated and maintained by the City except that the full length of sewer services from the sewer main or manhole shall be owned and maintained by the customer. All such City lines shall terminate with a manhole. U. By these presents, Developer hereby transfers to the City, the title to the water distribution and sewer collection systems to be installed pursuant to this Agreement, such . conveyance to take effect without further action upon the completion and acceptance by City ` 11. Developer shall pay the City upon, execution of this Agreement the sum of 10¢ per water connection per equivalent residential connection (ERC) as an advanced deposit to cover engineering, plan review, inspection, test, legal and administrative expenses of City in connection with this Agreement. Developer shall also pay to City upon execution of this Agreement the sum of 10¢ per sewer connection per ERC as an advanced deposit to cover engineering, plan review, inspection, tests, legal and administrative expenses of City in connection with this Agreement.
