I do not consider my letter to be any form of "extortion". It was simply to put you on "written notice" that there were problems with the roof you installed, and that Mr. and Mrs. Zubia would like someone to come, out and look at it. Mrs. Zubia showed me several pictures of the problem, and it appears to me that the roof is leaking in at least two places, if not more. It is definitely not water intrusion as a result of flooding or other source. While I realize that your contract calls for written notice, it seerns to me that a responsible businessman would respond to a call from a customer when the installation was less than one month old. When Mrs. Zubia called your office, she got the distinct impression that no one cared about the problem, and that if you responded at all, it would be when you felt like it. I am not trying to "stir up litigation", as my practice involves very little litigation. We simply wish to have someone from your company respond to the problem as soon as possible. I might also point out to you that Mrs. Zubia contacted the building inspector for the City of Atlantic Beach when she got no response from your company other than "send us a letter". The building inspector was quite surprised to find out that the work had been completed, but no inspection had been requested by you. He told her that is a violation of the permit, which requires a final inspection. If you do not consider my prior letter, or this letter, as a valid warranty claim, then I will have to advise Mr. and Mrs. Zubia to find someone else to perform the necessary repairs and to hold 10 Your company responsible for the costs.
