The neighbors are for some reason under the impression that they have to get permission from the City Commission to replace the track. I was over there a bit earlier and it was quiet,just like it has been every other time I have been over there, but the sight is a disaster. I have tried to find out more about the history of this property, but can't find much before 2000, when the current building was constructed. And looks like the new building replaced an old building. Under current regulations, approval of a Use-by-Exception would be required for the"sale of new and used automobile, motorcycles and boats...." However, in the old Zoning Code, a UBE was required "for the sale of new and used automobiles and boats" with no mention of motorcycles. After almost 8 years of seeing how George interpreted the zoning regulations, I think it is safe to assume that he would have not required a UBE for this business. It was simply permitted as a metal warehouse and was entirely typical of the other buildings and uses on the south end of Mayport Road at that time. I can't find any reason or justification to tell the owner that his existing business is not a Permitted Use, or to tell him that they cannot reconstruct the "practice track" they have had for many years unless they are violating the noise ordinance. We have been very clear with him for several years that the track cannot be a primary activity, that it cannot be operated at night, and that if it becomes so noisy that it"adversely effects nearby residential uses," it would not be a permitted activity in the CG district. Their plans do include a wall and buffer as required by the Land Development Regulations. I think we do need to continue to monitor. Hopefully once the sight is cleaned up, and he gets the new wall and buffer installed, this will be resolved. I can't blame the neighbors that are adjacent to this mess for being upset. I am going to send Kirt Lynch a letter reminding him of all of this. I have not when I have been by there. And clearly that mess with the cargo container needs to go. A main purpose of my letter is to document what he has been telling us he plans to do for the past year. Obviously, until we have actual plans submitted for review,we are to some degree speculating on what his intent is. I guess we can hope that he will discover he needs all of the property to meet parking and drainage requirements, and will not have room for any type of track. I have not sent this out yet, but did revise or question the following as I have thought more about it. Used by kids under the age of 16 only when accompanied by an adult. Is 16 an appropriate age limit,or should it be younger? Use of the track shall be limited to the hours between 12:00 noon and 6:OOpm,and such training and education should occur in supervised sessions such that this is not a constantly ongoing activity. Is there a better way to limit this? The original platted lot has already been modified with the City's purchase of the 50-foot wide area at the rear of the lot from the Pate's in 2000,so there is not a "replat" issue. Erika came up with a market value of about$1400 for the roughly 140 square feet they wish to purchase back from the City (based on current COJ Property Appraiser data). And it would probably cost the Johnson's about that much to have a new survey and legal description, etc. prepare. I don't know how they/we need to proceed or what the process is. ...Alan and Jim ?? I have gotten a copy of the deed by which the City obtained the property (O/R 9569-14) on March 6th,2000, however, I have yet to locate the paperwork explaining our reason for purchase, or the purchase price. The Johnsons' submitted their request, stating that Rick& Donna had "walked" the property and had no objection,but the original survey shows a 50' easement running across the back of those lots for the purpose of"drainage,utilities & sewer by plat", as well as concrete drain pipe,concrete headwall and ditch, with note that"this area appears to be landscaped and maintained by others" (the city,perhaps?). Anyhow, I'll work on this more Friday. Just didn't want you to start looking for it and think that it had magically disappeared. (No such luck!) However, we did issue the permit after the applicant applied and showed compliance. However, the fence does not comply with the subdivision standards, which we do not enforce.
