In the most general terms, a wetland is a natural community where water is at or covering the ground for all or part of the year. The key to this definition is the term natural community, which helps to exclude temporary standing floodwaters from being designated as wetlands. Other definitions are more specific and technical and--because the definition establishes what property is or is not subject to regulation by federal, state,or local environmental agencies-- are often controversial. In 1994 a state wide definition of wetlands and surface waters was adopted.This definition of wetlands and surface waters is used throughout the state to establish what property is or is not regulated by state or local environmental agencies. Chapter 62-340 of the Florida Administrative Code, "Delineation of the Landward Extent of Wetlands and Surface Waters",is the state rule for establishing wetland and upland boundaries as well as defining surface waters in the state.Both wetlands and surface waters are regulated under the provisions of Chapter 373,Florida Statutes. Subsection 62-340,Florida Administrative Code defines wetlands and states in part: (9) "Wetlands", as defined in subsection 373.019(17), means those area that are inundated or saturated by surface water or ground water at a frequency and duration sufficient to support, and under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soils. Florida wetlands generally include swamps, marshes, bayheads, bog, cypress domes and strands, sloughs, wet prairies, riverine swamps and marshes, hydric seepage slopes, tidal marshes, mangrove swamps and other similar areas. Surface waters are defined in subsection 62-340.600 which states in part: (1) for the purposes of section 373.421, FS., surface waters are waters on the surface of the earth, contained in bounds created naturally or artificially, including the Atlantic Ocean, the Gulf of Mexico, bays, bayous, sounds, estuaries, lagoons, lakes, springs, creeks, branches, sloughs, tributaries and other water courses....and; (2)(d) the top of bank for artificially created lakes, borrow pits, canals, ditches and other water bodies....
