Upon motion made and seconded the minutes were approved. OLD BUSINESS: I. Application for Variance filed by Kent Enterprises, Inc., to reduce parking requirements and waive island requirement in parking lot for property located at 751 Atlantic Boulevard. John Kent of Kent Theaters introduced himself to the board and presented a revised landscape and parking plan prepared by Ron Slade of Powers &Merritt Architects and drawn pursuant to the landscape code but providing 193 parking spaces which includes the south part of the adjacent property in the overall theater plan. Mr. Kent indicated that the irrigation system is not shown on the plan but would be installed completely according to code. On Mr. Worley's suggestion, the applicant has included a 5-foot grass strip around the south and east side of the north part of the adjacent property where the edge of the theater property consists of a driveway but requested that only eight trees be planted. After discussion, the Chairman moved to grant the variance as presented provided: 1. The irrigation plan be implemented in compliance with city ordinance; 2. The parking requirement be reduced to 193 spaces; 3. The applicant be held to eight trees on the L shape location and clustered in such a way as to be protected in the future and maintained indefinitely by the contractor as well as the owner. Mr. Frohwein seconded the motion. After discussion, Mr. Wolfson amended his motion to exclude the requirement of landscaping at the rear of the property on the north side. Mr. Frohwein seconded the amended motion and the variance was granted by a unanimous vote. NEW BUSINESS: 1. Application for Variance filed by Dorothy Papazian to remodel a nonconforming structure located at 587 Beach Avenue. Michael Leinenweber, contractor for the applicant, introduced himself and explained that Mrs. Papazian had asked him to appear on her behalf. He stated that the applicant desires to construct an addition on the rear of an existing garage to be used as a secondary dwelling. The addition will be attached to the east side of the building and continue along the south line. The original structure was a garage larger than its current size. Half of the structure was demolished and the remaining structure used for storage. After discussion, the Chairman moved to approve the variance and Pat Pillmore seconded the motion. Mr. Frohwein expressed concern about the proximity of the structures and felt that the request was not a minimum request by the applicant. The Chairman indicated that his motion for approval was based on the wrong survey and withdrew the motion. After discussion, Mr Frohwein moved to deny the variance and Mr. Grunthal seconded the motion. The Chairman explained that if a vote was taken and the variance denied the applicant would have to wait a year before reapplying. It appearing that the consensus was denial, Mr. Leinenweber asked that the application be withdrawn to allow the applicant to present a revised application that the board may be more inclined to approve. The Chainnan requested the application be placed on the agenda for the next regularly scheduled meeting. Il. Application for Use-by-Exception filed by Billy Joe Witt to operate a jeep specialty shop at property known as 20 Donner Road. Billy Witt introduced himself and explained that he desired to open a jeep specialty shop in the CL, Commercial Limited district. He stated that no more than two vehicles will be parked outside overnight and no more than four vehicles during business hours. After discussion, Mr. Frohwein moved to recommend approval of the Use-by-Exception with the following conditions: I. The hours of operation between 8:00 AM to 8:00 PM; 2. Not more than two vehicles parked outside overnight; 3. No noise producing equipment operate outside the building; 4. No auto body work performed. The Chairman requested that the use-by-exception be granted solely to the applicant. Mr. Grunthal seconded the motion and the use-by-exception was unanimously approved. 111. Application for Use-by-Exception filed by Adele Grage Community Center to operate a non-profit theater at 716 Ocean Boulevard. Martha Reid, President of the Atlantic Beach Experimental Theater which operates under an agreement with the City of Atlantic Beach and operates a community based theater in a portion of the Community Center which is located at 7 16 Ocean Boulevard. J. P. Marchioli, Peter Coalson, Joan Carver and Pete Dowling introduced themselves and expressed their approval of the request. Bob Weiss introduced himself and explained that he was not in favor of granting the use- by-exception due to the fact that alcohol is served at the premises. After discussion, Mr. Frohwein moved to recommend approval of the use-by-exception. At the Chairman's request, Mr. Frohwein withdrew his motion. The Chairman asked if anyone present had any problems regarding parking at the location. There being no response, Mr. Frohwein restated his motion. Mr. Grunthal seconded the motion and the board voted unanimously to recommend approval of the use-by-exception, IV. Application for Variance filed by Peter Coalson on behalf of Bob Blohm to construct an addition that will encroach the setback requirements of property located at 105 7 Beach Avenue. Peter Coalson introduced himself to the board and explained that Mr. Blohm purchased the property with the hope of constructing a second story garage and covered front stoop. He read several letters from neighbors expressing their support of the improvements. He stated the 60-foot frontage under the present plan would allow for a 54" setback on the north side, a 5-foot setback on the south side and an open breezeway of 56" for an aggregate of 16 feet. Mr. Worley explained that the property consists of two 30-foot lots and the proposed addition will be attached to the original structure by a 5.5 foot long breezeway. He stated that under "Definitions" the code addresses the issue of combining two 30-foot lots. After discussion, Mr. Wolfson moved to approve the variance with the following conditions: 1. That the building be used only for a garage; 2. That no second floor be constructed on the building. Mr. Grunthal seconded the motion and the variance was granted by a vote of 3 - 2 with Mr. Frohwein and Mrs. Walker dissenting. Request for time extension of Variance granted to lots 8 and 9, Ocean Grove Unit 11 filed by Pelkey Builders. The applicant was granted a Variance to the minimum lot dimension requirements for the two lots for the purpose of constructing two single-family homes (see attached minutes). The applicant has completed construction of one home but requests the extension to allow him to begin construction of the second home. The construction to-date has been in accordance with the zoning codes and the stipulations placed on the variance by the Community Development Board. LI + ------- ------- ------ CITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Use by Exception 10-20 Donner Road SUBMITTED BY: Community Development Board DATE: December 12, 1990 BACKGROUND: Use by exception request to operate an automotiveltruck. ' service garage at 10-20 Donner Road. The Community Development Board recommends that the exception be granted with stipulation that the dilapidated automobiles be re- moved, that no long-term outdoor storage of vehicles be permitted and that only three outside parking spaces be allotted to tenants and cqstomers. The City Commission expressed concerns at their December 10th meeting re- garding the term "long-term outdoor storage" and the possibility of imposing hours of operation restrictions. RECOMMENDATION: This type of use is consistent -with similar uses existing on this site in the past. The concerns over the words "long-term" can be clarified with specific hour limitation. A reasonable approach would be to limit outside parking, other than the three for tenants and customers, to no longer than 24, at most 48 hours. The time should be specific. Regarding the imposition of restrictions on the hours of operation - the Commission is clearly within its authority under Section 24-63 to impose additional res- trictions. In addition, nearby residents have expressed concern that operations related to this type of use may continue into the late night unless specific restrictions are imposed. It should be considered that the City has a Noise Ordiance which prohibits unusual and annoying noises between the hours of 8:00 p.m. and 6:00 a.m. If the Commission desires to limit hours of operation for businesses under this "use by exception" these hours would not be unreasonable. Mrs. Russell seconded the motion which was unanimously passed. NEW BUSINESS I. APPLICATION FOR "USE BY EXCEPTION" FOR THE CONSTRUCTION OF A TELEPHONE TOWER IN THE VICINITY OF 251 LEVY ROAD, FILED BY PETER AND DELIA RODRIQUEZ. David Edwards, with Mahoney, Adams & Kriser, 50 Laura Street, Jacksonville, FL, representing Peter and Delia Rodriquez, owners of the property, and Bell South Mobility, petitioning. for a zoning exception to construct a cellular telephone relay tower in the ILW industrial district. Mr. Edwards presented an aerial photograph as well as a survey to the Board to indicate the location of the proposed site. It was explained that the tower would be about 500 feet and 600 feet to the East of Main Street and the majority of uses in this area are industrial-and warehousing. Mr. Edwards stated that t4ere are a few homes in the area and that they are ail over 600 feet from the tower. He stated that he knocked on the doors and explained what they were doing and received no objections from the residents. Mr. Edwards also stated that the tower was only going to be 190 feet tall rather than 280 feet as indicated in the Application and was designed to withstand winds up to 100 mph. The tower would also enable boaters with Mrs. Russell inquired whether the tower would cause interference with individuals witfi cordless phones in the area and Mr. Edwards explained that it should not interfere. In response to a question from Mr. Wolfson, it was explained that the tower would probably have about an eight mile radius and that another tower was located on San Pablo Road. Further discussion followed regarding the tree ordinance that should be conformed to as well as the approval of NAS Mayport. Mr. Edwards indicated that approval of the Navy was in the process and that the tower cannot be built without it. Mr. Wolfson also stated that the Navy would have to sign on the permit. After discussion, Mr. Bass moved that the application be approved. Mrs. Russell seconded the motion. and Mr. MacDonell added that the authorization should be granted subject to the approval of NAS Mayport, and the same was unanimously approved. II- APPLICATION. FOR "UW BY_ EXCEPTJQR!.—FQR AN AUTOMOTIVE/TRUCK SERVICE GARAGE AT 10-20 ,DONNER ROAD FILED By FRED'LEWIS# Paul Eakin, appearing on behalf of Fred Lewis, regarding said application and in support thereof presented that �n Section -24-110 of the Zoning Regulations allows for an automotive garage.by exception. Mr. Eakin stated that the property was previously used for this kind of service but that when the tenant left it was a furniture store and Mr. Lewis desires to rent the property again as an automotive repair shop. He also indicated that there is also a chance that there. may be limited warehousing in connnection with this application which is also allowed by Section 24- 110. Discussion followed in connection with the warehousing uses and/or garage/automotive use of the proposed application. Mrs. Russell indicated that there was no survey attached to the application at which time Mr. Fred Lewis offered to leave the meeting and obtain a copy of said survey for the Board. Discussion followed regarding permitted use and use by exception and it was determined that the proposed usage was allowed under the use by exception section. Mr. Wolfson pointed out that the application is very vague and that the application should be more specific. Mr. Fred Lewis indicated that he always had a problem with his tenant's obtaining the proper licensing and that his property stays empty due to the property not being zoned for body shop use. Further discussion followed regarding the area surrounding the building concerning abandoned and derelect cars being parked thereby creating an eyesore to the community. Mr. Wolfson suggested that Mr. Lewis should possibly take the problem to the Courts rather than to this Board and Mr. Lewis indicated,that it may be necessary. After lengthy discussion regarding storage of automobiles and/or parking facilities on the premises it was agreed that the situation regarding delapidated and/or parked cars around the premises would be remedied if the use by exception was passed. Mr. Wolfson questioned the type of use by exception being requested and if same were for a paint shop. Mr. Lewis responded that he was applying for any use by exception that would be permitted for the buiding so he could proceed to get the building ready for occupancy. General discussion followed regarding the rezoning and why such zoning was not grandfathered in at that time. It was noted by Mr. MacDonell that the property was rezoned in 1982 and they replaced CI and CG with CL and if anyone wants to do anything with the property they would have to come be-fore the board with specific plans. Mr. Bass asked of Mr. Lewis had not lost his previous tenants whether he would be present now to which Mr. Lewis said he would not. He also stated that the building was a warehouse and every time a tenant moves out and someone else comes along to rent the building and they could not get a license for automotive repair because of the zoning. Mr. MacDonell asked Mr. Lewis if he had asked for a use by exception at the time he was intending to put a Goodyear Store on the property and Mr. Lewis stated that particular deal fell through and the buil,ding was not built, but also that the property that was intended to'be 'used was in the center of the subject property and not on the corner in which a use by exception is being applied for at this time. Mr. Wolfson again brought up the subject of the cars parked outside the warehouse and who they belonged to and it was stated that two of the cars belonged to tenants upstairs. Mr. Wolfson inquired into the other five cars that were parked there especially one with a mattress on the top and flat tires but these cars had not been noticed by the new manager of the property. Mr. Wolfson stated that in essence are we zoning from CL to CO or all uses permitted in CG. Mr. Eakin pointed out that as he stated at the outset that it is his understanding that they would be asking the CL uses by exceptions number 8 and 9 and CG permitted use number 7 and Mr. Eakin agreed to rewrite the application and be more specific regarding proposed uses. After further general discussion the Chairman asked for further comments and there being none the Chair entertained a motion. Mr. Howie made the motion for approval subject to the classifications that were just discussed and also with the stipulation that they immediately take action to remove the derelect cars that are in the area, and that there be no outside storage of cars awaiting service other than �the three parking spaces that are alloted to the tenant or customers awaiting service the same being possible being overnight and not long term storage. The motion was seconded by Mr. Bass and there being no objections was unanimously approved and for clarification J;�r Mr. Wolfson asked that this was for only for CL 8 and 9 and CG 7. III. AN APPLICATION FOR "USE BY EXCEPTION" FOR THE SALE OF ALCOHOLIC BEVERAGES AT 1211 MAYPORT ROAD FILED BY ACA MANAGEMENT SERVICES, INC. Charles Mann represented AMOCO who owns the property located at the northeast corner of Mayport Road and Plaza. He stated that the property was previously zoned so that his client could sell beer and wine for off-premise consumption and with was subsequently downgrading to CL they found that they now needed an exception. He stated that AMOCO had greatly improved this location. He presented a letter from Atlantic Beach Beautification Committee for consideration and also pointed out that there are numerou's establishments up and down Mayport Road who have the exception they are seeking to have the right to sell beer and wine. He also pointed that AMOCO is a responsible citizen in the community. As you know, this "exception" was barely passed - only Py a 3/2 Vote - over the strong objections of several citizens. One of these citizen-objectors, Mrs. Ruth Gregg, has a personal concern because of the proximity of her own home to the proposed activity. I share her concern and am sympathetic to her feelings. However, as in the case of the Deweese Street beach access, I think the needs of the many outweigh the needs of the few. .. but with a decent respect for the feeling of the few taken into consideration. As I told you on the telephone Tuesday, I have some doubts about how this whole scenario will play - that's why I specifically asked City Attorney Alan Jensen about our future control - but I hope it will be a positive happening for the ghildren, the neighborhood, the city, and for you. How- ever, as I also told you Tuesday; if it becomes a public nuisance, if the police have an unusual amount of calls to the area, and if intolerable actions occur to disturb the peace of the residents of the area; even though I voted to allow the "exception," I will be the first to set in motion the necessary actions to revoke the "exception." The request for a "Use by Exception" for the operation of a "Teen Club" at was considered by the Board and recommendedfor denial by a vote of 5 to 1. The Board's consensus of opinion was that the location was inappropriate for the proposed use. Some of -the factors included: the locations close proximity to a bar, the higher drug-rilated crime rate in the vicinity, the shared parking lot with the bar, and the layout of the site which will re- quire patrons to move between the parking area and the club entrance via an alley at the rear -of the building.
