Thompson,, City Manager BACKGROUND: At the June 14, 1999 City Commission Meeting, the City Commission approved forgiving the late fees and penalties on the property recently deeded to the church. The intent of the City Manager was to only recover the actual out-of-pocket expenses that the City incurred. After further review, it was determined that the actual City costs were only$1,545. The amount was doubled, as provided in the City Code,to cover city administrative expenses. The actual out-of-pocket expense to the City was $1,545, not $3,090. For this reason, we recommend reducing the lien to $1,545. RECOMMENDATION: We recommend further reducing the lien on the property discussed above and in the attachments,to $1,545. The church was deeded a piece of property at Mayport Road between Dudley Street and Church Road. This property had a lien on it that was the result of the City condemning a house and demolishing it. The original demolition cost the City$3,090. Late charges have now accumulated in the amount of an additional $1,596.50, for a total lien of$4,686.50. The New Friendship Missionary Baptist Church is involved in a number of community service projects serving citizens throughout the neighborhood. They run clothing and food ministries, and they are involved in other projects to improve the neighborhood and serve people who are in need. The City's actual expense for the demolition of the house was $3,090. This is different from the previous request from Habitat in that the Habitat bill was for services that were not actually utilized. The Habitat lien was based on minimum water rates, sewer rates,and late charges, even though no one was actually living on the property. In this matter,the City actually incurred the cost of the demolition. RECOMMENDATION: It is the staff recommendation that the late charges of$1,586.50 be forgiven by the City, and the remaining$3,090 will be worked into a payment plan for the New Friendship Baptist Church. This is different from the previous request from Habitat in that the Habitat bill was for services that were not actually utilized. The New Friendship Baptist Church's 44-foot-tall building at 28 Dudley St. off Mayport Road is just about complete. The building could have been higher. The church had received a permit to build a steeple that would have added another 30 feet. But church officials nixed that plan. City Community Development Director Sonya Doerr said she noticed the building's height about a month ago while reviewing the plans. She notified other city officials. "We were sending commercial [building] reviews to Orlando," where the consulting firm BEA International was handling overseeing permit requests for the city,Doerr said. The firm was hired when former city Building Official Don Ford resigned in February 2006 to take a job in Neptune Beach. A Shorelines telephone message left at BF Ns offices in Orlando was not returned. In Ford's absence until November,when Dave Hufstetler was hired as Atlantic Beach building official,the contracting firm was hired to oversee building permits. Doerr said the church applied for the building permit under a non- residential classification in September,which does not require City Commission review. "In the case,they only sent the civil engineering [plans]to the city.They sent the building plans to Orlando [with BFA]. I never got to see the building plans," Doerr said. "They [BFA]were well aware of our height limit." The building height limit at the time was part of the city's comprehensive land use plan. But in November,voters overwhelmingly approved a referendum making the building height limit part of the city charter,requiring any exceptions to the height limit to be approved by the voters.Neptune Beach and Jacksonville Beach voters approved similar referendums in 2004. Regardless, said Mayor Don Wolfson,the building height limit was in effect when the church was permitted to go ahead with the building reconstruction. He's not upset with the church. Wolfson acknowledged the city was in transition when the church was permitted to exceed the height limit. But the consulting firm was supposed to catch violations like that. "It's very clear in their contract that they're supposed to comply with state, county and municipal ordinances," Wolfson said. "In this case,they clearly did not. ... I would have preferred holding the church to the standards that everyone else is being held to,which is 35 feet." Wolfson credited Doerr for finding out the height limit was exceeded,but the reconstruction of the church was nearly finished and the city can't make church officials remove the top of the building. Wolfson said city officials met with church leaders and that they agreed,out of respect for the height limit,to nix plans for a steeple that would have added another 30 feet on top of the building.But Wolfson also wondered if the city could take action against BFA. "it seems to me the responsibility clearly falls on the firm that was representing the city," Wolfson said. "The recourse that we would have would be to take the firm to court. But the city attorney [Alan Jensen] really felt that could be long, drawn out and expensive for the city." That's when the city decided to enter direct negotiations with the church leaders,who agreed to withdraw the steeple plans,Wolfson said. The church building is 9 feet over the building height limit and it was permitted because of a technical snafu. But given the public outcry for controlling building heights at the Beaches, Wolfson said this case is a big deal. "The big deal is that we have an ordinance on the books that's clearly been breached," Wolfson said. "Since that has happened,obviously the citizens of the community have strengthened that position. "It's very unfortunate," Wolfson said, adding the city will have to move on. As confirmed in the attached, New Friendship Missionary Baptist Church of Atlantic Beach, Inc. has offered a parcel it owns to be the permanent home for the building. The site is located in Atlantic Beach, just off Mayport Road on Lewis Street. I have also attached a printout showing the site location. In addition please find enclosed a letter- from Mayor Meserve of Atlantic Beach, noting that the site is properly zoned for the building. Due to the width of the building, a variance to reduce the sideyard setback fi-om ten feet to five feet must be approved by the City's Community .Development Board. A meeting is scheduled on the request for Monday, January 29, 2001 at 6 p.m. As noted in Mayor.Meserve's letter, the City Planner as well as the Mayor, will recommend approval of the request. As you know, this past Tuesday evening, the School Board announced that the Preservation Organi2ation had to find a site by Rinuary 291h or else risk the demolition and loss of the building. In just three days, we have found a permanent site. Both the Church and the City have expressed their strong desire to have the building relocated to the site in Atlantic Beach.
