E. Your Mitigation on December 10, 2003 resulted in an agreed addendum to your previous Tree Removal Permit. The addendum allowed for the removal of 4 trees, 24 inches of oak and 38 inches of pine,to be mitigated at 100%on site. What ever could not be planted on site was to be paid into the tree fund at$117.00 per inch. The 8-inch camphor was not mitigated. To date,this mitigation has not been satisfied, and as you did not appeal the Tree Boards Decision to The City Commission within 7 days of their decision, this case has been forwarded to the Code Enforcement Office for enforcement. In an effort to eliminate undo hardship, I am granting you 14 days from your receipt of this notification to comply with the Tree Board's mitigation requirements. Failure to do so will result in Code Enforcement action, which can result in fines of up to $5,000 per tree and or$500 per day for failure to comply with the Tree Board's findings. Furthermore, you are reminded that any fines imposed would be in addition to the Tree Board's assessed mitigation, and that any unpaid fines can result in action against your business license and or liens against your property. Tree Removal Applications 1. 320 5a' Street: Building Official Ford advised that the 12" palm tree was marginal because it was too close to the foundation, no mitigation would be required The 8 '/z"palm tree required no mitigation. A motion was made by Board Member Permenter, seconded by Board Member Carroll, and unanimously carried to direct the Building Official to issue a permit for the removal of a 12"palm and and 8%" palm with no mitigation required. 2. 14 E. Dutton Island Dr.: In response to questions from Board Members, Building Offical Ford advised that there are similarities with Mc Donald's tree removals and that the Board could forward a complaint to the Code Enforcement Board to fine the contractor. A motion was made by Board Member Permenter, seconded by Board Member Carroll, and unanimously carried to direct the Building Official to issue an addendum to the existing Tree Removal Permit,for the removal of 4 trees,24"of oak and 38"of pine, to be mitigated at 100% on site and whatever cannot be planted on site will be paid into the tree fund at$117.00 per inch. The 8"camphor will not require mitigation. A motion was made by Board Member McCue, seconded by Board Member Carroll and unanimously carried to direct the Building Official to forward a complaint to the Code Enforcement Board to levy fines at the maximum penalty and recommend that each of the (5) five trees be considered a separate violation, (Le. S250Jea.) for the contractors lack of due diligence. He stated that they were required to plant 40 inches of trees. Building Official Ford will research the file to determine if there was a fine and/or a dollar value of landscaping required and bring the results of his research to the next meeting. i 'faifd Road: '£wilding Official Ford advised that Mr. Vaughn Rivers met with him on Monday to discuss his concern with the mitigation plan approved by the Tree Conservation Board on December 10. He stated that Mr.Rivers advised him that they removed five trees, a 7"oak, a 5"oak,a 8" camphor, 4"myrtle and a 10" wild cherry. Building Official Ford stated that the Board used the numbers provided by Mr. Rivers on their memo and site plan, which were incorrect. He further advised that after examination of the site, he determined that the actual trees removed were 12" of oak and 14"of other tree. He further advised that he did not count the camphor tree because it was considered undesirable. A motion was made by Board Member Permenter, seconded by Board Member Carroll, and unanimously carried that the Building Official issue a corrected permit for the removal of 12" of oak in lieu of 24 of oak, and 14" of other hardwood in lieu of 38" of pine to be mitigated at 100 percent at$t17 per inch,and that the Tree Conservation Board approve the final landscaping plan. Annual Calendar: The annual calendar was distributed. Discussion was held and it was determined that the November 24 meeting would be canceled and the December meetings would be moved to December 1 and December 15. 7. It is Staff's opinion that the proposed use is consistent and compatible with surrounding uses, and that this use is of a less intense character than other by-right Permitted Uses in the CG Zoning District. Staff finds that the request complies with Section 24-63 and recommends approval of the requested Use-by-Exception, subject to the following conditions: no chain link, or similar type of fence will be installed on the westernmost side of the property which adjoins Mayport Road; any such fencing will be limited to that as shown on the site plan submitted with this application, all exterior lighting shall be directed towards the site and shall not illuminate adjacent residential parcels, and all business activities shall be maintained within the enclosed building, and there shall be no outside storage of any goods or materials. In response to a question from Mr. Frohwein, Ms. Doerr advised that even though a portion of the land was zoned RG-2, the zoning of the larger portion was zoned Commercial General and, therefore, the zoning of the larger portion of the lot conveys to the smaller portion of the lot. Discussion was held with regard to the address of the property. Mr. Jason Henson, who represents the seller of the property, explained that the address of 15 Simmons Road was the address of the current owner of the building and the land located behind the building. Mr. Wolfson expressed concern with regard to the close proximity of the retention pond to residential property. Ms. Doerr stated that the retention pond was required to meet drainage requirements. Mrs. Walker requested that Ms. Doerr ensure that the landscape ordinance be applied to this property. Mr. Wolfson requested that the applicant install a fence to deter children from entering the retention pond. He further requested that the applicant install a vinyl-coated fencing that would blend into the shrubbery. Ms. Doerr advised the Board that the applicant was required to comply with landscaping requirements and buffering and would recommend that the fencing be located on the inside of the buffer.
