Item 8C AGENDA ITEM # 8C OCTOBER 25, 2010 STAFF REPORT City of Atlantic Beach Commission Meeting AGENDA ITEM: Updates /Amendments to Code Enforcement Board Ordinance DATE: October 18, 2010 SUBMITTED BY: Donna L. City Manager BACKGROUND: The purpose of the proposed amendment is to update the City Code to make it consistent with the state laws regulating Code Enforcement. Over time, the existing language in the Atlantic Beach Code has become obsolete and inconsistent with the state laws. The recommended changes will resolve any conflicts with the state laws, while providing an appropriate mechanism to remove members of the Code Enforcement Board who repeatedly fail to attend meetings without prior approval of the chair. BUDGET: No impact on the budget RECOMMENDATIONS: To review the attached proposal and to authorize staff to proceed to amend the City Code as recommended. ATTACHMENTS: Draft Ordinance with Proposed Amendments REVIEWED BY CITY MANAGER: AGE A ITEM NUMBER: AGENDA ITEM # 8C OCTOBER 25, 2010 ORDINANCE NO. -10- AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, FLORIDA, AMENDING CHAPTER 2 OF THE CODE OF ORDINANCES, ARTICLE V, BOARDS AND COMMISSIONS, DIVISION 2, CODE ENFORCEMENT BOARD, SEC. 2 -142, REMOVAL; FILLING VACANCIES, TO PROVIDE FOR REMOVAL OF A MEMBER OF THE CODE ENFORCEMENT BOARD FOR FAILURE TO ATTEND MEETINGS AND THE FILLING OF A VACANCY ON THE BOARD RESULTING THEREFROM, AND PROVIDING AN EFFECTIVE DATE. BE IT ENACTED BY THE CITY COMMISSION ON BEHALF OF THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA: SECTION 1. Sec. 2 -142 of the Code of Ordinances of the City of Atlantic Beach, Florida, is hereby amended to read as follows: "Sec. 2 -142. Removal; filling vacancies. Members of the code enforcement board may be removed from office by the city commission for cause upon written charges and after public hearing. Any member who fails to attend two (2) of three (3) consecutive successive meetings without cause and without prior approval of the chair shall have his office declared vacant by the code enforcement board , ... • , _ _ ' _ • _ _ and the city commission shall promptly fill such vacancy. Vacancies shall be filled by appointment by the mayor and approval of the city commission for the unexpired terms affected." SECTION 2.
