Mr. Worley introduced City Manager Jim Hanson to the board. OLD BUSINESS: 1. Application for Use -by- Exception filed by Kelley Properties, Inc. to conduct religious services at property located at 100 Royal Palm Drive. Mr. Worley reported to the board that staff has been unable to contact the applicant and requested that the item be withdrawn. The Chairman requested that staff write a letter requesting the applicant's intentions in the matter. NEW BUSINESS: 1. Application for Variance flied by Gus Alvarez to construct an addition that will encroach the rear yard setback at property located at 2173 Fairway Villas Lane South. Ian Warren of a Patterson Homes introduced himself to the board and explained n that Mr. Alvarez desires to construct a sunroom onto the rear of his residence that will 4/ encroach the required 15 foot setback. He stated the a hardship exists because of the size of the lot. Responding to questions from the board, Mr. Worley stated that most subdivisions enforce the covenants and restrictions locally and privately by the association and they are typically more restrictive than the City. After discussion, Mrs. Pillmore moved to deny the variance and Mr. Burkhart seconded the motion. Mrs. Walker stated that special circumstances may exist because of the location of a golf course to the rear of the property instead of homes. Mr. Jacobson stated that before making a decision he would like to hear from the homeowners association and that the applicant should deliver a more developed application. Mr. Worley stated that the board would still have to make a determination based on the zoning code as modified by the PUD document. Mr. Frohwein stated he did not see a hardship with the property. After discussion, the motion and second were withdrawn and Mrs. Pillmore moved to defer the application to the next meeting. Mr. Burkhart seconded the motion and it passed unanimously. 2. Application for Variance filed by Alex and Barbara Manolis to construct an addition to an existing nonconforming residence at property located at 578 Beach Avenue. Mr. Manolis introduced he and his wife to the board and stated their residence is located on a double frontage lot and they desire to construct a second story bedroom. He stated that the house was constructed in the 1930's. He stated that the proposed construction will meet all required setbacks. After discussion, Mr. Burkhart moved to grant the variance and Mrs. Pillmore seconded the motion. After further discussion, Mr. Burkhart amended his motion to include that the applicant obtain a building permit within a period of one year. Mrs. Pillmore seconded the amended motion and the variance was granted unanimously. DISCUSSION 1. Traffic issues created by the Mayport Flyover. Mr. Worley stated that a meeting was held a week ago with the City Manager and CITY OF ATLANTIC BEACH COMMUNITY DEVELOPMENT BOARD STAFF REPORT MEETING DATE: February 15, 2000 AGENDA ITEM: # 4. a. Application for Use -by- Exception to operate a church in an existing building at 100 Royal Palms Drive. * (Please be advised that Staff has been unable to contact this applicant to verify their intent to pursue this exception. If we are unable to contact them prior to the meeting Staff will administratively withdraw this application.) The applicant desires to operate a church in the existing building on this site. The interior will be modified to accommodate the use, but the exterior of the structure will remain intact. The parking lot will accommodate 13 cars which will allow seating for 52 persons. One exterior sign is proposed. Staff has reviewed the proposal and the site plan and would like to point out that the applicant has apparently used the existing site plan for his submittal. The site layout will accommodate the proposed 13 parking spaces as shown. Staff recommends approval of the requested Use -by- Exception subject to a maximum permitted occupancy of 52 persons, and that the exception be granted to this applicant only and for this location only. AGENDA ITEM: # 5. a. Application for Variance to construct an addition onto the rear of an existing residence at 2173 Fairway Villas South. The applicant desires to construct an addition onto the rear of his single- family residence in violation of the rear yard setback requirement. The Fairway Villas Subdivision was platted with the lots along the western side being only 81 feet in depth. The PUD was amended to allow front and rear yard setbacks of 15 feet in 1983 (See Attached). The existing residence currently has a rear yard setback of 16 feet. The reduced size of the platted lots limits property owners in constructing additions onto their residences. This was mitigated to some extent, apparently, by the relaxation of the rear setback requirement in 1983. Staff believes that any hardship caused by the smaller platted lots has been mitigated by the modification of the PUD which permitted development of homes closer to the rear line than is currently permitted by code. William Moss, City Manager SUBJECT: Proposed Amendment to the Planned Unit Development - Fairway Villas On February 14, 1983, the City Commission adopted Ordinance No. 90 -83 -77 which created a PUD zone for property owned by W. A. Bull. The real property zoned by the ordinance borders Mayport Road on the west and Selva Marina Golf Course on the east, and is just south of Atlantic Beach water plant. It contains 10.76 acres which will provide for 66 patio home units known as Fairway Villas. Ahern & Associates, representing the owner, W. A. Bull, advised the City Manager that the owner of the subject property desired to sell the pro- perty to Stokes & Company. Representatives from Stokes & Company have indicated a desire to deviate from the original PUD which would, in their opinion, upgrade the development. On March 22, 1983, the Advisory Planning Board reviewed a request to deviate from the Fairway Villas PUD (Ordinance No. 90- 83 -77). England & Thims, Inc., Consulting and Design Engineers, spoke on behalf of Stokes & Company. (See attached Exhibit A.) The Advisory Planning Board consi- dered the request and reviewed the plans presented by England & Thims, Inc. The Advisory Planning Board recommended approval of the modifications to the PUD ordinance as presented by Stokes & Company in the letter from England & Thims, Inc., dated March 16, 1983, subject to certain modifica- tions. The recommended approval provides that: 1) The front and rear setbacks be amended from 20 feet to 15 feet. 2) The "T" at the south end of the property line and secondary access at the north end be eliminated and replaced with cul -de -sacs as indicated on the plans dated March 16, 1983. 3) That Stokes & Company, the proposed developers, provide for an additional lot at their discretion to be combined with existing green area for a playground. The additional lot for a green area confers approval to increase the adjacent residential lot(s) Page 2 MEMORANDUM March 28, 1983 to the playground by up to 10 feet to provide an additional buffer zone. This will decrease the number of patio home units from 66 to 65. ,4) That the minimum building size be increased from 900 square feet to 1,000 square feet. Attached for review by the City Commission are the revised plans for the Planned Unit Development as recommended by the Advisory Planning Board. Should the City Commission concur with the recommendation or otherwise modify the PUD requirements, a motion would be appropriate.
