Selby 3 Forrestal Circle,North Atlantic Beach, Florida 32233 DATE OF HEARING: May 26, 2009 SUBJECT PROPERTY: 3 Forrestal Circle,North Lot 22, Block 1, Atlantic Beach Villa,Unit 1 Atlantic Beach, Florida ORDER GRANTING WAIVER FROM THE LAND DEVELOPMENT REGULATIONS On May 26, 2009, the above referenced property was granted a waiver from the Land Development Regulations at a public hearing by the City Commission of the City of Atlantic Beach. • Specifically waived are the provisions of Section 24-171 (f), the Commercial Corridor Standards, prohibiting the use of chain-link fences within the Commercial Corridor, upon finding by the City Commission that it is not the intent of the Commercial Corridor Development Standards to apply to properties in residential use, and the subject property is within a residential subdivision and has been in residential use since development; and subject to the following condition: • This waiver shall not exempt the property owner from any other provision of the Land Development Regulations, as may be amended, regulating the condition of fences which are in a state of disrepair, dilapidated, in poor condition, or a safety hazard to clear vehicular sight distance. The undersigned certifies that the above stated action of the City Commission is a true and correct rendition of the action by said Board as the same appears in the record of the City Commission minutes. Q.�ifh Sonya Doerr,AICP Community Development Director A couple of residents on Forrestal Circle were given notice to remove their chain link fences in 90 days or face a$500/day fine. In my opinion,this request is not only unreasonable,but is being handled in an unfortunate manner that is nothing short of discriminatory towards these middle class families. Most average people cannot afford to pay to unnecessarily replace a perfectly functioning fence on short notice or to pay an astronomical fine for not doing so. It is our understanding that area businesses on Mayport Rd. have had more advance notice to comply with this... So if you combine the fact that the city's poor foresight has left the homeowner's short changed along with the fact that not sufficient information is being provided to homeowners....it seems like the city isn't giving this much thought. Honestly, homeowners don't know what the city is thinking regarding this request. Contact with homeowners has been on a restrictive timeline and communication has been minimal at best, only general letters and no point of contact for concerns/issues. Although some may feel differently,the fences that are already in place have their obvious advantages. Living in Florida,with in climate weather prompting rotting and the ever problem of termites...metal fences are durable. More importantly, the residents feel like the fences in place are safer. In residential areas,you have people who are there 24 hours/day...there are children, grandchildren, pedestrians and pets close to these fences in yards or even on the sidewalks. With the city widening roads, sidewalks, and concrete polls being put in, it is getting more and more difficult to look for pedestrains before pulling out of our roads. With a wooden fence a couple of feet away from where the road and sidewalk meet at the stop signs to enter Mayport Road, it will be impossible to avoid oncoming pedestrian. Also, homeowners have had wreckless drivers jump the curb and come crashing through the fence. Living that close to a busy street,the homeowners have been lucky so far, but what if children were playing in the yard and had no warning of an impending accident... In this situation with the fences...one man's eyesore is another man's safety issue. Homeowners can be sued if an accident happens and the fence was part of the problem,then the city can be sued for making the homeowners put up that type fence. As far as eyesores... residents have been looking at "The Palms" as it deteriorated into a troLgic area. Residents have been forced to deal with construction and"pre-construction" fences. It is hard to swallow the seemingly arbitrary creation of new'rules', when it doesn't seem like the current codes are being followed. I'm not sure why fences that have been there for 30+years cannot be grandfathered in, or a better solution be found. The fence has been there for 37 years. It's never been a problem until recently. You want to beautify Mayport Road, so the businesses were told to remove there fences,we were not notified then,but when it was realized 4 HOMES had chain link fences we were notified to comply then. I have NEVER asked nor WAFTED to be zoned commercial property. This property will always be residential as long as I'm alive... It's my home,I have never run a business out of my home,had cars coming and going, had a dumpster for my trash or signs in my yard or windows, and never made income off the property. So I feel it's wrong to put me in with businesses along Mayport Road. I would like the fence to be grandfather in, I heard the assistant city manager say if you did that there can be no change, maybe if you put a stipulation that as long as we own the homes, or a better solution found. A lot of us feel disenfranchised along Mayport Road and the Westside . We have no one to stand up for us to hear our voices. All the decisions are being made for us, from people who live on the east side. In the Mayors recent letter he said"Public safety is a top priority"I believe my fence provides that for me. In residential areas you have people there 24 hours a day. There are children, grandchildren,pets, and pedestrians close to these fences and yards. With the city widening the roads,sidewalks and concrete poles being put up, it is getting more difficult to look for pedestrians before pulling out on the roads. With a wooden fence a couple of feet from where the road and sidewalk meet at the stop sign to enter Mayport road,it will be impossible to avoid an oncoming pedestrian, and make it hard to see the traffic coming. I have had reckless drivers jump the curblal`'&come crashing through the fence. Living that close to a busy street, the homeowners have been lucky so far, but what if children were playing in the yard and no warning of an impending accident. In this situation with fences,one man's eyesore is another man's safety issue. Homeowners can be sued if an accident happens and the fence was part of the problem, then the city can be sued for making the home owner put up that type of fence. In this economy,the average person doesn't make$500.00 a day. I am an unemployed middle class person, who finds it offensive that the city wants me to take down a perfectly functioning fence or pay an astronomical fine for not doing so. Although some may feel differently the fences that are already in place have their obvious advantages. Living in Florida,with inclimate weather promoting roving and the ever problem with termites...metal fences are durable. More importantly I feel the fence in place safer. On Forrestal Cir So. There is a brown wooded fence on the corner house. To me this is an eyesore. It's warping and just doesn't look like something you would want to project an image of. Maybe the main concern should be beautifying what is already there, instead of implementing new rales that may not even improve aesthetics an may cause more accidents.
