You indicated that you felt landscaping should be provided to this property. I think it is important to understand that the DCDC is not a City agency. Pat Williams, who you mentioned in your letter, serves as the Office Manager for the DCDC. This organization is set up as a private Florida corporation, as well as an IRS5013C, which makes it a separate charitable organization. The City of Atlantic Beach does not have any authority to direct or compel the DCDC to perform in any certain way its business operations. The only formal connection that the DCDC has with the City is that the City Commission has allowed the DCDC to coordinate the Community Development Block Grant Program for the City. The concerns over the landscaping related to your recent purchase from the DCDC should be appropriately addressed to that organization's Board of Directors, and I am sending a copy of your letter to Sharette Simpkins, President, DCDC, the DCDC Board of Directors, and Pat Williams, DCDC's Office Manager. I am also forwarding your letter to Alan Jensen, City Attorney for the City, to double-check to see if the City has any responsibility for landscaping of private property. As soon as Mr. Jensen reviews this issue I will forward his opinion to you. Page 2 Sam Gotay August 6, 1998 If I can be of further assistance please let me know. Sincerely, fames R. It sounds as though you are experiencing some problems with regard to sod and landscaping for your property at the above address. As you may know, we have a Commission/City Manager form of government here in Atlantic Beach, which means that elected officials may not solve problems directly, but may certainly refer them to the City Manager for his review and/or corrective action. This I have done on your behalf as of today. You mentioned in your letter that you know me to be a"person of action and not words". I can assure you that City Manager(Mr. James)Jarboe is that same kind of person. He often solves a problem even before a complaint letter arrives here from city hall, and I have had a chance to read it. Please allow him time to make contact with you at 270-1259, and to take what action he deems appropriate. I feel sure he will contact you soon. If, after your discussions with Mr. Jarboe, you feel your problem has not been fairly and equitably resolved, please call me at my home at 249-3044. I have confidence, however, that this matter can be resolved at the city hall level. Thank you for taking the time to write to me about this matter, and for the faith you have expressed in me. It is my sincere belief that government should be about helping people. Withkindest regards, ducat. Suzanne Shaughnessy Mayor Enc: memo to Mr. Jarboe Printed on Recycled Paper qct g' SAMUEL GOTAY 1520 FRANCIS AVE ATLANTIC BEACH FL. 32233 270-1259 DEAR MAYOR SHAUGHNESSY RECENTLY I PURCHASED THE PROPERTY ON 1520 FRANCIS AVE. IN DOING THIS I WAS ASKED BY THE CITY AND THE DONNER COMi1;- ITY,TO HELP WITH THE BEAUTIFICATION OF THE COMMUNITY. AS TO PRIOR AGREEMENT THROUGH MEDIATOR PAT WILLIAMS, THE CITY OF ATLANTIC BEACH AND ' THE DONNER COMMUNITY WE WERE PROMISED THAT THEY WOULD FURNISH THE GRASS AND SHRUBS(LANDSCAPING) FOR OUR HOME. THIS PROMISE AND VERBAL AGREEMENT WAS WITNESSED NOT ONLY BY MYSELF BUT BY PHYLLIS TO, ON NUMEROUS OCCASIONS. AS THE CLOSING GREW NEAR- THE PROMISES AND VERBAL AGREEMENT CHANGED. WHEN I INSISTED TO PAT WILLIAMS TO PUT THE GRASS DOWN IMMEDIATLY SO MY THREE SONS WOULD NOT HAVE TO PLAY ON THE DIRT I WAS TOLD BY PAT WILLIAMS THAT THEY DID NOT WANT TO PUT IT DOWN IN FEAR OF IT BEING STOLEN. TIME PROGRESSED AND I STILL INSISTED ON PUTTING THE GRASS DOWN, AT THAT TIME PAT WILLIAMS TOLD ME TO CO AND GET SOME ESTIMATES ON THE SOD, AFTER RECEIVING SEVERAL ESTIMATES AND FURNISHING THEM TO PAT WILLIAMS I WAS TOLD BY HER THAT THE PRICE WAS TO HIGH. FEARING THE WORST I TOLD PAT WILLIAMS I WANTED THE AGREEMENT ABOUT THE LANDSCAPING IN WRITING ON THE CONTRACT. I DID NOT UNDERSTAND AND DID' NOT THINK AT THE TIME WHY PAT WILLIAMS DID NOT WANT THE AGREEMENT IN WRITING. PAT WILLIAMS EXPLAINED THAT ALL MATTERS CONCERNING THE LANDSCAPING WENT THROUGH HER THEREFORE THERE WAS NO NEED FOR IT TO DE IN WRITING. REALIZING HONESTY WAS HERE TO QUESTION AND NOT UNDERSTANDING WHY THEY WOULD TREAT ONE OF THEIR OWN THIS WAY (A CITY EMPLOYEE) . I VIENT AS FAR AS OFFERING TO LAY THE SOD BY MYSELF, WHICH LEFT THEM TO PURCHASE $500 . WORTH OF LANDSCAPII7G. PAlt WlILLIAMS AGREED. AT THE CLOSING PAT WILLIAMS INFORMED US THAT THERE WOULD BE NO SOD PROVIDED. IT HAS NOW BEEN TWO MONTHS SINCE WE SIGNED THE CONTRACT, AND ONE MONTH SINCE THE CLOSINGrWE HAVE NOT SEEN ONE SHRUB NOR BLADE OF GRASS. MY SONS DARIUS,CAMERON AND KENDALL, HAVE NOT BEEN ABLE TO PLAY IN THEIR OWN YARD YET. ON JULY111TH MR GEORGE WORLLY CAME TO SURVEY LAND FOR-A FENCE PERMIT. WE INFORMED HIM OF THE SITUATION TO WHICH HE REPLY THAT HE REMEMBER SOMETHING IN WRITING ABOUT THE LANDSCAPING BEING PROVIDED BY THE CITY AND DONNER COMMUNITY, WE HAVN'T HEARD A WORD FROM HIM SINCE MAYOR SHAUGHNESSY, I KNOW YOU ARE A PERSON OF ACTION AND NOT WORDS. I HOPE I WILL HERE FROM YOU SOON. 'HANK/Y40AY4 ` SAMUEL ------------------------------------------------------------------------------------------------------- MAYOR SHAUGHNESSY SINCE I 'VE MOVED IN I HAVE ALREADY STARTED TO BEAUTIFY, I TOOK THREE HUD MAIL BOXES THAT WERE FALLING APART DOWN PAINTED AND SEALED THEM AND BOUGHT SOME LANDSCAPING FOR THEN] , EVERY NIGHT. You have refused our request to relocate the fence onto your lot and have directed the conversation to other matters such as what you don't like about the home we have under construction on our lot. As one last try, I am hereby requesting said fence be relocated immediately within the confines of your lot. Sincerely, Dave Clarke Construction Manager Beaches Habitat
