MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, FEBRUARY 22, 1960 AT 8 P.M.

The meeting was called to order by the Mayor-Commissioner,
Mr. Howell.
Minutes of the meeting of February 8th, 1960 were approved as
written upon motion of Mr. Moore, Seconded by Dr. Whitehurst and
carried.
Mayor Howell recognized visitors present and called for any business
from the floor. Mr. Frank Keith requested the Commission to consider
his request and make an exception to the Zoning Ordinance require-
ment and permit him to put his carport closer to the sideline than
the 72 feet. Mr. Moore advised that he does not believe Mr; Keith ' s
carport hurts anyone due to other non-conformities in t11140$ neighbor-
hood, and he feels he should be allowed to go ahead with it. Dr.
Whitehurst feels he would like to see the situation before making a
decision, and Mr. Johansen thinks we have turned others down and
should be careful in making a decision as others will want the same
exception. Mr. Waggoner advised that the Zoning Ordinance needs
clarification as to certain procedures and he would like to see
the Committee study and make recommendations on it. There was
further discussion and it was decided to see the location, etc. and
take action on the matter at the next meeting. **
Another request was received to re-zone Tract 3, Gov' t. Lot #3 lying
west and adjoining the other tract being considered for re-zoning,
from Residence "D" to Business "B". It was noted that Levy Rd.
seems to be going business and believe should study the Zoning
Ordinance on this also. Dr. Whitehurst moved that the Mayport Rd
and Levy Rd. zoning be referred to the Zoning Committee for study
and report back at next meeting, seconded by Mr. Moore and carried.
Mayor Howell presented in writing an Ordinance amending the Zoning
Ordinance by changing the zoning of a parcel of land lying at the
northwest corner of Mayport Rd. and Levy Rd. from Business "B" and

Residence "D to Business UB for the entire tract. Mr. John
Amos, who was present, advised that it was mutually agreed that
they will not get a license to operate a trailer court on this
tract until there is a high fence or necessary planting to sepa-
rate from the residential area lying just north of the tract, for
the benefit of the residential area. Dr. Whitehurst moved the
adoption of the Ordinance on first reading, seconded by Mr.Moore
and having been duly considered the Mayor put the question thereon
and the vote was
Aye: Claiborne, Johansen, Moore, Whitehurst, Howell
Nay: None
Whereupon the Mayor declared the motion carried and said Ordinance
adopted on first reading. March 14th, 1960 was set as date for
Public Hearing on this Ordinance.
The City Clerk presented Federal Reserve Bank operating circular
#20 setting forth the terms under which they will hold securities
pledged by Banks as security for the deposits for our accounts
in such Banks. Mr. Moore moved that we acknowledge receipt of
the circular and proceed in line with the terms and conditions
as set forth in same, seconded by Mr. Claiborne and carried.
Mr. Wsggoner asked approval of his going to the City Manager 's
Meeting at Tallahassee on 1'pril 24th to 27th, 1960. It was the
consensus of opinion that he should go to the meeting.
Mr. Waggoner presented the report of the Water Department for the
y2ar 1959. It was received and filed.
The Commission next went into session for Public Hearing on two
Ordinances in line with Notices as posted.
Commissioner Whitehurst ir '.roduced and caused to be read in full
Ordinance #95-60-3 entitled
"An Ordinance Changing the Name of Saltair Boulevard,
Part of Sherry Drive and Part of Sixteenth Street in
the Corporate Limits of the City of Atlantic Beach,
Duval County, Florida"
and moved its adoption on second and final reading, seconded by
Mr. Moore. No one appeared either for or against said Ordinance
and having been duly considered the Mayor put the question thereon
and the vote was

Nay: None

Whereupon the Mayor declared said motion carried and said Ordinance
#95-60-3 adopted on second and final reading.
Next Commissioner Moore introduced and caused to be read in full
Ordinance #80-60-4 entitled
"An Ordinance Amending Ordinance #80-59-2 Entitled 1An
Ordinance Providing for the Imposition and Collection
of Sewer Service Charges, etc
and moved its adoption on second and final reading, seconded by
Mr. Johansen. Mr. Matt Finn appeared and objected to the part of
the Ordinance which provides for the disconnecting of water service
for failure to connect in required time. He, himself is going to
have his property connected, but he objects to the principle in-
volved. No one else appeared either for or against and the matter
having been duly considered the Mayor put the question thereon and
the vote was
Aye: Moore, Whitehurst, Claiborne, Johansen: Howell
Nay: None
Whereupon the Mayor declared the motion carried and said Ordinance
#80-60-4 duly adopted on second and final reading.
The Commission recessed and convened into regular session.
Mayor Howell presented in writing an Ordinance rsggiring that on the
issuance of any permit for construction or improvement of property
in the City there shall be deposited with the City the sum of $10Q.00
to secure and indemnify the City against damage to public property,
etc. Mr. Moore moved its adoption on first reading, seconded by
Mr. Johansen and having been duly considered the Mayor put the
question thereon and the vote was
Aye: Whitehurst, Claiborne, Johansen, Moore, Howell
Nay: None
Whereupon the Z yor declared said motion carried and said Ordinance
duly adopted on first reading. March 14th, 1960 was set as date for
Public Hearing.
Mr. Claiborne presented Resolution IMMO expressing the support of
the Commission to the off-shore fishing area to be built up with
the help of the Navy which has been requested, and moved its adop-
tion . The motion was seconded by Mr. Moore and having been duly
considered was adopted by unanimous votes Copy of said Resolution
AIM is attached to these minutes and made a part thereof.

Mr. Moore advised that h4 felt that something should be done
about the parking and traffic condition at the corner of Ocean
Boulevard and Atlantic Boulevard. The City Manager is to put
up parallel parking signs just as soon as they are received.
** Relative to Mr. Keith 's set-back request the Atlantic Beach
Zoning Board of Adjustment has recommended after study that
Mr. Keith conform to the Zoning Regulations.
There being no further business the meeting was declared ad-
journed by the Mayor.
