MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD AT THE CITY HALL ON MONDAY, JUNE 27TH, 1960

The meeting was called to order by the Mayor-Commissioner,
Mr. Howell.
Minutes of the meeting of June 13th, 1960 were approved as written
upon motion of Mr. Johansen, seconded by Dr. Whitehurst,
A letter was read from the Beautification and Cleanup Committee
of the Garden Circles of Atlantic Beach calling attention to
conditions which exist contrary to garbage ordinance, to blind
corners, lot clearing, etc. There was a great deal of discussion
and suggestions, and Mr. Waggoner advised thathhe would personal-
ly check on the garbage situation and make every attempt to carry
out the ordinance.
The Commission next considered the request of Mr. Townsend Hawkes
to make a garage apartment out of the garage located on Lot 1,
Block 30. The commissioners advised that they had looked at the
situation and if made into a garage apartment it would in no way
meet the zoning set-back requirements. The question of prefer-
ring a garage apartment to a duplex which could be built on this
lot was discussed, and opinions varied. After further discussion
Dr. Whitehurst moved that the request in the present form be
denied as it conflicts in too many ways with the Zoning Ordinance
as it now stands, seconded by Mr. Claiborne and carried.
Mr. Waggoner advised that in regards to the lots for the play-
ground at Seminole Road and Plaza, he was advised by the Dow Estate
that they will sell but there is some question as regards a minor,
which Mr. Thompson said he would handle with the Dow Estate execu-
tives. Mr. Waggoner has talked to the other two lot owners, but
has not received any word from them to date. Commission wants to
get all the minor items checked out before take any action as to
condemnation or otherwise.

Mr. Waggoner advised that he has received a request from Mr. C.L.
McDowell for the City to furnish him with water to his property
located on the east side of Mayport Road just north of the City.
It was discussed and suggested that he be supplied with water pro-
vided he pay for the extension from the present location of our
lines to his property, it being understood that the extension
would belong to the City. In the discussion it was brought out
that Mr. McDowell was among those who opposed annexation and did
not want anything the City had to offer. It was discussed further
and Mr. Moore moved that the City furnish him with water providing
he pay a tap charge equal to the cost of running a water line up
to his property from our present City line and to pay the present
outside city rate for the water, seconded by Mr. Johansen and the
vote was.
Aye: Claiborne, Johansen, Moore, Whitehurst
Nay: Howell
Whereupon the Mayor declared the motion carried.
Mr. Waggoner again requested that the Commission get to-gether for
a study of the Master Plan. They decided to meet after the adjourn-
ment of this meeting.
Mr. Waggoner reported that work has started on the Atlantic Garden
Apartments on Mayport Road, and since the Lift Station site has been
changed the cost to the developer of gravity lines will be greater.
There was a lengthy discussion of the matter in which it was brought
out that our former commitment might have been taken into consider-
ation by the present developers. Mr. Waggoner advised that he has
talked to the present developers and thinks they understand that they
will pay for the gravity line, and that he invited them to this
meeting but they did not feel they needed to come. The matter was
further discussed following which Dr. Whitehurst moved that the
Wt. S. Smith Co. be informed that there have been changes since last
commitment with them, and circumstances have necessitated re-locating
lift station and there may be additional expense for gravity lines and
the Commission would like to discuss with them on or before July 11,
1960, seconded by Mr. Claiborne and carried. It was suggested that
they be notified by letter.
Mr. Waggoner advised that the Tax Roll for 1960 connot be ready by
July 1st and requested an extension of time to August 1st, with the
books being open for inspection during the month of August. It was
discussed following which Mr. Johansen moved that the request be
granted and the extension of time be made to August 1st, 1960,
seconded by Dr. Whitehurst and carried.

Mr. Howell presented Ordinance #55-60-5 being an Ordinance entitled
"An Ordinance Regulating the Accumulation, Removal and Disposal
of Garbage and Garden Trash, etc; Providing for fees etc. "
which Ordinance was read in full following which he declared the
meeting in session for a Public Hearing on said Ordinance.
Mr. Johansen feels that the increase in rate to large restaurants
is too much, but he agrees that we should control the place where
dumped and have the proper approval. He, himself does not use the
City service , but feels that the charge is high for the other
large restaurants. The Ordinance was discussed at length, and
Mr. Claiborne requested information as to what is considered the
front yard on ocean front houses, and since it is the part of the
yard on the ocean, then that part of Section 2 (b) referring to
front yard does not apply to them. It was suggested that the Ordi-
nance be amended by adding the following sentence to this para-
graph In cases where lots run from street to street the provis-
ions applicable to front yard shall also apply to rear yard. "
After further discussion the Public Hearing was closed and Dr.
Whitehurst moved that the Ordinance with amendment as suggested
above be approved on second and final reading, seconded by Mr.
Johansen and carried. The rates as listed were not changed, but
the amount of license fee to be charged for engaging in business
of garbage disposal was set at $25.00 in Section 3 (a) .
Dr. Whitehurst brought up the matter of dogs with one "certain
dog" that comes into the City from north Atlantic Beach being
discussed. The co-operation of the Police Department in the
handling of this dog was requested.
There being no further business the Mayor declared the meeting
adjourned. /
