Subdivision Ordinance lst Reading. 9. Commissioners MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, OCTOBER 10TH, 1960 AT 8 P.M. Present: Wm. S. Howell Preben Johansen J.B. Claiborne Chas. R. Moore W. Laney Whitehurst, Commissitners and Frank Thompson, City Attorney J.F. Waggoner, Jr. City Manager Adele S . Grage, City Clerk The meeting was called to order by the Mayor-Commissioner, Mr. Howell. Minutes of the meeting of September 26th, 1960 were approved as written upon motion of Mr. Johansen, seconded by Mr. Claiborne and carried. Mr. Howell recognized visitors present and called for any busi- ness from the floor. Mr. Bob Lynch presented a request that a sidewalk be built on the east side of Sherry Drive for the bene- fit of the children going to Atlantic-Neptune School. He suggested that the Commission make a study of the cost and all factors in volved before making a decision. Members of the P.T.A. and others present spoke on the need for the sidewalk. There was a discus- sion of the feasibility of putting the sidewalk on the west side of Sherry Drive, but problem of drainage and cost to cover the ditch would make it unwise. The matter was discussed at length as to costs, who will pay, filling ditch in front of school, etc. The P.T.R. was asked to get a report from property owners as to their opinion of a sidewalk on the East side of Sherry Drive and report back to the Commission. Mr.A.. Glenn who owns property located Lots 5 & 6, Block 20 advised tnat he felt the sewer service charges for multiple places such as his were too high and would appreciate it if Commission could make some adjustments in same. There was a discussion and it was decided to study the matter and see what can come up with. Mr . Alan Potter feels we should keep after the Board of Education relative to school facilities here at Atlantic Beach due to our anticipated growth. The Commission has already called the matter to the Board ' s attention, and plans to keep after it. A letter was presented from Fowler & Associates advising that they are making plans to build on Tract 3 , Donner Replat and requesting the City to furnish them with sewer and water services which will be needed about January 1st, 1961. It was discussed and decided Minutes 10-10-60, Page #2 if economically feasible, we would do, but will study and make a definite decision later. A letter was presented from Mr. Ed Banks relative to the excess water charge on his place due to his usage in air conditioning. A sliding scale rate was discussed, as a possibility, and after due discussion it was the consensus of opinion that it was not advisable to cut rates at this time. Mr. Waggoner presented Final Estimate #3 from Joe Reinertson of Jacksonville on the Sewage Lift Station "E" and Force Main in the amount of $4, 180.00 and advised that it has been approved by our Engineer, Mr. Parks and is recommended for payment. Dr. Whitehurslt moved that this Estimate be paid, seconded by Mr. Moore and carried. Mr. Waggoner presented plans from P.H. Gay for a Shopping Center on Atlantic Blvd. and advised that it conformed except for a few minor changes which they will make, and recommended that it be accepted by the Commission. It was discussed following which Mr. Moore moved that the plans be approved and that a building permit be issued Mr. Gay for the Shopping Center, seconded by Mr. Claiborne and carried. Mr. Johansen presented Resolution #60-21 accepting specified streets in Royal Palm Sub-Division as to paving, sewer, water, drainage, etc. an roved adorti'n of_ same ' , seconded by Dr. Whitehurst and car- ried. The maintenance bond in amount of $17 , 580. 50 is on file. Copy of Resolution # 60-21 is attached to these minutes and made a part thereof. Dr. Whitehurst presented Resolution #60-22 permitting the installa- tion of LP gas tanks and mains in street right-of-ways and easements in Royal Palms sub-division with certain stipulations and moved its adoption, seconded by Mr. Moore and carried. Copy of Resolution #60-22 is attached to these minutes and made a part thereof. There was considerable discussion as to enforcing the provisions of this Resolution and knowing when the installations were in line with the code. It was recommended that Mr . Waggoner contact an authprity on such installations so that he can be satisfied as to the said installations. Mr. Howell presented in writing an Ordinance Amending Ordinance No. 67-58-1, Prescribing Street Paving Requirements for Sub-divi- sions and Re-Subdivisions for first reading by title only. Mr. Moore moved its adoption on first reading, seconded by Mr. Johansen and having been duly considered the Mayor put the question thereon f y Minutes 10-10-60, Page #3 and the vote was unanimous in favor of said Ordinance on first reading. October 24th, 1960 was set as date for Public Hearing on said Ordinance. Dr. Whitehunst advised that he has given much thought to the question of donations to charities and civic organizations by the Commission, and that although he is personally in favor of such worthy causes, he is opposed to the City donating tax money to such worthy causes, and would like to go on record that he will vote "no" on any that come up. Mr. Johansen brought up the matter of Civil Defense and what is being done to inform the public. There was a general discussion of Civil Defense. Grage, City Clerk RESOLUTION NO. 1, 5" WHEREAS, the Interstate Contracting Company, developers of Royal Palms Subdivision, have completed all of the sewer lines, water lines, storm drainage lines, curbs and gutters, and paving in Bonita Road, the west portion of Amberjack Lane from Plaza to Bonita Road and the east portion of Amberjack Lane from Plaza to Bonita Road and, WHEREAS, the facilities have been installed according to the approved plans and specifications and have been inspected by the City Forces and, WHEREAS, the Interstate Contracting Company has posted a one year maintenance bond in the amount of $17 , 580. 50 to insure their proper construction, NOW THEREFORE BE IT RESOLVED BY THE CITY OF ATLANTIC BEACH, FLORIDA, That, The City of Atlantic Beach accept these sewer lines, water lines, storm drainage lines, curbs and gutters , and paving in Bonita Road, the west portion of Amberjack Lane from Plaza to Bonita Road and the east portion of Amberjack Lane from Plaza to Bonita Road for maintenance and operation. * * * * Passed by the City Commission on ILLY - , 1960. WHEREAS, The Interstate Contracting Company, which is presently developing land and constructing homes in Royal Palms Sub- division, have requested permission to install and operate a block-type LP Propane gas system and it is the desire of said company to locate underground gas storage tanks and gas mains, to serve each block of said subdivision, in the street rights- of-way and on utility easements granted to the City of Atlantic Beach by way of dedication of said subdivision plat, and, WHEREAS, the City Commission has given due consideration to the request of the Interstate Contracting Company for permission to install said LP Propane gas tanks and gas mains in the dedicated street rights-of-way and utility easements of said subdivision for the purpose of operating such a gas system as described herein; NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Atlantic Beach, Florida, that, The Interstate Contracting Company is given permission to install underground LP Propane gas tanks and gas mains in the dedicated street rights-of-way and utility easements in Royal Palms Subdivision, and the City Manager is hereby instructed to issue permits for the installation of said tanks and mains to said Interstate Contracting Company upon the following conditions: 1. That, when and if it becomes necessary for the City of Atlantic Beach to install, repair, move, replace or do any work on any water, sewer, drainage or other facilities, and in doing such work the LP Propane gas tanks and/or gas mains are in conflict with the proposed work, the Interstate Contracting Company will move, relocate or if necessary remove said tanks and mains within thirty (30) days after written notice at no cost to the City of Atlantic Beach. 2. That, the construction, operation, maintenance and repair of said tanks and mains shall conform to any requirements made by the City for the protection and safety of the public, and such maintenance shall at all times conform to the require- ments and standards as fixed by the American Standard Gas Transmission and Distribution Piping Systems, Code ASA B31. 1.8- 1955 and any damage or injury done or caused to the City ' s streets, curbs, water pipes, sewer lines , drainage lines or any other City property shall be immediately repaired and Resolution No. 6c Page 2 reconstructed under the supervision and control of the City at no cost to the City. 3 . That the location of said tanks will not interfer with the ordinary and customary use of said street rights-of-way. 4. That the Interstate Contracting Company will indemnify the City of Atlantic Beach from any loss sustained by it what- soever as the result of the construction, operation and maintenance of said gas tanks and mains. 5. That the Interstate Contracting Company prior to placing said facilities in use shall furnish the City a certificate from a qualified person satisfactory to the City Manager, that the tanks, mains and appurtenances thereto have been installed according to the code designated in Paragraph 2 hereof and in all respects in compliance therewith. 6. That the acceptance of a permit to install said tanks and mains signifies agreement to all conditions contained herein. * * * * Passed by the City Commission on /0.74 , 1960.
