After conversations with you and your wife you stated you had removed the tree and that you thought it was on your property. After reviewing the survey supplied by you I have determined the tree was on the city right -of -way. By this notice you are cited with a violation of Section 23 -17 of the City of Atlantic Beach Code of Ordinances in that you removed a public protected tree from the city right- of -way. You are required by this notice to appear at the April 17, 2000 meeting of the Tree Conservation Board to determine the correction of this violation. When this development was platted the developer, Sevilla Development Corporation, Inc., retained ownership of the streets. The city was granted the right of ingress and egress to "serve the land shown on the plat." Q. When was a 60 -foot right -of -way established for the streets in our subdivision, and where does this measurement begin and end? A. The 60 -foot right -of -way was established in the original plat of your subdivision. Selva Marina Unit 12B, in which you property is located, was approved by Atlantic Beach City Commission on February 12, 1979 (Recorded in Plat Book 36, Page 76 of the Current Public Records of Duval County on February 26, 1979). The location of the street right -of -way should be indicated on the survey of your property, or you may inspect the plat of Selva Marina Unit 12B in this office. Q. Please provide records of city maintenance done by the city on Hickory Lane, other than water and garbage, etc. Q. List all road improvements done by the city on Hickory Lane. A. The city does not provide maintenance on private property, however, the city has repaired potholes on Hickory Lane and other private streets in your area in order to be able to provide public safety and sanitation service to the residents. Q. Has the city ever published the fact that there is a 60 -foot right -of -way in this subdivision? A. Public notice was given when the plat was presented to the City Commission for approval. Most of the ordinances pertaining to the proper development and maintenance of one's property can be found in Chapter 24, Zoning and Subdivision Regulations, of the city's Code of Ordinances. However, additional references to proper maintenance of one's property may also be found in Chapter 4, Animals; Chapter 6, Buildings and Building Regulations; Chapter 7, Fire Prevention and Protection; Chapter 8, Flood Hazard Areas; Chapter 12, Nuisances; Chapter 16, Solid Waste and Recycling; Chapter 17, Signs and Advertising Structures; Chapter 21, Traffic and Motor Vehicles; Chapter 22, Utilities; and Chapter 23, Vegetation. Auk MINUTES OF TREE CONSERVATION BOARD May 1, 2000 A regular meeting of the Tree Conservation Board was held Monday, May 1, 2000, in the City Hall Commission Chambers. Present were Mae Jones, Chairperson, Eloise Koerber, Judith Jacobson and Staff Members Don Ford and Susan Dunham. 1. Call to Order The meeting was called to order by Chairperson Mae Jones at 7 :40 p.m. 2. Recognition of Visitors None. 3. Approval of Minutes of Meeting of April 17, 2000 Eloise Koerber moved to approve the Minutes of the Tree Conservation Board meeting of April 17, 2000; Richard Bell seconded and the motion carried. 4.A. Old Business /Tree Removal Applications 1. None. 5.A. New Business /Tree Removal Applications 1. 2219 Ocean Forest Drive: Mr. Sims, Jr. presented his tree removal application for the purpose of installing a pool and Florida Room. On site inspection by Board members showed that the trees marked as T13, T16, T17 and T18 on the Tree Removal Application are in the interior zone and, therefore, not protected. After further discussion, Richard Bell moved that we approve the application for the removal of 45" of oak and 43" of hardwood to be mitigated with 22.5" of oak on site and 21.5" of hardwood on site and direct the Building Official to issue a permit. Judith Jacobson seconded the motion, which passed unanimously. 2. 133 Beach Avenue: Mr. Daryl Grubbs introduced himself to the Board as the builder on this property. This application is presented for the purpose of removing trees to build an addition to the home and a garage apartment. The Board determined that the 14" palm to be removed is on city right -of -way. The Board requested Don Ford to determine if the Tree Conservation Board has authority to address the mitigation on this tree since it is in the driveway. In addition, the Board discussed the health of the 17" oak and it was determined that the tree was still alive. With respect to mitigating the 17" oak, it was determined that hardwood could be used for mitigation due to the improbability of another oak surviving in close proximity to the ocean. Richard Bell moved that the application be approved for the removal of 41" of palm and 17" of oak to be mitigated with 20.5" of palm and 8.5" of hardwood (the property is oceanfront and oak trees would probably not survive so the mitigation for the 17" of oak is changed to 8.5" of hardwood). In addition, since the 14" palm in the middle of the driveway is on public property, the Building Official will determine whether City Council needs to address the removal of this tree. Further, we recommend that the Building Official issue a permit for the removal of these trees. Eloise Koerber seconded the motion, which passed unanimously. Richard Bell moved to amend the motion to allow Mr. Grubbs to use a 12" palm on site for mitigation thereby owing 8.5" of palm to be planted on site. Eloise Koerber seconded the motion, which passed unanimously. 3. 1901 Hickory Lane: Chairperson Mae Jones indicated to the Board that a public tree was removed from the front of the home located at 1901 Hickory Lane. Mr. and Mrs. James Morton introduced themselves as owners of 1901 Hickory Lane. Mr. Morton stated that the tax assessor's records indicate that these roads are private roads and that his position is that the City has no jurisdiction in this matter. It was clarified with Mr. Morton that the Tree Conservation Board's role was only to determine the size of the tree removed and set mitigation requirements. Discussion ensued regarding 4 , Minutes of Tree Conservation Board May 1, 2000 Page2 the size of the tree removed. The Board informed Mr. Morton that they were only able to measure the stump since the rest of the tree had already been removed from the site. Based on this on -site inspection, the Board determined the size of the tree removed was 23.5 ". It was explained to Mr. Morton that his options are to plant 23.5" of oak on City right -of -way or pay $82.50 x 23.5 ($1,938.75) into the tree fund. If he chooses to do neither, he will be cited by the Code Enforcement Board and will have an opportunity to plead his case with them. After further discussion, Richard Bell moved that the oak tree that was removed be replaced with 23.5" of oak. Eloise Koerber seconded the motion, which passed unanimously. 6. Reports and Announcements Mae Jones stated someone was still needed to fill Eloise Koerber's seat on the Board. Eloise Koerber stated that her last meeting would be Monday, May 15, 2000. Don Ford updated the Board as follows: 1. 750 Mayport Road: The case has been turned over to the insurance company. No litigation is pending at this time. Don Ford will pursue this issue with the Code Enforcement Board. 2. Trees have been removed without a permit on a lot on the north side of 10 Street between East Coast Drive and Seminole Road. 7. It was not dedicated to the city for use or maintenance purposes. Ownership of the streets in that vicinity varies somewhat. Many of the properties run to the middle of the private road right -of -way. Many others stop at the right -of -way which appears to be owned by the original development company. The survey that you provided to me indicates that the road right -of -way belongs to the development company. The city does not own the right -of -way. The provisions of the Tree Ordinance relating to public property do not apply. I cannot answer whether the tree was on the private property of 1901 Hickory Lane. That should be ascertainable by field inspection and comparison with the survey. If the tree was not on the property of 1901 Hickory Lane, then it was removed in violation of the Tree Ordinance because no permit was acquired and who ever is the owner of that property is not exempted under Section 23- 17(b)(2)a. This review was conducted at the request of the city's representative to the Tree Conservation Board. Present during this review was the City Manager, the city's representative to the Tree Conservation Board, and myself, with the city's attorney responding as legal adviser. It was determined during this review that I had acted prematurely in closing your case and that I did not know or have all the facts as presented to the Tree Conservation Board. As a result of this review, your case remains open, the Tree Conservation Board's Mitigation requirements remain in effect, and I've been directed to forward your case to the Code Enforcement Board for a hearing. The findings of this review were as follows: 1. As Code Enforcement Officer, I cannot close, evaluate, or overturn another board's decision. 2. You have lost your right to appeal, by failing to appeal the Tree Conservation Board's decision to the city commission within seven business days (Enclosure 3). 3. Having failed to exercise your right to appeal, the Tree Conservation Board's ‘ became final. 4. Your original tree mitigation case is not being forwarded to the Code Enforcement Board for appeal, and will not be reviewed, evaluated or dismissed. Your case will be heard for the code violation of failing to comply with the Tree Conservation Board's mitigation requirements (enclosure 4). In an effort to eliminate any undo hardship presented by this notification, you have until March 31, 2001 to comply with the Tree Conservation Board's mitigation requirements. After such time, a hearing before the Code enforcement board will be scheduled and a subpoena issued. I have discussed the issue with the City's Building Official, the Code Enforcement Officer, and have reviewed the files. The City Manager is not empowered with the authority to overturn a decision of the City's Tree Board. The proper appeal of a Tree Board decision is to the City Commission. Consequently, regardless of whether I agreed with you or not on your concerns about the location and measurement of the tree, I could not grant your request for relief from the Tree Board's decision. The minutes of the Tree Board Meeting of May 1, 2000 indicate that the requirement for a seven day appeal may not have been adequately described to you in the meeting. While Don Ford's letter to you of May 3, 2000 outlines this requirement clearly, you indicated that you did not understand it. With this in mind, the only avenue that I can find for you to appeal this matter would be to request consideration by the City Commission. Your first request would be for the Commission to waive the provision requiring an appeal within seven business days because of the instructions you received at the Tree Board meeting. If approved, you could then present your evidence that the tree was on your property, and not in the road right -of -way and further that it was incorrectly measured. If you would like to make this appeal to the City Commission, please forward your request in writing to me at least seven days prior to the next City Commission meeting. For examp' you provided this to me by February 19 I can have it on the agenda for the City Commissi meeting scheduled for February 26 Please keep in mind that any possible appeal to the C Commission does not preclude the Code Enforcement Board from considering whether a fine should be levied for lack of compliance with the Tree Board's decision.
