Commissioners. j MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COM.MISSION HELD AT THE CITY HALL ON MONDAY, JANUARY 12TH, 1959 AT 8 P.M. Present; Wm. S0 Howell Preben Johansen Chas. R. Moore Hugh Roberts Wo Laney Whitehurst, Commissioners and Frank Thompson, City Attorney J.F. Waggoner, Jr. , City Manager Adele S. Grage, City Clerk The meeting was called to order by the Mayor-Commissioner, Mr. Howell. Minutes of the meeting of December 22nd, 1958 were apiroved as written upon motion of Mr., Johansen, seconded by Mr, Moore, and carried. Mr. Howell recognized visitors present and called for arq business from the floor. Mr. Henry F. Martin was p.resen r, and presented to the Commission a letter on behalf of his brother John F. Martin offering to pay the City on or befcre March 31, 1959 the total principal of all general and seawal taxes through the year 1958 on the lot described as E025o Lots 1 and 2 and W53 a of Lots 7 and 8, Block 43, and to comc. promise the interest on the delinquent taxes by paying on 07 before March 31., 1959 the sum of 0225.00 for interest on general taxes and the sum of $15000 for interest on seawall taxes. The matter was discussed and it was agreed that i. would be to the City's advantage to settle at the figures es offered rather than sue on same. The taxes on this proper,y are due from 1932 through 19580 Upon motion of Mr. Johanser. seconded by Mr. Roberts and carried, approval was given to the acceptance of Mr. Martin's offer as stated above paying the taxes and compromise interest on or before March 31st, 1959, if found to be to the City's advantage to so do. Mr. Waggoner reported that the bids as received from Grage Texaco Service and Smith's Sinclair Service had been studied and that the two bids offset each other and he could not make a recommendation of one being better than the other. The matAer was discussed and it was determined that Grage Texaco Service had apparently given satisfactory service during the past year and the Sinclair Service has only been operating under Mr. Smit; for about 60 days, therefore Dr. Whitehurst moved that the bid of Grage Texaco Service be accepted for 1959, seconded by Mr . Moore and carried. Minutes of 1-12-59& Page #2 Mr, Waggoner presented the following estimates on Sewerage contracts and advised that they have been approved by the Engineers Mr. Walter Parks and recom- mended that they be paid; Estimate #4 - Henry G. Dupree Co. $12&548.00 Estimate #6 - Wm. S. Smith ConstoCo0 10,377.00 Mr. Moore moved that these Estimates be paid from the Sewer Fund& seconded by Drc Whitehurst and carried. Mr. Waggpner presented a :'equest from t-hia WN0 S. Smith Construction Co. for an €. tension of time to January 31st . 1959 to complete their contract as there has been a factory delay in deliv ry of some material.� It was discussed and upon motio.l of Mr. Johansen,, seconded by Mr. Moore approval was g i.ven to extend their completion date to January alst& 1959 as requested. Bids were received on iabre tory equipment for the Sewer Plant and tabulated as followsg W.H. Curtin & Co. $1,205.56 Medical Supply Co. 1.270. 50 Surgical Supply Co. 1280,,00 The matter was discussed and upon .yotion of Dr. Whitehurst& seconded by Mr Moore and carried a.+Iproval was givento accepting the bid of W.H. Curtin & co. and that change order be issued to cover. Mr. Waggoner advised that the State Board of Health had approved a sewage disposal plan for Sinleton Trailer Park on Mayport Road and he noticed that the effluent empties into the ditch on Mayport Road and that Le questioned the advisability of this. The Mayor appointed Mr. Waggoner& Dr. Whitehurst and Mr. Moore to look into this matter. The Commission next went into session for Pu`.lic Hearing on Ordinance #90-•59-3 in line with notice of pubic hearing certificate of publication of said notice is attached to these minutes and made a part hereof. Said Ordinance pro vides for the Zoning of the City of Atlantic Bea%h Fla. The Ordinance having been read in full& the Mayor called for any discussion. There was some discussion as to du- plexes and the areas they occupy, also some c1arifi7ations on set-back requirements,. etc. Mr. Johansen moved wet fi Minutes of 1.12-59, Page #3 said Ordinance #90-59-3 be passed on second and final reading, seconded by 7r. Whitehurst and having been duly considered the Mayor put the question thereon and the vote WAS: Aye: Johansen, Roberts, Whitehurst, Howell Pass : Moore Nay: None Whereupon the Mayor declared said motion carried and said Ordinance adopted on second and final reading. Acting Fire Chief Howell presented the yearly report of the Fire Department which was received and filed. Dr. Whitehurst expressed the apprecia6ion of he and Mrs. Whitehurst for thy- assistance rendered them by the Police and Fire Departments in the recent illness and death of Mrs. Whitehurst °s mother.
