As I conveyed during our last conversation, I am primarily interested in safeguarding the health of my two children. During our meeting, you had the opportunity to view the crack in my home's found ion. I anticipate that the necessary repairs will be made in a timely manner per our discussion August 12, 2003. 1 recalled one other needed repair since our meeting-the phone jack in the living room is not working. In addition to the aforementioned repairs, I have larger concerns about the woodpiles in the adjacent lot. I learned during my annual termite inspection that such pi es are i ea negrs or ernutes and may contribute to a problem developing in my home. It is my preference thafthe woodpiles be removed as soon as possible to avoid potential termite infestation. At, Finally, I am concerned about the possibility of harmful toxins in my soil and/or groundwater. Since being accepted in the Habitat program, my intention has been to create a safe, nurturing environment for my family to call home. As noted during our meeting 8/12/03, T was not aware that my neighborhood was a dumping site until about a month after I moved in. During our meeting, the environmental engineer generously offered to conduct testing of my lot's soil. I am agreeable to this testing, and hopeful that the results will assuage my misgivings. In addition, I would like to be kept informed of the testing results from the two lots adjacent to mine. I believe an open dialogue concerning possible hazards in my neighborhood will provide my family with much- needed reassurance regarding our safety and well-being. Regarding our meeting on your home issues, I would like to clarify the following: o The crack in the foundation does not appear to be caused by any settling underneath the foundation. Our construction staff as well a Bill McMahon, a geotechnical engineer, has confirmed this. We will be happy to re-inspect this crack at a future date to determine if there is any change in status. o Beaches Habitat spent over $70,000 on land development costs to prepare the two Jasmine lots. Included in this was the removal of landfill (i.e. household garbage). You are welcome to inspect these bills at our office. o Beaches Habitat has worked with the Department of Environmental Protection as well as Atlantic Geotechnical Environmental Services to insure that your home is environmentally safe. He agreed to establish a grade line for checking the swales so that we could confirm positive drainage and should be ready for another inspection tomorrow. We informed Craig that he would need to pave the roadway in front of the two homes and he argued that there was no requirement to days to do the work, or we will use the bond do so, however if we insisted, he would do it to have another contractor pave the road. - in "about 6 months." After reviewing our Bob City Code with Sonya, I believe Section 24- 252 c allows us to require paving and I will require Habitat to do so. Within all presidential Zoning Districts, the maximum amount of Impervious Surface area allowed is fifty percent (50%). Within all commercial and industrial Zoning Districts, the maximum amount of Impervious Surface area allowed is seventy percent (70%). The Zoning regulations define Impervious Surface as follows: Impervious Surface shall mean those surfaces that prevent the entry of water into the soil. Common Impervious Surfaces include, but are not limited to, rooftops, sidewalks, patio areas, driveways, parking Lots, and other surfaces made of concrete, asphalt, brick, plastic, or any surfacing material with a base or lining of an impervious material. Wood decking elevated two or more inches above grade shall not be considered impervious provided that the ground surface beneath the decking is not impervious. Pervious areas beneath roof or balcony overhangs that are subject to inundation by stormwater and which allow the percolation of that stormwater shall not be considered impervious areas. Swimming pools shall not be considered as Impervious Surfaces because of their ability to retain additional rain water, however, decking around a pool may be considered impervious depending upon materials used. Information verifying Impervious Surface must be provided prior to issuance of Building Permits whenever new construction, including building renovations or additions, new driveways, decks or porches involves any increase in Impervious Surface area.
