MINUTES OF THE MEETING OF THE ATLANTIC'BEACH CITY COMMISSION HELD
AT THE CITY HALL ON MONDAY, MARCH 23RD, 1959 AT 8 P.M.

Chas. R. Moore
Hugh Roberts , Commissioners

Prank Thompson, City Attorney
J.F. Waggoner, - Jr. , City Manager

Absent: W. Laney Whitehurst, Commissioner.
The meeting was called to order by the Mayor-Commis;ioner,Mr. Howell.
Minutes of the meeting of March 9th, 1959 were approved as written
upon motion of Mr. Moore, seconded by Mr. Johansen and carried.
Mr. Howell recognized visitors present and called for any business
from the floor. There was none.
Bids were opened on a police car as specified in invitation to bid,
and were tabulated as follows:

Lynch-Davidson Motors , Inc. 1;782.54
Brooks Plymouth, Inc . 1,654.71
The matter was discussed whereupon Mr. Johansen moved that if it
meets with the Mayor-Commissioner's specifications that the bid of
Brooks-Plymouth be accepted. The motion was seconded by Mr. Moore
and carried.
Bids were next opened for a car for the City Manager and were tabu-
lated as follows :

Duval Motor Co. (Deluxe Anglia) 1;429.00
Thor Investments , Inc.(Renault1,425 .00
The matter was discussed and the Mayor-Commissioner referred the
bids to a committee composed of all the eommissioners .and Mr.
Waggoner to study and decide on whether to buy or not.
A letter was read from the Jacksonville Gas Corporation to-gether
with a copy of Resolution adopted by their Board of Directors
accepting the franchise which the City approved for natural gas .
A letter was read from the State Road Department thanking us for
our co-operation during the recent Public Hearings at 'Lake City on
Road Construction Program for 1959-60 in Duval County.
Mr. Waggoner reminded the Commission of the meeting in Jacksonville
Beach at 10 A.M. on AprilT7th, 1959 with th0 Corps of Engineers
relative to Beach Erosion.

Mr. Waggoner reported that the audit report for the fiscal year
1958 had been received :from the Ludttors , Tyson & Meek and copies
had been distributed to the Commission. Upon motion of Mr. Johansen,
seconded by Mr. Moore and carried the audit report was accepted.
Hr. Howell presented in writing and caused to be read an Ordinance
providing for the registration of every person engaged in business
of door to door soliciting. The City Attorney suggested that the
words "except solicitors or agents of life or other insurance who
hold license issued by the Insurance Commissioner of the State of
Florida or employees or agents of established businesses in Duval
County" be inserted in Section line 2 following the word °'solic-
iting" . The Clerk was directed to insert these words as suggested.
Mr. Johansen moved the adoption of said Ordinance as amended on
first reading, seconded by Mr. Moore. Said motion having been duly
cpnsidered the Mayor put, the question thereon and the vote was :
Aye: Johansen, Moore, Roberts , Howell
Nay: None
Absent: Whitehurst
Whereupon the Mayor declared said motion carried and said Ordinance
adopted on first reading. April 13th, 1959 was set as date for
Public Hearing.
Mr. Howell next presented an Ordinance,in writing, providing for'
fire limits, and regulations governing construction, alterations ,
etc. in the City' of Atlantic Beach. Mr. Johansen moved its adoption
on first reading, seconded by Mr. Roberts . Said Ordinance having
been duly considered the Mayor put the question thereon and the
vote was:
Aye: Moore , Roberts , Johansen, Howell
ITay: None
Absent: Whitehurst
Whereupon the Mayor declared said Notion carried and said Ordinance
adopted on 1st reading. Public Hearing was set for April 13th, 1959.
Mr. Howell next presented an Ordinance in writing which Ordinance
provides for the imposition and collection of sewer service charges.
Mr. Johansen moved its adoption on first reading, seconded by Mr.
Moore and having been duly considered the Mayor put the question
thereon and the vote wag:
Aye: Roberts , Johansen, Moore, Howell
Nay: None
Absent: Whitehurst
Whereupon the Mayor dec16,red said motion carried and said Ordinance
adopted on first reading. April -13th, 1959 was set as the date for
Public Hearing on this Ordinance.

Mr. Howell presented in writing Resolution #59-7 approving
the continuance of City services now being provided to the
residents and freeholders of the area lying north of the City
until the results of the Special Referendum Elections be deter-
mined by the City Commission. Mr. Moore moved the adoption of
said Resolution . The motion was seconded by Mr. Johansen and
having been duly considered the Mayor put the question thereon
and the vote was:
Aye: Johansen. Moore, Roberts , Howell
Nay: None
Absent: Whitehurst
Whereupon the Mayor declared said motion carried and said Reso-
lutior #59-7 duly adopted. Copy of said "Resolution is attached
to these minutes and made a part thereof.
Mr. Howell presented in writing Resolution #59-8 setting up the
official holidays to be observed by the employees of the City.
Mr. Moore moved the adoption of said Resolution, seconded by
Mr. Johansen. Said motion }awing been duly considered the Mayor
put the question thereon and the vote was:
Aye: Moore, Roberts , Johansen, Howell.
Nay: None
Absent: Whitehurst
Whereupon the Mayor declared said motion carried and said Resolu-
tion #59-8 duly adopted. Copy of said Resolution is attached to
these minutes and made a part thereof.
Mr. Waggoner advised that the operator of the Delicatessen located
in the new building at 30 Ocean Blvd. has requested a letter from
the City stating that his location is not in violation of any
City Ordinance covering the sale of beer and wine for consumption
on the premises. We cannot deny the license under the present
Ordinance but the Commission is going to consider an amendment
to the present law which will provide that no beer or wine can
be sold for consumption ofi the premises except in the same loca-
tions as hard liquor is now sold, plus Suets Drive-in and the
Delecatessin at 30 Ocean Blvd.
There being no further business the Mayor declared the meeting
adjourned at 9:10 P.M.

Ba IT RSSOLVSD SY That CITY COMMISSION or TUE CITY
OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDAs
WHEREAS, certain freeholders residing in the area
lying North of the City of Atlantic Beach did petition
the City Commission of the City of Atlantic Beach to
sponsor the necessary special legislative act to annex
certain lands lying North of said City, and
Nom, the City Commission did prepare and present
such special legislative act to the Duval County Delegation,
and
WHEREAS, said Delegation did announce that they
would introduce such special legislative act for consider-
ation of the State Legislature,
NOW, THEREFOR*, BE IT BESOILV*D that all City Services
now being provided by the City to all residents and free-
holders of said area be continued until the results of the
Special Referendum *lactions be determined by the City
Commission.

BE IT RESOLVED BY TEE CITY COMMISSION OF THE CITY OF ATLANTIC
BEACH, FLORIDA, That
The following days be observed as official holidays by the
employees of the City of Atlantic Beach (except necessary
operating personnel) :
New Year 's Day Labor Day
Washington's Birthday Veterans ' Day
Memorial Day Thanksgiving Day
Independence Day Christmas Day
and any other day proclaimed by the Mayor-Commissioner.
