Commissioners. r j MINUTES OF THE REGULAR METING OF THE ATLANTIC BEACH CITY COP'MMISSION HELD AT THE CITY HALL ON MONDAY, APRIL 13TH, 1959 AT 3 P.M. Presents Wm. S. Howell Chas. R. Grage, City Clerk Absent: Preben Johansen, City Commissioner The meeting was called to order by the Mayor Commissioner, Mr. Howell. Minutes of the meeting of -March 23rd, 1959 were approved as written upon motion of Mr. Moore, seconded by Dr. Whitehurst. Minutes of the meeting of -April 6th, 1959 were approved as written upon motion of Dr. Whitehurst, seconded by Mr. Moore. Mr. Howell recognized visitors present and called for any business from the floor. A representative from the Fletcher Band Parents Association made an appeal for a donation to help send the band to Thomas- ville. Mr. Howell advised that we contributed to the Band ex- penses in October, 1958, but that we were prepared to make a donation from the 1959 budget at this time. Upon motion of Dr. Whitehurst, seconded by Mr. Moore approval was given to a donation of >50.00 to the Fletcher Band Parents Association. The Jacksonville District representative of the Avon Company advised that she had been asked by the National Association of Direct Selling to request the Commission to postpone action on the Ordinance coming up for Public Hearing to-night covering door to door selling. The Public Hearing on Ordinances will be later in the meeting. A request was received from Mr. Arthur Penman that the City accept as a public street a public right of way which he has already dedicated lying east of Mayport Rd. and 1421.7 feet north of Atlantic Blvd. with the specific understanding that the City will not have to grade, maintain or pave same. Upon motion of Mr. Moore, seconded by Mr. Roberts the matter was re- ferred to the City Attorney investigation and recommendation as soon as possible. Mr. Waggoner presented a budget study for the first quarter of 1959. Mr. Waggoner presented the annual report on the Water and Sewer Departments for the year 1958 . Minutes 4-13-59, Page §2 A bill was presented from Mr. Walter J. Parks , Jr. , Engineer for the balanOe due him on Engineering fees in line with con- tracts as • let, in the amount of $4, 248.31. Upon motion of Mr. Moore, seconded by Dr. Whitehurst and carried approval was given for the payment as specified. MMr. Waggoner advised that the Uonderwood Baptist Church has reuqested permission to erect a tent on their property to hold their services in while their church building is being built. It was the unanimous opinion of the Commission that they be allowed to erect the tent as requested. Mr. Waggoner Was directed to secure bids on complete unit garbage truck. • Upon motion of IIr. Moore, seconded by Dr. Whitehurst approval was given the City Manager to purchase sewer rods in the amount of $750.00. A letter was read from the Department of Health, Education and 1.lelfare advising that the audit of the Sewer Project had disclosed that we were entitled to Federal participation in this project in the amount of $67,093.29 of which $43300.00 has been paid leaving a balance -which has been certified for payment in amount- of $23,793.29. Check covering this amount has been received. • A telegram was read from Charles E. Bennett, Member of Congress relative to saline water plant sites, but it was decided that Atlantic Beach is not eligible or interested in such a plant. The City Clerk advised that the Solve Marina Realty Company has paid the Special Sewer Assessment on the lots to'be known as Selva Marina Unit =-3 and served by the new system, in the amount of "3, 387.00. It is therefore in order for the City to re-imburse the Selva Marina Realty Co . the cost cf the 12" line which they had constructed in the amount of $4,855 .00. The authorization for the construction of the 12" line and the re-imbursement therefor are covered by Resolution 58-1. Upon motion of Dr. Whitehurst, seconded by Mr. Moore approval was given twpayment to Selva Marina Realty Co . of $4,b55.00 from the Sewer Fund. The Commission next went into session for Public Haring on 'four Ordinances in line with notices as posted. The first Ordinance considered was Ordinance ir95-59-2 covering door to door soliciting. Dr. Whitehurst presented and caused to be read in full said Ordinance ,'-95-59-2 entitled "An Ordinance Providing for the Registration of Every Person Engaged in the Busineseof Door to Door Solicit- ing, etc." Minutes 4-13-59, Page ;=3 and moved - its adoption on second and final reading, seconded by Mr. Moore. The Avon Representative and Jasper Jones speaking for National Association for direct selling again requested that the Commission postpone acting on the said Ordinance for a couple of weeks . It was brought out that the Ordinance excepts agents or employees of established business • in Duval County and therefore does not apply to Avon, Fuller brush, or any other established business . The matter was further discussed and having been duly considered the Mayor put the question thereon and the vote was: Aye: Moore Roberts , Whitehurst, Howell. Nay: None Absent: Johansen Whereupon the Mayor declared said motion carried and said Ordinance X95-59-2 duly adopted on second and final reading. Mr. Moore introduced and caused to be read in full Ordinance 25-59-1 entitled "An Ordinance Providing for• Fire Limits ; and Regulations Governing the Construction, Alteration, Removal, Demolition, Equipment, Use and Occupancy, Location and Maintenance of Buildings and Structures" and moved its adoption on second and final reading. The matter having been duly considered the Mayor put the question thereon and the vote was: Aye: Roberts , Whitehurst, Moore, Howell Nay: None Absent: Johansen Whereupon the Mayor declared said motion carried and said Ordinance 25-59-1 adopted on second and final reading. Mr, Howell presented and read in full Ordinance 00-59-2 entitled "An Ordinance Providing for the Imposition and Collestion of Sewer Service Charges , for the Use and Availability of Service and Facilities Afforded -by the Sewer System of the City of Atlantic Beach,, etc ." A number of citizens appeared to protest the amount of the sewer service charges as they are higher than Neptune Beach' s and Jack- sonville Beach' s , and other places where they have lived. It was brought out in the discussion that the' single family charge of 2.50 was not a charge just thought up, but is the amount that has been stated each time the matter has been discussed beginning with the letters sent out prior to the election in February, 1943 . Also it is hoped that we will find that it will not take this much to run the system and pay off the bonds and if so , in which event we expect to be able to lower the rates . There was further dis- cussion following which Dr. Whitehurst moved the adoption of Ordi- nance ,`-80-59-2 on second and final reading, seconded by Mr. Roberts • Minutes 4-13-59, Page N- and having been duly considered the Mayor put the question thereon and the vote was: Aye: Whitehurst, Moore , Roberts., Howell Nay: None Absent: Johansen Whereupon the Mayor declared said motion carried and said Ordinance #80-59-2 duly adopted on second and final reading. Mr. Moore presented and caused to be read in full Ordinance #10-59-5 entitled " An Ordinance Restricting the Location Wherein a Vendor of Alcoholic Beverages Shall be Permitted to Conduct His Place of Business and Prohibiting the Granting of License to Such Vendor to Conduct and Prohibiting the Conduct of • Such a Business in Any Location Except as Permitted Herein, etc . " and moved its adoption on second and final reading. Said motion was seconded by Mr. Roberts and having been duly considered the Mayor put the question thereon and the ,vote was: Aye: Moore, Roberts , Whitehurst, Howell Nay: None Absent: Johansen \Thereupon the Mayor declared said motion carried and said Ordinance ;`10-59-5 adopted on second and final reading. Mayor•Howell presented the Fire Department monthly report for March, 1959 which was received and filed.
