Special Election (Annexation) S. Commissioners. MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT TH2 CITY HALL ON MONDAY, JULY 13TH, 1959 AT 8 P.M. Present: Wm. S. Howell Preben Johansen Chas. R. Moore Hugh Roberts W. Laney Whitehurst, Commissioners and Frank Thompson, City Attorney J.F. \laggoner, ' Jr. , City Manager Adele S. Grage, City Clerk The meeting was called to order by the Mayor-Commissioner, Mr. Howell. Minutes of the meeting of" June 22nd; 1959 were approved as written upon motion of Mr. Johansen, seconded by Mr. Roberts and carried. Minutes of the meeting of - June 30th; 1959 were approved as written upon motion of Mr. Johansen, seconded by Mr. Roberts and carried. Minutes of the meeting of - July 7th, . 1959 were approved as written upon motion of Mr. Johansen, seconded by Mr. Moore and carried. The Mayor recognized visitors present. Mr. Waggoner advised that he had received a request for a permit to erect a palmetto.' log groin in front of the W.M. Mason place located in Block 20, Atlantic Beach. He advised that although House Bill 239 as passed by the 1949 Legislature permits the erection of groins, seawalls, etc. to protect property against the inroads of the sea, he does not feel that the groins do -any good and recommends that they not be allowed to put them in. The matter was discussed in which it was brought out - that opin- ions on the matter varied, even among engineers. Mr. Waggoner was requested to get more information by the next meeting, and action was deferred to that time. Mr. Howell presented Resolution '59-14 Requiring that all Services Rendered by the Fire Department and the Police Depart- ment Outside the Territorial Boundaries of the City be Discon- tinued and requested the Commission to adopt same. He gave figures as to cost of fire runs alone which have been made out- side the City Limits. There was a discussion following which Mr. Roberts moved the adoption of said -Resolution #59-14, seconded by Br. Whitehurst and carried. Copy of said Resolu- tion is attached to these minutes and made a part thereof. Minutes 7-13-59, Page 2 The Mayor presented Ordinance X12-59-1 entitled "An Ordinance Calling a Special Referendum Election for the Adoption or Re- jection of Chapter 59-1053, Laws of Florida, Special Acts of 1959, etc." for second and final reading. The Ordinance having been read in full, Mayor Howell opened the meeting for any questions on the Ordinance only. Mr. Janes Landon presented a letter from Senator Ripley advising that he had intended to amend the Bill to allow all property owners to vote but it had come to his attention that the word residing was'left in. Upon questioning, Mr. Thompson advised that we assume the cer- tified copy of the Legislative Act as furnished by the Secretary of State is correct , also that the word "residing" means legal residence or permanent place of abode, not just sojourning for a short tine. There was considerable discussion during which it was brought out' that since the Legislative Act calls for a Soecial Referendum, there is nothing Atlantic Beach canTdo but • hold this election as set out in the Act. Whereupon Dr. White- hurst moved the adoption of Ordinance '12-59-1 on second and final reading, seconded by Mr. - Roberts and unanimously carried. There were those present for the annexation as well as those a- hainst it, and Mr. Howell announced that there would be Public earings on the subject on August 11th, 1959 and August 25th, 1959 at 8 P.M. in the City Hall, Atlantic Beach. All those interested are invited to -be present on these two dates for discussions of the matter. The Fire Chiefts report for the month of June, 1959 was present- ed and filed. Dr.- Whitehurst moved - that the meeting adjourn, seconded by Mr. Johansen and carried. ;Thereupon the Mayor declared said meet- ing adjourned. // / ///_ • A Z'In.
