Agenda Item 4BAGENDA ITEM # 4B
STAFF REPORT JANUARY 24, 2011
City of Atlantic Beach
Commission Meeting
AGENDA ITEM: Forfeiture Funds
DATE: January 13, 2011
SUBMITTED BY: Michael D. Classey ,Chief of Police
BACKGROUND:
Forfeiture funds are money or other valuables seized by the Police Department, generally from drug
cases. Florida State Statute (F.S.S.) 932.7055 (5) (a) and (b) governs the requirements for expending
those funds. Specifically, it states that the proceeds may not be used to meet normal operating expenses
of the agency. A few of the permissible uses would be training, memberships and providing additional
equipment.
The statute requires that a request to expend the funds be made to the governing body. These requests
are made during the formal budget process or in a subsequent budget ordinance. It also requires a
written certification that the request complies with the provisions of the statute.
The police department provides a gym membership for our police officers. There are no funds
available in the General Fund budget to provide this physical training opportunity to our officers.
These funds have already been appropriated in the current forfeiture budget. The sole purpose of this
staff report is to certify, as required by statute, that this expenditure does comply with the provisions of
FSS 932.7055 (5) (b).
