MINUTES OF THE ADJOURNED MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD AT THE CITY HALL ON MONDAY, MARCH 31ST, 1958
AT 8 P.M.

The meeting was called to order by the Mayor, Mr. Howell.
Mr. Howell reognized visitors present and called for any busi-
ness from the floor. There was none.
Mro Waggoner requested the Commission to transfer $500.00 from
unallocated Funds to Account $1004 covering the jail and equip-
ment, as it would take approximately this amount to finish the
work and equipment. There was a discussion and Mr. Johansen
introduced Resolution #5811 transferring the funds as requested
and moved its adoption. Said motion was seconded by Oro Marvin,
and having been duly considered the Mayor put the question thereon
and the vote was;
Aye: Johansen, Marvin, Roberts, Howell
Nays None
Absent: Moore
Whereupon the Mayor declared said motion carried and said Reso-
lution adopted. Copy of Resolution #58-11 *s attached to these
minutes and made a part thereof.
Mry Marvin presented a bill in writing covering an Ordinance
amending Zoning Ordinance #50 by requiring 2 family dwellings
to have 100 foot frontage and moved its adoption on first read-
ing, Said motion was seconded by Mr. Roberts and discussion
followed. Mrs Waggoner advised that he felt this provision
was ineonsiatant with other parts of the present Ordinance
citing some of the instances. He also gave statistics on other
cities as to required front foot and square foot areas for
duplexes and we are at present In line with them, Mr. Johansen
and Mr. Marvin advised that they only consider this as a stopgap
until the new Zoning Ordinance is passed and the Zoning Committee
has time to consider the matter. Mr. Roger Peden advised that he
felt there should be some regulations on duplexes, but feels this
Ordinance should have a time limit, and he was advised that the
New Zoning Ordinance would take care of that. an owner of a 75
foot lot on 8th St. requested that the frontage be reduced to
75 feet, as he bought to build a duplex for his home and one
rental. There was further discussion following which the Mayor
put. the question and the vote was,

Whereupon the Mayor declared said motion carried and said
Ordinance adopted on first reading.
Mr. Waggoner advised that he has two applications for duplexes
on which the plans were filed in the office but he was not in
to issue the permits, and he would like the Commissions direction
on them. Mr. Thompson advised that in good faith the passing of
this Ordinance on first reading should stop the issuing of permits
until the matter is settled. Mr. Marvin moved, seconded by Mr.
Johansen and carried, that no permits be issued for duplexes
except those that comply with the pending Ordinance.
Mr. Marvin introduced and caused to be read an Ordinance amend-
ing Zoning Ordinance #50 to change N 10 feet of Lot 1 and
Lot 2 (except North 3 feet) , Block 41 from residence "A" to
Residence "C", and moved its adopthpn on first reading. Said
motion was seconded by Mr. Roberts and having been duly consider-
ed the Mayor put the question thereon and the vote was,

Nays None
Absent: Moore
Whereupon the Mayor declared said motion carried and said
Ordinance adopted on first reading.
Upon motion of Mr. Marvin, seconded by Mr. Johansen the Clerk
was directed to publish and post the necessary notices covering
Public Hearing on the above amendments to Zoning Ordinance #50.
Mr. Howell advised that he had sent a registered letter to County
Commissioner Mallard which was received by him on March 26th, but
to date he had heard nothing from him. He suggested that the Com-
missioners go in in a body to appear before the County Commission
at its meeting next Monday and request assistance especially on
the paving of the Plaza from Sherry Drive to Mayport Rd. Much time
would be saved in answering fires in the County and Mayport if we
could, use the direct route by way of the Plaza. Mrs Marvin advised
that he thinks he can contact Mr. Mallard, so the matter was re-
ferred t% him.
Upon motion of Mr,, Marvin the meeting adjourned.

RESOLUTION NO. 58-11
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
ATLANTIC BEACH, DUVAL COUNTY, FLORIDA, That
Five Hundred ( 500.00) Dollars) from the unallocated
funds be and the same is hereby transferred to account
number 1004, covering Jail and Equipment, in the 1958
Budget.
