MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELI) AT THE CITY HALL ON MONDAY, DECEMBER 22nd, 1958 AT 8 P.M. Present: Wm. S. Howell Preben Johansen Chas, R. Moore Hugh Roberts W. Laney Whitehurst, Commissioners and Frank Thompson, City Attorney J.F. Waggoner, Jr. , City Manager Adele So Grage, City Clerk The meeting was called to order by the Mayor-Commissioner, Mr° Howell Minutes of the meeting of December 8th, 1958 were approved as written upon motion of Mr. Johansen seconded by Mr. Roberts Mr. Howell recognized visitors present and called for any business from the floor. Mr. Hiram Moore requested the Com- mission to extend the time allowed him to correct the non- conforming building he is doing on his property without a permit. Mr. Waggoner advised that he refused him a building permit as what he wanted to do was against building and zoning regulations, that he had gone ahead with the work anyway and had been brought into court on a warrant. The Judge fined him and gave until December ist, 1958 to take down what had been done. Mr. Moore's lawyer had written for an extension of time and Judge Dunlop had given them until January 1st, 1959, The matter was further discussed and it was the (opinion of the Commission that the Judges order be upheld and that any further extension must be given by the Judge. The Commission went into session for Public Hearing on. Resolution #58-38 to hear any objections to confirmation of said Resolution° Proof of Publication of notice for the said hearing is attached to these minutes and made a part thereof. As no one appeared either for or against said Resolution #58-38, Mr0 Moore moved that said Resolution be confirmed which motion was seconded by Mr. Roberts° said Reloluti_on having been 3ead in full and said motion having been duly considered the Mayor put the question thereon and the vote was: Ayes Johansen,Moore Roberts,. Whitehurst, Howell. Nay,; None Minutes 12--22.58, Page #2 Whereupon. the Mayor declared said motion carried and said Resolution #58-38 duly confirmed. Copy of said Resolution is attached to these minutes and made a part thereof. A Plat covering Selva Marina Unit #3 was presented for appro- val. This Unit is on the west side of Sherry Drive from the Plaza north to and including the P.H. Campbell lot. The matter was discussed following which Mr. Johansen presented Resolution #58-40 approving said Plat for Selva Marina Unit #3 and moved its adoption, which motion was seconded by Whitehurst and carried. Cory of Reslution #58=40 is attached to these minutes and made a part thea eof. A deed was presented to the City from John C. Lowe giving the City a 35 foot right-of way which with our present 25 feet right-of-way would give the City a 60 foot wide extension of Levy Road west to the marshland. There was a discussion and upon motion of Mr. Moore, seconded by 7Jro Whitehurst and car- ried approval was given to accept the deed from Mr. Lowe and the Clerk was directed to have same recorded, and that a letter of thanks be written to Mr. Lowe. A contract was presented from Mr. Robert K. Lynch, Station Manager of Radio Station WKTX covering radio advertising for the year 1959. The amount of the contract for 315 half- minute spots is $567000 less 10% for yearly contract with an additional 2% discount for cash payment which would make a net amoukt of $500.10. After discussion Mr. Moore moved that the contract be accepted and that the City Manager work with Mr. Lynch on the announcements and broadcasr spots. This was seconded by sir. Johansen and carried. Sealed bids on gasoline. oil, tires, repairs, services, etc. were received and tabulated f roma Grage Texaco Service Smith's Sinclair Service There was a discussion and upon motion of Mr. Moore, seconded by Dr Whitehurst and carried the matter was referred to the City Manager for recommendations at the next meeting. Mr. Johansen presented in writing an Ordinance providing for the Zoning of the City of Atlantic Beach, Duval County, Florida for the putpose of promoting Health, Safety, Morals and General Welfare of the City, etc. and moved its adoption on first read- ing. Said motion was seconded by Mr. Roberts and having been duly considered the Mayor put the question thereon and the vote wase Minutes 12-22-58, Page #3 Aye : Moore$ Roberts.. Whitehurst$ Johansen, Howell Nay: None Whereupon the Mayor declared said motion carried and said Ordinance passed on first .reading. January 12th, 1959 was set as date for Public Heaving on said Ordinance and the City Clerk was directed to publish the notice of Public Hearing in the Jacksonville Journal. Dr. Whitehurst presented Resolution n58-41 expressing sympathy on the passing of George Allen Pritchard, and moved its adoption° The motion was seconded by Mr. Hohansen and carried. Copy of said Resolution to be sent to Mrs. Pritchard. Also a copy is ttached to these minutes and made a part thereof. Mr. Waggoner presented Resolution # 58-42 covering transfers and changes in the 1959 budget. Mro Johansen moved that said Resolution #58-42 be adoptedseconded by Mrs, Moore. Said Resolution having been read in full and duly considered the Mayor put the question thereon and the vote was unanimous for adoption. Copy of said Resolution is attached to these minutes and made a part thereof. Upon motion of Mr:, Moore, seconded by tura Roberts approval was given for the payment of the Jacksonville Journal invoice cov- ering the publishing of notice of Public Hearing on Resolution #58-38 designating a sanitary sewer district in Atlantic Beach. Payment to be made from the Sewer Fund. Upon motion of Mr. Johansen, seconded by Mr. Moore approval was given for ca11 for bids on the Sewer Distribution Facilities for January 26th, 1959 or at such later date as may be found necessary, and that the call for bids be published as soon as received from the Engineer. EE IT RESOLVED BY THE CITY CONNISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA, THAT 1. That, it is hereby determined by the City Commission of the City of Atlantic Beach that all lots and lands adjoining and con- tiguous or bounding and abutting on said sanitary se; ex, improvement, or, although not adjoining and contiguous or bounding and abutting on said sanitary sewer improvement, are capable, because of their location, of being served by said sanitary sewer improvement, are especially benefited by said sanitary sewer. improve .gent, to the extent and in the proportions to be determined later and shall be assessed for said benefits in the manner provided by Sub-Section 7 of Section 184.05 Florida Statutes. 5. That, the cost for the construction of the said sanitary sewer improvements not assessed to property especially benefited by said sanitary sewers, shall be apportioned to and paid by the City of Atlantic Beach from its Sewer Fund. 6. That, Walter Jo Parks, Engineer, be and is hereby authorized and directed to prepare in duplicate plans and specifications for the improvements ordered hereby and an estimate of the cost thereof and also to prepare in duplicate a tentative apportionment of the estimated cost as between the City and each lot or parcel of lands subject to special assessment under this Resolution, such apportion- ment to be made in accordance with the provisions of Sub-Section 7 of Section 184.05, Florida Statutes. Said Engineer shall file with the Clerk of this City, one copy of such plans and specifica- tions and one copy of such estimate and such tentative apportion- ment, one copy of the same to be retained by said Engineer in his files, all thereof to remain open to public inspection. 7. That, upon the filing with said Clerk of such plans, speci- fications, estimate and tentative apportionment of cost; said City Clerk shall publish once in the Jacksonville Journal, a newspaper of general circulation, a notice stating that at a regular meeting of the City Commission and on a certain day and hour not earlier than ten days from such publication, the Com- mission will hear objections of all interested persons to the confirmation of this resolution. Said notice shall state in brief and general terms a description of the improvement ordered hereby to be made with the location thereof and shall also state that plans, specifications, estimate and tentative apportionment of costs thereof are on file in the office of said Clerk. CITY MANAGER WHEREAS, the untimely passing of George Allea Pritchard, a resident of the City of Atlantic Beach, Florida, has ADELE S. GRACE CITY CLERK taken from our midst a good friend and honored citizen, TREASURER and J. L. RUSSELL WHEREAS, the City Officials of the City of Atlantic Beach CHIEF OF POLICE feel that we have lost one who was great help to and interested in Atlantic Beach, NOW, THEREFOR, it is hereby made a matter of record that the City expresses its sincerest regret at the passing of our friend and extends deepest sympathy to his loved ones in their hour of sorrow, AND BE IT FURTHER RESOLVED That a copy of this Resolution be given to Mrs. Pritchard. * * * * * * * * * * * Passed by the City Commission on December 22, 1958.
