01-14-57 v r MINUTES Ott' `11±F REGULAR MELTING OF THE ATLANTIC BEACH TOWN COUNCIL HELD AT THE TOWN HALL ON MONDAY, JANUARY 14TH, 1957 AT 8 P.M. Present: Norman Ainchew Glover Weiss Wm. S. Howell R.L. Wardrep, Councilmen and J.A. Reid, Mayor Frank Thompson, Town Attorney J.F. Waggoner, Jr. , Town kanager Adele S. Grage, Town Clerk The meeting was called to order by the President, fir. Minchew. Minutes of the regular meeting of December 10th, 1956 and the adjourned meeting of December 28th, 1956 were approved as written upon motion of Mr. Howell, secondeby Mr. Weiss. Mr. Minchew recognized visitors present and called for any business from the floor. Mr. Harcourt Bull tendered the Town a deed to the triangular plot bounded by Fifteenth Street, East Coast Drive, and Seminole Road . He advised that this piece of land is not on the Town°s, nor the County°s Tax Roll, and it is not large enough for a building plot, He proposed thathe Town accept the plot and cancel the paving assessment in the amount of $48.60 now outstand- ing against it. There was discussion and Mr. Weiss presented Resolution #57-1 and moved its adoption. Said motion was seconded by Mr. Wardrep and being duly considered the President put the question thereon and the vote was : Aye : Howell, Weiss, Wardrep, Ninchew Absent: Carr Whereupon the President Declared said Resolution #57-1 duly adopted as follows: RESOLUTION # 57-1 BE IT RESOLVED BY Tris, TOWN COUNCIL OF THL TOWN OF ATLANTIC 3EACH, DUVAL COUNTY, FLORIDA, That The Town accept the deed to the Triangular plot bounded by Fifteenth Streets East Coast Drive and Seminole Road (County Road #667) for the benefit of the Town, and that The paving lien in the amount of 448.60 be and the same is hereby cancelled against this property, and that The Town Clerk be and is hereby directed to have said deed recorded with the Clerk of the Circuit Court, Duval County, Florida. * * * * kr. Bull also proposed and asked the Council's consideration to their giving the Town an equal amount of land west of and adjoinging the present Waterworks site in exchange for the plot now known as the 'Incinerator Site" , as it would better the development now being made in this area. He advised that the Town could continue to use the present site until they might need it, and that if it was necessary to move the present structure now on the site, before the Town was ready to build a new one, that they would move it. The Council direct- ed the Town Manager to look into the matter and report back to them. Mr. Waggoner advised that he has no report on the Council tables, as he is waiting to secure the name; of another cabinet man, so that he 411 can send out to all interested at the same time. He hopes to have a report by the next Council meeting. Mr. Minchew presented and caused to be read Ordinance #198 being an Ordinance providing for the connecting to the Selva Marina Sewer System, and fixing fees and charges to be paid for the privilege and use of same. This Ordinance: having been read, Mr. Howell moved that said Ordinance be passed on third and final reading, which motion was second- ed by Mr. Wardrep. Said motion having been duly considered the President o Minutes of 1-14-57 n Page put the question thereon and the vote was Aye ; Howell, Wardrep, Weiss, Minchew absent: Carr Whereupon the President declared said motion carried and said Ordinance adopted on third and final reading. The amount of $500.00 tap fee to be in Section 3 (a), and 4500.00 fine and/or 90 days in Section 4. Mr, Waggoner advised that the application for Federal Grant on the Proposed Sewer Disposal Plant had been filed and is in the process of being handled. Wardrep advised that there are others interested in presenting a Retirement plan for the Town's employees, and th,e., expects to have a report by the next meeting. There was a discussion on the permanent barricading of the beach, and Mr. Thompson again advised that he felt the Town would be liable if the barricade was not adequately lighted, and that he could not tell just what any court would consider adequate lighting or marking. The matter was discussed thoroughly, and in the discussion Mr. Weiss advised that he felt the itinerant or scattered pilings that were on the beach should be pulled put as they are a definite hazard. Mr. Howell pre. sented an Ordinance by Title only Repealing Ordinance #165 which Ord14. nance provided for the erection and maintenance of barricades or ob- structions,and moved its adoption on first reading. The motion was seconded by Mr. Wardrep and paid motion having been duly considered the President put the question thereon and the mote was: Aye- Howell, Wardrep, Weiss, Minchew, Absent: Carr. Whereupon Mr. Howell Moved its adoption on second reading, seconded by Mr. Weiss. Said motion having been duly considered the President put the question thereon and the vote was: Aye . Howell, Wardrep, Weiss. Minchew Abesnt: Carr. Whereupon the President declared said motions carried and said Ordi- nance adopted on first and second readings. The matter of time and dates for closing the beach was next discussed and Mr. Weiss presented Resolution #5702 and moved its adoption. Said motion was seconded by lir. Wardrep and being duly considered the Presi- dent put the question thereon and the vote was; Aye : Howell, Weiss, Wardrep, Minchew Absent:Carr Whereupon the President declared said motion carried and said Resolu- tion #57-2 adopted as follows; RESOLUTION # 57-2 WHEREAS, it is necessary to the Public Safety and Welfare that the area of the Ocean Beach within the corporate limits of the Town of Atlantic Beach, Duval County, Florida lying southerly of the prolon- gation easterly of the southerly line of 15th Street to the low water mark of the Atlantic Ocean and northerly of the prolongation easterly to said low water mark of the northerly line of Lot 5, Block 36 At- lantic Beach according to Plat recorded in Plat Book 5, , Page 69 of the current Piblic Records of Duval County, Florida be established as a safety Zone for the use of persons engaged In batting, sunbathing, games, fishing and similar recreational activities, NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDA, That It shall be unlawful for any person to propel, operate or drive any power driven vehicle or any vehicle drawn by draft animal, or to ride any animal within the said above described area between the hours of 8 A.M. and 7 P.M. beginning on May 1st and continueing through Septem- ber 30th. * * * * * * * * * * * Mr. Minchew presented Resolution #57-3 to amend the Budget for the year 1956 to reflect actual changes in approrpiations authorized dur- ing the fiscal year.
