07-19-55 v MINUTES OF THE ADJOURNED MEETING OF THE ATLANTIC BEACH TOWN COUNCIL HELD AT THE TOpJN HALL ON TUESDAY, JULY 19th, 1955 AT 8 P.M. Present: Norman Minchew Marvin Carr L.J. "Jack" Feather R.S. Thames, Councilmen and J.A. Reid, Mayor Frank Thompson, Town Attorney Adele S. Grage . Town Clerk The meeting was called to order by the President, Mr. Minchew and went into session as an Equalization Board on the Street Paving Special Assessment Roll for 1955. Certificate of Publicatthon of Notice to Property Owners of the Equalixation Board meeting and also copy of the special assessment roll, is attahhed hereto and made a part of these minutes. There were no complaints, whereupon Mr. Thames introduced Resolution # 55-13 which was read in full and moved its adoption : ' t • Said motion to adopt said Resolution was seconded by Mr. Carr, Said motion having been duly considered, the President put the question and the called vote was as follows : Aye : Carr , Feather, Thames, Minchew Absent: Aams Nay: None Whereupon the Prt.sident declared the motion carried and Resolution ado' Copy of the Call for bids as published in Ocean Beach Reporter on July 8th, 1955 and also proof of publication of Resolution No. 55-9 are attached hereto and made a part of these minutes . Carr approval was given to purchase the 6 cylinder Ford 1955 Business 2-door sedan (business • coupe) at a net delivered price of $1,233.00, from Lynch-Davidson Motors, Inc. ' , • 1 4 / RESOLUTION # 55-13 •i A Resolution finally approving and confirming Those certain Special Assessments fully shown and set out in that certain Town of Atlantic Beach, Florida. The Special Assessment Roll made and prepared in accordance with the Resolution passed and adopted by the Town Council of said Town on June 23rd, 1955, providing for the improving of a portion of Ahern Street, First Street, Ninth Street, Twelfth Street Thirteenth Street Fourteenth Street and Fifteenth Street in said Town. WHEREAS, all things essential to the validity of each and every, all and singular, the Special Assessments contemplated by anset out in that certain hereinabove mentioned and dexcribed Special Assessment Roll have been done and com- pleted incltding the publication of said Roll as required by law, and WHEREAS, said Assessments have by this Town Council and Governing Authority of the said Town of Atlantic Beach Florida, sitting as an Equalization Board. (pipe ) 503.59 Smith & Gillespie Invs. 1,2,3,4 7,751.07 !here was a discussion of the water pressure especially in the after- noons, and it was brought out that in the south section of the Town you cannot get a drop of water out of the faucets from the middle of the afternoon until about 8 o'clock. Whereupon Mr. Feather intro- duced Resolution #55-14 directing that sprinklers not be used in yards nor any yard watering done between the hours of 2 P.M. and 8 P.M. , and moved its adoption: RESOLUTION NO. 55-14 WHEREAS, it has been found and determined by the Town Council of the Town of Atlantic Beach, Florida, that the use of water supplied by the Town for the purpose of watering lawns, plants and shrubs reduces the supply available during the hours hereinafter mentioned to consumers for necessary and essential household uses, and that such use should be limited and re- stricted as herein provided: NOW THEREFORE, Be it Resolved by the Town Council of the Town of Atlantic Beach, Florida: That all consumers of water supplied by said Town hereby are directed to refrain from the use of such water within the hours of two o ' clock P. M. and eight o'clock P. M. of each day, for the purpose of watering lawns, shrubs and plants, until further action of this Council. Passed by the Town Council on July 19th, 1955. Mr. Feather introduced by title only an Ordinance regulating the use of water for yard watering and moved its adoption on first reading. Said motion was seconded by Mr. Thames , and having been duly considered the President put the question and the call vote was : Aye : Carr, Feather, Thames, Minchew Nay: None Absent:Adams Whereupon the President declared said motion carried and said Ordinance passed on firstzeading. Mr. Feather moved its adoption on second reading. Said motion was seconded by Mr. Carr , and having been duly considered, the President put the question and the call vote was : Aye : Carr , Feather, Thames, Minchew Nay: None Absent: Adams Whereupon the President declared said motion carried and said Ordinance passed on second reading. • Upon motion of Mr. Feather, seconded by Mr. Carr, Eddie Bullock was appointed Fire Chief as provided for in Ordinance No. 176. The motion was seconded by Mr. Carr and carried. The matter of an inspector to act for the Town on the new Waterworks Project was discussed and several names mentioned. It was brought out that the Southeastern Contracting Co. have already started on Part"C" of their contract work, and we should have an inspector on the job. After discussion Mr. Thames moved that the matter be referred to the Public Works Committee who are to study the matter and hire an inspec- tor. The motion was seconded by Mr. Carr and the call vote was : Aye: Carr, Thames, Minchew Nay: Feather Absent: Adams Whereupon the President declared the motion carried. The appointment of a Town Manager was next considered. Upon motion of Mr. Carr , seconded by Mr. Thames , J.F. Waggoner, Jr. was presented for appointment as Town Manager at salary of $5,400.00 per year (no raise to be considerdd in next budget) . After due consideration the President put the question and the call vote was : Aye : Carr, Thames, Minchew Pass: Feaher Absent: Adams Whereupon the President declared the motion carried. Request of the Hygema Co. to move a house from Garry St. in Jacksonville onto Lot 614, Saltair was considered. Mr. Bullock advised that he had examined the house and it was in good condition, but does not quite meet the required lot coverage. After discussion Mr. Thames moved that they be given permit to move the house when they have secured the septic tank • permit, met the required lot coverage and laid their foundation. This was seconded by Mr. Carr and carried. i Mr. Harcourt Bull discussed with the Council the waterworks site and asked that they have the engineer establish a reasonable value for the pipe that is presently under ground on the waterworks site, and also to see if the right-of-way will ihUrfer with any future structure. Mr. Feather moved the Engineer be so requested. The motion was seconded by Mr. Carr and carried. Grage , Town 6ierk l , IIIP RESOLUTION # 55-12 WHEREAS, on February 15th, 1955, the Town of Atlantic Beach, Florida enacted Ordinance No. 172 providing for the erection and construction of a waterworks system of said Town and authorizing the issuance of Utility Revenue Bonds not to exceed $260,000.00 to pay for the cost of such project, and WHE EAS, Section 16 of said Ordinance No. 172 provides that all monies received from the sale of said bonds, exclusive of accrued interest, shall be deposited into a special bank account and used only to pay for the cost of constructing the project as defined in said Ordinance and further provides that such proceeds shall be and constitute a trust fund for such purposes, and WUEliEAS, it is deemed desirable and expedient to provide that such proceeds shall be deposited in the Atlantic National Bank of Jacksonville, Jacksonville, Florida and shall be disbursed and withdrawn from said account, in said bank, only after such withdrawal or disbursement shall have been approved by a written certificate from Smith and Gillespie, consulting engineers. Now, therefore, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF ATLANTIC BEACH FLORIDA, That: SECTION 1: The proceeds received from the sale of $255,000.00 Utility Revenue Bonds dated March 1, 1955 shall be deposited into a special account in the Atlantic National Bank of Jacksonville, Jacksonville, Florida and shall be withdrawn and disbursed from said account only for the purposes pro- vided in Sections 2 and 16 of said Ordinance No. 172. SECTION 2s Expenditures, disbursements and with- drawals from said special bank account, in said bank, shall ✓i N • be made only after such expenditure, disbursement or withdrawal shall have been approved by a certificate in writing executed by the consulting engineers, and said certificate shall be attached to and accompany any warrant, voucher or check issued for such expenditure, disbursement or withdrawal from said special bank account and the Atlantic National Bank of Jacksonville, Jacksonville, Florida is hereby authorized and directed to disburse monies from said special account, in the amount provided by such warrant, voucher or check, provided the same has attachbd thereto the aforesaid certificate of the consulting engineers. Vouchers of the Town shall be signed in the name of the Town of Atlantic Beach, Florida by Adele S. Grage, Town Clerk, and countersigned by Norman Minchew, President of the Town Council, or Marvin Carr, Vice-President of the Town Council. The Engineers' certificate shall be signed in the name of Smith and Gillespie by Wylie W. Gillespie or B.F. Borden. SECTION 3: Any securities deposited as collateral to secure monies on deposit in said special account shall be released to said bank, from time to time, upon its request, in the amount that such secu- rities exceed the amount of cash on deposit. Release shall be signed in the name of the Town of Atlantic Beach, Florida by Adele S. Grage, Town Clerk, and countersigned by Norman Minchew, President of the Town Council or Marvin Carr, Vice-President of the Town Council.
