A RESOLUTION MAKING FINDINGS REGARDING
INTERLOCAL AGREEMENTS BETWEEN THE CITY OF
JACKSONVILLE AND THE TOWN OF BALDWIN, AND
THE CITIES OF JACKSONVILLE BEACH,
ATLANTIC BEACH, AND NEPTUNE BEACH, AS
APPROVED IN RESOLUTION 81-1072-403,
RESOLUTION 96-481-132, RESOLUTION 95 -944-
256, AND RESOLUTION 97- 1143 —A; DIRECTING
THE COUNCIL AUDITOR, IN COORDINATION WITH
THE OFFICE OF GENERAL COUNSEL AND THE
COUNCIL RESEARCH DIVISION, AND WITH ANY
ASSISTANCE THAT CAN BE MADE AVAILABLE BY
THE EXECUTIVE BRANCH, TO RESEARCH,
ANALYZE AND MAKE A REPORT AND
RECOMMENDATION ON ALL FACTS AND
CIRCUMSTANCES RELATING TO THE RELATIVE
TAXING OF AND THE PROVISION OF SERVICES
TO CITIZENS LIVING IN THE TOWN OF BALDWIN
AND THE CITIES OF JACKSONVILLE BEACH,
ATLANTIC BEACH, AND NEPTUNE BEACH;
DIRECTING THE CHIEF OF LEGISLATIVE
SERVICES TO PROVIDE A COPY OF THIS
RESOLUTION TO THE MAYORS OF THE TOWN OF
BALDWIN AND THE CITIES OF JACKSONVILLE
BEACH, ATLANTIC BEACH, AND NEPTUNE BEACH;
PROVIDING AN Eerr:CTIVE DATE.
WHEREAS, the City Council approved, in Resolution 81-
1072 -403 an Interlocal Agreement between the City of
Jacksonville and the Town of Baldwin, the City of Jacksonville
Beach, the City of Atlantic Beach, and the City of Neptune
Beach relating to the relative taxing of and provision of
services to citizens living in said communities; and
WHEREAS, the City Council thereafter approved amendments
to the Interlocal Agreements relating to the relative taxing
of and provision of services to citizens living in the cities
of Jacksonville Beach, Atlantic Beach, and Neptune Beach in
Resolution 96- 481 -132, Resolution 95 -944 -256, and Resolution
97- 1143 -A; and
WHEREAS, said interlocal agreements have no expiration
dates, and it is verily believed that these agreements may
therefore be cancelled at the pleasure of any of the parties
as a matter of law; and
WHEREAS, nearly fifteen (15) years have expired since the
City entered into the latest versions of the interlocal
agreements, and facts and circumstances justifying the terms
of the interlocal relationships have changed; and
WHEREAS, good government, fairness, and responsiveness to
the citizens of Duval County require that the facts and
circumstances surrounding the interlocal agreements be
reviewed and analyzed, to determine whether the citizens and
governments of the Town of Baldwin, and the cities of
Jacksonville Beach, Atlantic Beach, and Neptune Beach, and the
citizens and government of the City of Jacksonville continue
to be treated fairly and equitably; now therefore,
BE IT RESOLVED by the Council of the City of
Jacksonville:
Section 1. Facts and Circumstances Investigated.
The Council hereby directs the Council Auditor, in
coordination with the Office of General Counsel and the
Council Research Division, together with any assistance that
can be made available by the Executive Branch, to research,
analyze and report on all facts and circumstances relating to
the relative taxing of and the provision of services to
citizens living in the Town of Baldwin, and the cities of
Jacksonville Beach, Atlantic Beach, and Neptune Beach, as the
taxing and provision of services relate to ongoing
relationships and agreements between the City of Jacksonville
and the Town of Baldwin, and the cities of Jacksonville Beach,
Atlantic Beach, and Neptune Beach.
Section 2. Report to Council. The Council hereby
directs the Council Auditor, in coordination with the Office
of General Counsel and the Council Research Division, and with
any assistance that can be made available by the Executive
Branch, to report to the Council, no later than the first
Council meeting in September, 2010, on its findings and
recommendations, including but not limited to (1) whether the
City of Jacksonville should terminate existing interlocal
agreements and relationships with the Town of Baldwin, and the
cities of Jacksonville Beach, Atlantic Beach, and Neptune
Beach, and negotiate new agreements, (2) whether current
reductions in millage assessments to the citizens of Baldwin,
Jacksonville Beach, Atlantic Beach, and Neptune Beach continue
to be justified and supported by existing facts and
circumstances or whether those reductions should be reduced,
increased or eliminated, and (3) whether current services
provided to the citizens of Baldwin, Jacksonville Beach,
Atlantic Beach, and Neptune Beach at little or no cost, should
be continued to be provided, provided at a reduced cost, or
provided at an increased cost, and (4) whether any of the
described communities are providing services to citizens of
the City of Jacksonville, and whether the costs of those
services are equitably administered and collected.
Section 3. Notice to Beach Cities and Town of
Baldwin. The Council hereby directs the Chief of Legislative
Services to provide a copy of this resolution to the mayors of
Baldwin, Jacksonville Beach, Atlantic Beach, and Neptune
Beach, so that each community can timely conduct its own
investigation of the facts and circumstances described in
section 1; so that each community can cooperate with the
Council Auditor in arriving at the most accurate understanding
of all relevant facts and circumstances; and so that the City
of Jacksonville and the Town of Baldwin, and the cities of
Jacksonville Beach, Atlantic Beach, and Neptune Beach can
attempt to resolve any outstanding differences that may arise
in a prompt, amicable and professional manner in the interest
of all of Duval County's citizens.
Section 4. Effective Date. This Resolution,
representing the internal voice of the Council, and a matter
dealing with its internal affairs, shall become effective upon
signature by the Council President.
