Sincerely, Maureen King City Clerk CITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Use by Exception Auto Storage SUBMITTED BY: Community Developm�r�t, rd DATE: February 20, 1991 " 1L BACKGROUND: At the Community Development Board meeting of February 19, 1991 the Board heard a request for a Use by Exception from Dewey Miller to allow him to store inoperable automobiles outside on his property at 157 D Levy Road. Mr. Miller operates an automotive repair business and explained that he sometimes has vehicles abandoned on his property when customers cannot pay repair costs. Due to his limited business space and the fact that obtaining title to these vehicles requires up to 180 days he wants to store these automobiles outside of his building in a fenced portion of his property. Mr. Dewey stated that towing companies are very reluctant to remove cars without titles. RECOMMENDATION: The Board examined all aspects of this request and recommends that Mr. Miller be granted a limited Use by Exception for 120 days or until .lune 30, 1991 to store inoperable automobiles within a fenced area of his property while he obtains titles for them. CITY Uf ATLANTIC BEACH Rev 1-189 BUILDING OFFICE SEP 281992 , CITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Use by Exception Auto Storage SUBMITTED BY: Community DevelopmpRt.Iand DATE: February 20, 1991 BACKGROUND: At the Community Development Board meeting of February 19 , 1991 the Board heard a request for a Use by Exception from Dewey Miller to allow him to store inoperable automobiles outside on his property at 157 D Levy Road. Mr. Miller operates an automotive repair business and explained that he sometimes has vehicles abandoned on his property when customers cannot pay repair costs. Due to his limited business space and the fact that obtaining title to these vehicles requires up to 180 days he wants to store these automobiles outside of his building in a fenced portion of his property. Mr. Dewey stated that towing companies are very reluctant to remove cars without titles. RECOMMENDATION: The Board examined all aspects of this request and recommends that Mr. Miller be granted a limited Use by Exception for 120 days or until June 30, 1991 to store inoperable automobiles within a fenced area of his property while he obtains titles for them. Off street parking is enclosed by a 8 foot. privacy/security fence enclosing approximately 2924 feet of enclosed parking for employees and loading/unloading. AGENDA ITEM: #4. a. Application for Variance to construct an addition on to an existing nonconforming residence at 448 Sailfish Drive. The applicant desires to construct an addition onto the rear of her home, however the house was originally built 2 feet from the north side property line where 7.5 feet is required. The applicant desires to construct the addition in line with the existing wall of the house, at 2 feet from the property line. The proposed addition will not encroach further into the setback than the existing building and will comply with the required rear setback of 20 feet. The applicant explained to Staff that the interior layout of the house does not allow for the addition to be shifted southward to meet the required setback. By majority votes in the past, the Board has taken the position that additions onto existing nonconforming structures can be granted Variances where the applicant has met or has made all reasonable attempts to meet the required setbacks with the additions. In this case the Board must decide whether the applicant can reduce the size of the addition or relocate it to meet the setback on the side. Based upon past precedent set by the Board, Staff believes that this is not the least Variance necessary to allow the applicant reasonable use of her property. Staff recommends denial of this request. AGENDA ITEM: #4. b. Application for Variance to construct additions to a nonconforming commercial building and to reduce the required parking spaces to those existing on-site. The applicant owns an existing nonconforming commercial structure that contains ground floor retail spaces and a second floor motel The applicant desires to eliminate the motel use and convert the second floor into commercial office spaces. The site layout will be changed by the addition of an elevator on the north end of the building. The building does not meet the front, back, or the Ocean Boulevard side setback requirements. The existing second floor motel has 16 sleeping rooms requiring 16 parking spaces. The proposed commercial offices comprise approximately 7,000 square feet of area requiring 17 parking spaces. There are ten existing parking spaces on-site with no room available for additional spaces. All of the ground floor businesses rely upon on-street parking for their customers. The applicant has proposed to provide adequate parking and esthetic improvement of the site and the existing building. Because of the addition of the cremation equipment it is within reason to associate the use with some of the permitted uses in the ILW district. It is Staffs belief that the operation as described by the applicant will provide a low impact use, in both traffic and city services, on a heavily used road, as well as providing an esthetic improvement in line with the newer construction closer to Main Street. Because Staff believes that the use is more closely related to uses in the ILW district and sees an opportunity to encourage the improvement of the appearance of Levy Road, Staff recommends approval of the request subject to the applicant meeting all state regulations associated with cremation services-,providing the number of parking spaces per 24-161(g)(12)• and meeting the landscaping provisions of Section 24-177. AGENDA ITEM#8B FEBRUARY 12,2001 Minutes of Community Development Board DRAFT December 19, 2000 Page 3 Mr.Worley agreed that tenants will not move in without determining how many parking spaces they will have available to them before they lease a space and that part will be self-regulating. Mr.Worley stated that in general, uses could be limited to a low intensity retail-type operations, but it could get to a point where such specificity becomes too cumbersome to enforce. Mr.Burkhart moved to grant the variance request. Mr. Jacobson seconded the motion,which passed by unanimous vote. Mr. Jacobson thanked Staff for a fine analysis of a very complex issue. c. Application for Variance filed by S. Brett Hammond to construct a swimming pool and addition to existing nonconforming property located at 2348 Seminole Reach Drive. Mr.Worley stated that Mr. Hammond had not submitted a revision at this time. Mr. Worley requested that the Board defer this item until such time as Mr.Hammond submits a revised application. 5. New Business a. Application for Use by Exception filed by G B &M Enterprises to operate a crematory business at 157 Levy Road. Mr. James Hughey introduced himself to the Board and stated that he would like to request a use-by- exception to run a crematory. Ms. Pillmore asked Mr. Hughey how the public would know what type of business he would be operating. Mr. Hughey stated that by state statute they are required to post a 2' x 3' sign on the exterior of the building to identify the building and the licensed director in charge of that facility. There is a privacy fence that encompasses approximately 2900 square feet of interior parking for four vehicles. The machines used for this operation are environmental friendly and require permits from the Department of Environmental Protection. The machines cannot be heard and nothing can be seen. In addition,the machines have six safety features and six baffles in each machine that incinerate its own by-products. The only time an odor or emission could possibly occur would be by operator error. However, all the operators must be licensed. Mr. Frohwein asked Mr. Hughey how he would receive deliveries. Mr. Hughey responded that he has a retail office in Mandarin so there will be no retail traffic at this location. Vehicles would be un- loaded within the building. In addition, only cremations will be performed at this location,no funerals. Mrs.Walker asked Mr.Worley if this was a permitted business in the ILW district. Mr. Worley responded that, in his opinion, yes, it is a form of processing. He believed that it was not the type of operation fitting into the character of the commercial/general district because the tendency is toward professional office space or retail space. However, it is a type of operation that is done behind closed doors in a closed facility with very little direct public contact and would be appropriate in the ILW district. Ms.Walker asked Mr. Hughey about security. Mr. Hughey stated that there will be a security system in the building. On the exterior by the garage door will be a six-foot chain link fence with a two-foot barbwire extension. Immediately adjacent to the building will be chain link fence in front of the AGENDA ITEM M FEBRUARY 12,2001 Minutes of Community Development Board DRAFT December 19, 2000 Page 4 garage door. This will allow them to open the garage door during the day in the summer but still allow them to secure the building within the chain link fence. At night the garage door will be shut and locked. The one window will be filled in with expansion metal to secure the window. There will only be two doors into the building,the front door and the back garage door. The security company they will use is Century Security. In high profile cremations,the building will be manned at night. In addition, on Halloween night the building is manned all night. The crematory business will be run from 7:30 a.m. to 6:00 p.m. The crematories will run cycles of either 1 hour and 45 minutes on up to 2 hours and 20 minutes and operate a total of three cycles per day. Mr. Burkhart moved that we forward this application to the City Council for approval. Mr. Gulliford seconds. Mr.Worley asked if it was the intent of the motion to include Staffs recommendation Mr. Burkhart amended the motion to include the required number of parking spaces and the landscaping provisions as specified in Staff's Report Agenda Item#5.a. Reports and Announcements Mr.Worley advised the Board that the City Commission would like to hold another workshop with regard to zoning codes at 5:00 p.m. on January 8, 2000. Ms. Pillmore advised that at the last Commission meeting she was replaced by Karl Grunewald,the former Code Enforcement Officer. Ms. Pillmore hoped that the Board would welcome him and knows that he will be a very strong Board member. In addition,Ms. Pillmore stated that Mr. Gulliford was the person responsible for her becoming a Board member. Mr. Gulliford complimented Ms. Pillmore for having"stepped up to the plate"and for being conscientious and responsible. Mr. Frohwein thanked Ms. Pillmore for her years of service. 7. Responding to the applicant's statement that surrounding properties have 6-foot fences, Mr.Worley explained that the intent of the code is to correct nonconformances when remodeling and/or building occurs. He stated that a permit is not generally required for repairing a fence. After discussion, Mrs. Pillmore moved to deny the variance and Mr. Waters seconded the motion. After further discussion,it was the consensus of the board that a hardship was not recognized, that the granting of the variance would not be the minimum for reasonable use of the property. . The Chairman explained to the applicant that if the board voted to deny the variance that he could not return with a similar request for one year but he could withdraw his application and consider alternative solutions. Thereupon, the applicant requested that the application be withdrawn and the Chairman requested staff to refund the application fee. II. Application for Variance filed by John Nummy of K, C. Nummy General Contractors on behalf of Atlantic Beach Assembly of God to construct an addition to an existing nonconforming structure located at 680 Mayport Road. Mr. Nummy introduced himself to the board and explained that the applicant desired to add a conforming addition to a nonconforming building. He stated an addition was permitted in 1976 before the City adopted the setback ordinances and in 1988 a second addition was permitted and constructed and the existing nonconformance was not detected at that time. He stated that the new addition will conform to all setback codes. Mr. Nummy presented to the board an artist's rendering of the project for their consideration. Donnie Hatcher introduced himself as the pastor of the church and requested the board to look favorably on the request. Larry Armstrong introduced himself to the board and stated that he is a board member of the church and stated that the proposed addition will be an asset to the community. Responding to a question from Mr. Waters, Mr. Worley explained that the I original addition met the setbacks at the time of construction because prior to 1982 commercial buildings had a zero lot line side yard setback. The second addition was properly permitted and all inspections were made. After discussion, Mrs. Pillmore moved to grant the variance and Mr. Waters seconded the motion. i Mr. Frohwein stated that he was concerned about the parking requirements for the location and was assured by staff that the applicant would be required to comply with all parking requirements at the time of permitting. After further discussion, the board voted unanimously to grant the variance. III. DISCUSSION a. Special Zoning District Mr. Worley stated that the Town Center area is about the only area in Atlantic Beach that would be appropriate or applicable to implement cafe style restaurants with outdoor seating. He furnished the board a copy of an ordinance from Gainesville to be reviewed by them and used as a starting point. IV. MISCELLANEOUS a. Regarding the revised zoning maps delivered to the board,several omissions were noted for correction. b. Mr.Worley stated that pursuant to the board's request he drafted a letter to the City Commission requesting a joint effort with Neptune Beach for trolley or shuttle service from the K Mart parking lot and Town Center area. After correcting minor scriveners errors,the consensus of the board was to proceed with sending the letter with a copy furnished to Chairman Don Wolfson for review and signature. C. Concerning a traffic calming study, Mr. Worley stated he passed the request to the City Manager and will report the results to the board. d. Mr.Worley informed the board that Mr.Grunthal had indicated his intent to resign. He will provide a letter of resignation to Mr. Grunthal for his execution. Application for Variance to permit a six foot high fence in the front yard of a commercial property at the southwest corner of Mayport Road and Edgar Street. The applicant received a Use-by-Exception last month to operate a painting contractors business at this location. He proposes to park several of his vans at the property over night and desires to install a six foot high chain link fence for security. The driveway entrance is to be from Edgar street and will be gated. The applicant cites a number of neighboring properties having such fences. The City recently adopted an ordinance clarifying the intent of fence regulation on corner lots such as this. Staff is concerned about granting such a variance without clearly established hardships. The applicant is requesting this variance under the presumption that a problem will occur and, although there are a number of such fences along Mayport Road, the purpose of the fencing regulation is to protect the visual integrity of street intersections. Mr. Miller operates an automotive repair business and explained that he sometimes has vehicles abandoned on his property when customers cannot pay repair costs. Due to his limited business space and the fact that obtaining title to these vehicles requires up to 180 days he wants to store these automobiles outside of his building in a fenced portion of his property. Mr. Dewey stated that towing companies are very reluctant to remove cars without titles. RECOMMENDATION: The Board examined all aspects of this request and recommends that Mr. Miller be granted a limited Use by Exception for 120 days or until June 30, 1991 to store inoperable automobiles within a fenced area of his property while he obtains titles for them. Request position of permanent part-time clerk for Public Works Mr. Kosoy explained that the storekeeper and clerk/typist/ dispatcher had been assigned additional responsibilities in recent months. The Community Development Board voted at its last meeting to reconsider this matter and to place it on the agenda for this meeting. Staff believes that this applicant has shown that he can manage the storage of the disassembled automobiles without giving the appearance of a junk yard. Upon motion made and seconded the minutes were approved. NEW BUSINESS: I . Reconsideration of Variance granted to Edward H. Morin on April 19, 1995 for property located at 1849 Seminole Road. At the meeting on April 19, 1995 , Mr. McGowan moved to grant the variance with the provision that it not encroach within the 25-foot line of sight triangle required by Section 24-157(b) . Mrs . Pillmore seconded the motion with the request that Mr. Morin report back to the board the results of the acoustic fence in reducing the Poise. Mr. McGowan further amended the motion by adding that the fence be constructed within 60 days . Mrs. Pillmore seconded the motion as amended. The motion was approved by & vote of 4 - 3 . The Chairman explained that after the board granted the variance to Mr. Morin there was a motion for reconsideration. Guidance was requested from counsel and at the May 16, 1995 meeting the motion for reconsideration was approved. Mr. Morin could not attend the May meeting so the matter was scheduled for tonight 's meeting . By Roberts Rules of Order, reconsideration placed the original amended motion back on the table as if no vote had taken place . Mr. Fletcher moved to amend Mr . McGowan's motion by striking t "that the fence not encroach within 25-foot line of sight traingle required by Section 24-157(b)" and insert "that the overall length of the fence to the north be limited to and in line with the southwest corner of the garage and to allow the fence to continue east to the garage" . Mr. Frohwein pointed out that the amendment would be granting something not requested by the applicant . The City Attorney advised that it would be inappropriate to amend the request for variance without the applicant ' s consent . Mr. Fletcher withdrew Mr. Morin suggested to the board an alternative acceptable to him. Mr. Morin stated that there exists on the property a 6-foot fence and 3-foot fence. He requested that that he be allowed to amend his application by tying in to the 6-foot section and set it back from the north side of the garage approximately 8 feet . Mrs . Pillmore moved to grant the original amended motion of Mr. McGowan, with the amendment requested by Mr. Morin. Mr. Wolfson seconded the motion. Mr. Frohwein moved to strike the portion of the original amended motion requiring Mr. Morin to report to the board regarding the acoustic fence. Mr. Fletcher seconded the motion. The Chairman stated Mr. Morin had agreed at the April 19, 1995 meeting, to report to the board the results of the acoustic fence. The Chairman called for a vote on the motion by Mr . The Chairman called for a vote on the original motion made by Mr . McGowan with the two amendments. The motion failed with three aye votes from Mrs . Simpkins, Mrs . Pillmore moved to grant the variance for the fence as proposed being 6-feet in height running from just off his property line north, being 8-foot short of his original request and that Mr. Morin need not report back to the board with his findings regarding the acoustic fence and that the fence be completed within 60 days . Application for Use-by-Exception filed by Dewey Miller of Imports Unlimited to allow outside storage of automobiles for his repair and restoration business located at 157-D Levy Road. Mr. Miller introduced himself to the board and stated that he has been in business at this location 6 years . He explained that he was previously granted a use-by-exception which he thought was permanent but recently discovered through the Code Enforcement Officer that the use-by-exception had been granted for only 120 days . After discussion, Mrs . Pillmore moved to recommend approval of the use-by-exception to the City Commission with the following conditions: a. All outside storage be within the fenced area; b. No dissassembled automobile be stored for more than 120 days; C. The use-by-exception be granted solely to the applicant for the specified location; d. The Code Enforcement Officers be allowed access to the storage area and vehicles stored in violation must be immediately removed and the use-by-exception may be revoke by the City Commission. Mr. Frohwein seconded the motion and it was unanimously approved. III . Application for Variance filed by Charles Ackerman to construct a swimming pool in the front yard of property located at 1760 Ocean Grove Drive. Mr. Ackerman introduced himself to the board and stated that he purchased the property two years ago and has remodeled the structure extensively. He presented pictures to the board of the improvements he has made to the property. Mr . Ackerman explained that the area would be enclosed by a pre- existing 6-foot wall on the front property line and by adding a 6- foot wood fence on the south line and a 4-foot chainlink fence on r the north line with a security gate at the entrance. He stated that the only access to a swimming pool in the rear yard was through the garage. He indicated that if the variance was not approved he may dispose of the property. After discussion, Mr. Wolfson moved to deny the variance request . Mrs . Pillmore seconded the motion and the variance was denied by 5 aye votes by Mr. Wolfson, Mrs . Walker, Mr. Frohwein, Mrs . Pillmore, Mrs . Simpkins and Mr. Fletcher and 1 nay vote from Mr. Frohwein. Mr. Worley delivered copies of proposed amendments to Chapter 24 of the code of ordinances to the members and requested they review them and schedule special meetings for discussions regarding their review. He stated he would like to deliver the amendments to the City Commission by November 1 , 1995 . The board decided to hold the first special meeting at 6:00 p.m. on July 18 , 1995. All fill and backfill shall be clean, free draining sand with a maximum of 10 percent passing the No. 200 mesh, free from organic material, unless otherwise noted. 3. Unauthorized excavation consist of removal or material beyond the indicated subgrade elevations or side dimensions. Under footings, foundation bases or retaining walls, fill the unauthorized excavation by extending the indicated footing bottom elevation. Elsewhere, backfill and compact unauthorized excavation as specified for authorized excavations. 4. WHEREAS, User owns land in Duval County, Florida, described as follows: Road and WHEREAS, User plans to develop said land by constructing 1 buildings, l residences and/or other improvements thereon consisting of WA'; IOUSE and WHEIREAS, The City is the owner of a water plant, water distribution system, sewage treatment system and sewage collection plant in the vicinity of the above described property; and IIIEREAS, User will need water and sewer service, and User desires City to furnish same; and WHEREAS, City is willing to operate such water and sewage treatment system so that all buildings constructed on User's property by User may have furnished to them water and sewer service, subject to all terms and conditions of this Agreement, NOW, THEREFORE, in consideration of the premises and other good and valuable considerations and in consideration of the mutual covenants and conditions hereinafter contained, the parties hereto agree as follows: } (2) 1. Upon the terms and conditions herein contained, the City agrees to provide potable water and domestic sewer services to the User's Property. The terns "dotmestic sewage" used in this paragraph and referred to throughout this Agreement is defined as follows: Hunan waste including liquids and solid matter carried from plumbing fixtures normally carried off by drains and sewers, and except where specifically excluded bath and toilet wastes, laundry wastes, kitchen wastes and other similar wastes. It does not include commercial or industrial waste. 2. City agrees that after User has connected to the system, thereafter City will provide, at its costs and expense, but in accordance with other provisions of this Agreement, including rules and regulations and rate schedules, sewer service and water service to User's Property in a manner conforming to reasonable requirements of public governmental agencies having jurisdiction over City's water and sewer operations. 3. User shall, at its costs and expense, install all of the potable water distribution and domestic sewage collection lines which may be required on User's property, including engineering cosh to connect City's plant tolthe User's property, and all other facilities necessary to make it possible for the City to provide adequate potable water and domestic sewage service. If buildings more than two stories in height are constructed on the User's property, the User, at its own expense, agrees to furnish to the City any equipment which may be necessary for pumping potable water to the additional height with associated back-flow preventers, (3) At all times during the construction of the potable water and domestic sewer lines and related equipment, the City shall have access to the construction and the right to inspect the construction to insure that the lines and related equipment are being installed in accordance with the plans and specifications approved by the City. User shall construct the domestic sewage disposal lines in such a manner as to insure that no water from air conditioning systems, ice machines, swimming pools or any other form of condensate water shall flow into the domestic sewage disposal lines of the City and nothing other than sewage in its strictest sense shall be discharged into the domestic sewage disposal system of the City. City shall inspect all connections made by contractors, plumbers, builders, etc. to any portion of the sewer system that discharges into the sewage collection system owned or operated by City or contemplated to be owned and operated by City under the terms and conditions of this Agreement prior to being covered up. City shall only be obligated and will only provide water and sewer service to User's property upon 100% completion of all terms and conditions of this Agreement. 4. User shall pay a planning and inspection fee in order to defray all actual costs to City of preparing and executing this Agreement, including any attorney's fees; and conducting the inspection and testing of the installation of the User's Extension; and all other administrative costs incident to accepting the User's extension, Said fee shall be equal to one half of building permit fee. 5. User shall pay City a "Sewer Impact Fee" of $1,035.00 per residential unit and a water impact fee of $10.00 per fixture unit/or as otherwise (4) provided in the City's Code of Ordinances, 6. The City shall provide water and sewer service to User's property upon payment to City of the standard meter charges as provided in the City's Code of Ordinances ($85.00/ 5/8 x 3/4 inch meter) , 7. Payment of the Sewer Inpact Fee, Water 7npact Fee, Planning/ Inspection Fee and Water 1,16-ter Charges, shall be made in full at the time City approves the plans. 8. In the event, at a future date, City's charges, rate schedules or fees are revised, subject to the operating rules and regulations and approval of governmental authorities having jurisdiction, then in that event, User and/or assigns shall pay the charges, rates or fees then in effect on date of payment. 9. Hydraulic share of main extensions-payment or refund; User recognizes that water or sewer utility service to th User's property is provided by the use of a main extension and other improvements constructed by a prior developer and that User is obligated to refund to said prior developer User's share of the cost of said main extension or other improvements, Accordingly, User shall pay its pro rata share of the cost of said main extension or other improvements to City. Said pro rata share shall be based on Developer's percentage of the hydraulic capacity of said extension or other improvements. For the purpose of this Agreement, the cost of Developer's said hydraulic share shall be $ With respect to utility facilities installed by User to which future developers connect directly, and in consideration for monies expended by User toward said facilites, City shall refund to User, or User's successors or assigns, solely from monies collected from said future developers, said (5) future developer's pro rata share. of the cost of'said facilities', Said -refunds shall be calculated on the basis of the hydraulic capacity and demand of said future developer whenever feasible, The refund obligation of City hereunder and the benefits to User related thereto shall expire five (S) years from the date of execution of this Agreement, Said refund shall be made to User within sixty (60) days of the receipt of payment by City from a future developer, 10, If any damage is done by User, its agents,f or employees, to the existing potabld water lines or domestic sewer lines of City or other utilities CATV, electric, phone, or the potable water lines or domestic sewer lines installed pursuant to this Agreement, during or after the installation thereof and by reason of construction work, User shall at his expense, make such repairs as are required to restore said potable water or domestic sewer lines to the condition which existed before such damage occurred, but in the event User does not restore said potable water or domestic sewer lines (but this clause shall not be construed as to require the City to make such reparis or restoration) , User shall provide the City and its agents adequate access and facilities for the making of said repairs. All costs incurred by the City in making such repairs shall become inTmdiately due and payable and shall be considered in all respects the same as if said charge had arisen in connection with the rendition of the regular services of the City, 11. Notwithstanding any provision of this Agreement, the City shall have no obligation to provide sewer services to any customer producing sewage which is unusually burdensome, unusually costly to process or substantially detrimental to the sewage system. 12. This Agreement shall be beinding upon the parties hereto, their successors in interest, grantees, transferees and assigns, In the event User transfers any part of the User's property, it will cause its transferee to comply y in all respects with the provisions of this Agreement. 13. In the event the City sells either its sewer treatment plant or collection system or its water treatment plant or water distribution system to any governmental body or any other purchaser, then, in such events, this Agreement shall terminate as to the City on any protion sold and all of its obligations or liabilities hereunder shall cease and determine for that portion sold. 14. The City may shut off the water to the User or any other person and refuse to accept sewage from the User or any other person if the User or any other persons shall fail to pay any sums due hereunder when the same becaue due and payable. Nothing herein contained, however,. not any action taken by the City in pursuance hereof shall impair any other remedy which the City might have, at law or equity, for breach of this Agreement by Owner or any other person. 15. City does not guarantee an uninterrupted supply of water for any , purpose or water at any particular pressure for any purpose and reserves and shall have the right to shut off the water in its main at any time for the purpose of making repairs or extensions or for other purposes incidental to its water supply and will not be responsible for any damage caused by low pressure. City shall have the right to turn off water service at the main where the User has been found to be useing water illegally, and to assess a fee for restoration of service. 16. The City shall have the right to assign and transfer this Agreement at any time provided., however, that no such assignment or transfer shall impair the rights or increase the obligations to the User or any other person pursuant to this Agreement. (7) 17. Unless sooner terminated as provided herein, the initial term of this Agreement shall be 15 years. After the initial term of 15 years from the date of the execution of this Agreement, the terms of this Agreement shall automatically be renewed for successive terns of five (5) years each, unless written notice of termination of this Agreement is provided by either party hereto, not less than ninety (90) days prior to the comneizcement of any such renewal period. 18. It is expressly agreed and understood between User and City that there are no other written or verbal agreements applicable herein between User and City. 19. This Agreement may be amended and modified from time to time as necessary by mutual written agreement of the parties hereto.
