02-28-49 v MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH TOWN COUNCIL HELD .T THE TOWN HALL ON LONDAY, FEBRUARY 28th, 1949 AT 8 P.M. PRESENT: F.P. Ganzel D.P. Mason D.W. Bremer Hugh Rawls , a,ndJ;G. Kirby, Councilmen. and G.L. Rosborough, Mayor Frank Thompson, Town Attorney C .R. Frazier , Town Supervisor Adele S. Grage , Town Clerk The meeting was called to order by the President , Mr. Ganzel who called for the reading of minutes. Upon motion of Ilr. Mason, seconded by i• r. Rawls , the minutes of the regular meeting of February 14th , 1949 were approved as read. Mrs. Wm. Dunlap appeared on behalf of the Atlantic Beach Garden Circle who have taken the Town Park as their civic project for this year. She advised that the Garden Circle had already spent considerable money for shrubbery, fertilizer and top-soil, as well as labor, and they would like the co-operation of the Town in their further efforts . She also requested that something be done about the playdround equipment. Upon motion of IMMr. Mason, seconded by hr. Bremer, the matter was referred to the Public Works Committee who will confer with the Garden Circle Civic Committee. A letter was read from Mr. Futch, Manager of the Beach Theatre requesting Council to pass a Resolution for the repeal of the 20% tali on movie admissions , and upon motion of Mr. Rawls , sec- onded by Mr. Mason, the following Resolution was adopted: WHEREAS , it is the opinion of the Mayor and Town Council of the Town of Atlantic Beach, Duval County, Florida, that the Federal 20% Tax on Movie admission tickets is regressive leg- islation inasmuch as it could emasculate a medium of education, information and persuasion that has not yet attained its full growth, NOW THEREFORE BE IT RSSOLVED BY THE SAID MAYOR AND TOWN COUNCIL, That , the repeal of this tax is hereby advocated, and BE IT FURTHER RESOLVED, that copies of this resolution be furnished the two Senators from the State of Florida and the Honorable Charles Bennett , Representative from this District. Mr. &_I4r.s.'._H.A. Holcomb were present and asked. for further informa- tion as to approval for their building a 2 story garage apartment on the rear of their Lat . The Laws and Rules Committee advised that they did not have a report at this time and asked that the matter be tabled until future time when more information was received. • The . Holcombs. were advised to secure permission of the property owners as provided by the Zoning Ordinance and present to the Council, then if the Council so wishes they will call for advertising and a public Hearing on the matter before it can be approved or disapproved. The Town Clerk was instructed to furnish Airs. Hol- 411 comb with a list of property owners in the radius of 150 ft . of her property Feb. 28, 1949 - Page #2 A letter was read from Mr. S.S. Jacobs asking if it were possible for the Town to require the lot owners on either side of him to top-soil or muck their lots to stop the blowing of their sand onto his place. Mr. Thompson advised that while such a condition is a menace to the neighbor, and detracts from the appearance of the surrounding property, it does not come under the nuisance laws, as it is not a menace to the health of the general public . Upon motion of Mr. Rawls , seconded by Mr. Bremer the Town Clark was directed to advise Mr. Jacobs that there is no legal basis for forcing the property owners to put muck on their lots. Mr. Frazier reportedB the signs ,that lave been put up and painted on ;9.tlant is/o1 the State Road Depatt ment , and requested that a Resolution be sent Mr. Wilson of the State Road Depart- ment expressing our appreciation of their co-operation. By unanimous consent the following Resolution was adopted: WHEREAS , it has been brought to the attention of the Mayor and Town Council of the Town of Atlantic Beach , Florida, that the State Road Department , and particularly the office of the Dis- trict Maintenance Engineer at Baldwin, Flarida, has on numer- ous occasions in the past expeditiously and efficiently responded to to request of the Town Supervisor for needed work on the Atlantic Boulevard, a case in point being the recent placing of school signs at crossings, NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND TOWN COUNCIL, That heartiest thanks be extended to the said District Mainte- nance Engineer for this splendid co-operation, and BE IT FURTHER RESOLVED, that the Town Clerk furnish a copy of thia resolution to the District Maintenance Engiheer, and to the State Road Department at Lake City and at Tallahassee. The Town Clerk presented the delinquent tax list , and it was decided that we first send out a letter over the Attorney's signature in an effort to collect . Er. Thompson and Town Clerk are to get to-gether on the details . Mr. Thompson reported on the Seawall Emergency suits. He advised that the Copper Kettle would like to be allowed to pay theirs monthly as previously agreed. There was a discussion and upon motion of Mr. Eason, seconded by Mr. Rawls , it was approved that the Copper Kettle be allowed to pay on a monthly basis as recom- mended by Mr. Thompson. Mr. Thompson advised that the legislators would meet at Jackson- ville Beach on Saturday, May 5th to go over matters of Beach interest. It was decided that -.1,,r. Rosborough with Mr. Rawls and Mr. Bremer would attend this meeting to represent the Council, to-gether with Er. Thompson who will present our desired charter changes to them. Mr. Ganzel reported on a conversatioXi with Mr. Sollee who would like forLus to take all streets into the Town. There was a dis- cussion of this matter, and upon motion of Mr. Mason, seconded by Mr. Rawls , it was decided to only take in the Plaza from East Coast Drive to Sherry Drive. Mr. Frazier reported that he was ready to pour the 15th St . Ramp, which he will do as soon as the tides and weather permit . Mr. Frazier recommended that we resume Saturday garbage collections beginning March 19th, and upon motion of Mr. Rawls, seconded by Mr. Bremer this was approved. Upon motion of Mr. Rawls, seconded by Mr. Mason authorization 110 was given Mr. Frazier to use the pick-up truck for transportation back and forth to his home . Feb. 28, 1949 - Fage#3 Mr. Frazier had no report on bids for buildings , and the sugges- tion was given t hat a suitable addition be made to the present Town Hall building to store the trucks , etc. Mr. Rawls believes present plan to use incinerator site for storage building is best , as type building needed not suitable to Town Hall and also in- cinerator site further from ocean and salt spryy. 1°r. Rosborough feels that a good lean-to in place of the jail building and con- forming to the present building would be good idea. There was discussion of the maVter and ir. Frazier was advised to continue with getting bids for building on incinerator site to house the equipment . Upon motion of' Mr. Rawls, seconded by iir. Bremer , i•ir. Frazier was authorized to tear down the jail building. Frazier reported that letters had been sent out to property owners re : Saltair Street paving, and only 2 had i7eplied. One was in favor of the paving and one against . Upon motion of Tir. Rawls , seconded by i r. Mason it was :x ecided to write the owners again advising them that the matter would be disposed of at the next r'egulat Council meeting, and if they have not replied by that date , it would be assumed that they approve and have no prefer- ence for pavement type .
