06-20-49 v MINUTES OF THE ADJOURNED MEETING OF THE ATLANTIC BEACH TOWN COUNCIL HELD AT THE TOWN HALL ON MONDAY, JUNE 20TH, 1949 AT $ P.M. Present : F.P. Ganzel D.W. Bremer D.P. Mason Hugh Rawis, Councilmen and Frank Thompson, Town Attorney C.R. Frazier, Town Supervisor Adele S. Grage, Town Clerk The meeting was called to order by the President, Mr. Ganzel. A bill from J.W. Johnson covering a load of oyster shell was approved in amount of $1$.00 upon motion of Mr. Rawis seconded by Mr. Bremer. The Council next called for Public Hearing on permitting the remodeling of the existing single family residence on Lot 1, Block 24 thereby diminishing the rear yard space to 25 feet . Copy of Notice of Public Hearing is attached to these minutes and made a part thereof. There were no objections, and upon motion of Mr. Rawls, seconded by Mr. Bremer the following Resolution was adopted: WHEREAS. Ordinance #50, Zoning Ordinance, specifies the set-back requirements and the back yard Space, and WHEREAS, the residence on Lot 1, Block 24, Town of Atlantic Beach was erected before the effective date of the said Ordi- nance #50, and the said residence was set back far beyond the requirements thus limiting the rear yard space so that to make an addition to the said residence, in the rear, would project such addition into the rear lot space, and WHEREAS, to prohibit the addition would work a hardship on the present owner, NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN C&' ATLANTIC BEACH, FLORIDA That, there is hereby:;found and declared a hardship on the owner and there being no objection at a public hearing held on this date , and B$ IT FURTER RESOLVED That the Building Inspector of the said Town be and he is hereby authorized and instructed to issue a building permit for the construction of an addition to the said residence extending five feet into the rear yard space . Next was heard the Public Hearing on the Unpiated Strip lying west of Block 4 in Atlantic Beach as covered by legal notice attached hereto and made a part of these minutes. Mr. Rex Thames appeared to protest this change in the Zon- ing Ordinance as he does not think the lot coverage for houses in this area should be reduced. Mr. Thames! home adjoins this unplated strip. There was a discussion of the matter and it was the majority opinion that we do not want to lower the standard of houses to be built, or the minimum size. Upon motion of Mr. Rawls, seconded by Mr. Bremer the uhplated strip lying west of Block 4, Atlantic Beach will remain Residence "B". • The matter of License Ordinance was discussed and Mr. Mason recommended that the Ordinance remain as it is without any change . It wqs brought out that the license for trailer camps was out of line to other licenses and unequal, after discussion and upon motion of Mr. Bremer, seconded by Mr. Rawls the following Resolution was adopted: WHEREAS the license for trailer camps is found to be unequal, NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND TOWN COUNCIL CF THE TOWN OF ATLANTIC BEACH , FLORIDA, That , the license fee on trailer camps be and the same is hereby changed to $50.00 per year. The vote was Rawls, Bremer, Ganzel "aye" , Mason "nay". Upon motion of Mr. Rawls, seconded by Mr. Mason no trailer camp license will be issued without the approval of the Mayor and Town Council. Mr. Rawls advised that the Town was badly in need of a dump truck and he would like to recommend that the Town buy the second hand Dodge dump truck which George Frazier has for $280. There was discussion and upon motion of Mr. Rawls , seconddd by Mr. Mason authorization was given fornthe pur- chase of the dump truck for $2$0. The matter of a motorcycle was continued , as have not received the bids requested. Mr. Frazier advised that the McCormicks would furnish the clay for the playground ball field for $400. but would donate $100. to the project . Also that they would furnish their motor patrol for $96. but would donate $72. of this amount,also. Upon motion of Mr. Rawls, seconded by Mr. Bremer the McCormick offer was accepted and the Town Supervisor is to write and thank them for their contributi on. Upon motion of Mr. Mason, seconded by Mr. Rawls an Ordinance was passed on 1st and 2nd reading to collect a fee of $1.00 from every driver of commercial vehicle driving in the Town of Atlantic Beach and that the money be earmarked for play- ground. Mr. Wilcox requested that the Council take some definite action relative to having the property owners repair seawall damage. The matter was discussed and upon motion of Mr: Mason, seconded by Mr. Rawls the necessary Resolution , referring to the break in Seawall at Cliford Payne property Lot 4, Block 33 , was referi ed to the Town Attorney for drafting. • An Ordinance which has been passed by the Town of Neptune Beach covering the public peace and morals , was read and discussed and upon motion of Mr. Mason, seconded by Mr. 4 Bremer it was referred to the Laws and Rules Committee. The Ordinance covering the paving of Saltair streets was presented and upon motion of Mr. Mason, seconded by Mr. Bremer an"Ordinance .providing for the opening, grading and paving of a portion of those certain streets of the Town of Atlantic Beach , Florida as shown on Plat of Saltair Sections 1 and 2 , recorded in Plat Book 10, page 8 and 15 respectively of the current public records of Duval County , Florida, viz: The street designated on said Plat as Park Avenue ( kow known as David Avenue) from Saltair Boulevard northwesterly to Belvedere Street , Belvedere Street North- easterly from said Park Avenue ( David Avenue) to Sea Spray Avenue , Sea Spray Avenue Southeasterly from Belvedere Street to Saltair Boulevard; etc ." was passed on 1st and 2nd read- ing. The Council will meet on next Monday night , June 27th , 1949 to consider final passing of this Ordinance. Mr. Sargent requested that something be done to fill the holes in Section "H" streets. Mr. Frazier was instructed to see if he could get some of the jetty shell from Mr. 410 George Bull to relieve this situation. There was a general discussion of general street paving needs and of a street paving program.
