COUNCIL HELD AT THE TOWN HALL ON MONDAY, JULY 11TH, 1949

The meeting was called to order by the President, Mr. F.P.
Ganzel and went into session fcr Public Hearing on Rent De-
control. Notice of th is Public Hearing was published in
the Ocea1 Beach Reporter on July 1, 1949, certificate of
publication attached to these minutes and made a part thereof.
Notice was also posted at the Town Hall from June 29th to
date. The Town Clerk advised that the Public Relations
Officer at the Naval Air Station had been notified of the
meeting.
Mr. Ganzel called for those against dent de-control to speak
first , as we had already heard from those in favor of,in their
Resolution which was presented at last meeting. Mrs . Anette
Smith spoke against de-control advising it was her belief that
rents wouod go up, and that with GI's and others of small in-
come they could not stand rent advance. She advised that her
rent was past due now, due to the Government's delay in sending
her husband 's check, and they had received an eviction notice ,
therefore if rents were raised it would be impossible for them
to pay . Mr. Mason advised that he did not believe that rents
would be raised perhaps in this instance, but believe if they
were, that they cou ld find another place as satisfactory for
perhaps less . Mr. Minchew advised that a person can be dispos-
sessed with or without rent control, if their rent isn't paid .
Dr. Do ,r3ing read some comment from a Washington Official on the
subject . There was further discussion, and upon motion of Mr.
Mason, s efonrl ed by Mr. Rawls the Council went on record as
approving rent de-control, and approved the following Resolu-
tion to be sent to the Governor of the State of Florida asking
flu the de-control of rent in the Atlantic Beach Area:

of business.
Minutes of the regular meeting of June 13 , 1949 were approved
upon motion of Mr. Mason, seconded by Mr. Kirby.
Minutes of the adjourned meeting of June 20th, 1949 were
qpproved upon motion of Mr. Rawls, seconded by Mr. Bremer.
Minutes of the adjourned meeting of June 27th, 1949 were
approved upon motion of Mr. Kirby, seconded by Mr. Maso4.
Mr. Ganzel next called for any business from the floor
before ming into routine matters . Mr. . Harc ourt Bull
stated that; since the Resolution on the paving, etc .. of
the Saltair streets had been published, . the call for bids
was next in order. Upon motion of Mr. Mason, seconded by
Mr. Bremer the following Resolution was adopted:
RESOLUTION of the Town Council of the Town of
Atlantic Beach, Florida, authorizing the call
for bids , furnishing the materials , equipment
and labor required for the opening, paving and
grading of certain streets of said Town as pro-
vided for by Ordinance Number 125 and Resolution
of said Town Council pursuant thereto.
BE IT RESOLVLD by the I.ayor and Town Council of the
Town of Atlantic Beach, Florida : That bids be called for
by said Town for the furnishing of all the materials , equip-
ment and labor required by said Town for the opening, paving
and grading of those certain streets of said Town as provided
for in Ordinance Number 125 , heretofore adopted by the i ayor
and Town Council of said Town on June 27th, 1949 , said work
and improvement to be done and constructed in accordance with
the plans and specifications attached to and made a part of
said Ordinance and on file in the Office of the Town C lerk of
said Town, such bids to be received by said Town up to and
until 5 o'clock P.M. of the 8th day of August 1949 .
BE IT FURTHER RESOLVED that the Town Attorney be and he
is hereby directed to prepare appropriate form of call for
bids and such other instruments and documents as may be
appropriate to comply with the above requirements and deliver
the same to the Town Clerk who shall give public notice of
the Town's request for bids by publishing such call for bids
one time at least 15 days prior to August 8th, 1949 in a news-
paper of general circulation published in Duval County, Florida . JOI
This Resolution shall take effect iimediately upon its
passage .

Mr. Fred Lawrence advised that he was putting in tie-backs
between 1st and Ahern Sts , and that while he was doingthe
work he would put one in for the Town at 1st St. for 150 .
There was a discussion and upon motion of Mr. Rawls, seconded
by Mr. Mason,- approval was given for Mr. Lawrence to put in
the tie-back -at 1st St. for $150 .
Mr. D.T. Manget , Sr. asked permission to build a retaining
wall on the north side of 11th St, just a few feet south of
the Bull property line, and to -fill in the street-end and his
son's property( which is -on the south side of 11th St. ) at
his expense. Mr. Manget advised that he would stand all the
expense, if the Town wvu id -approve the project. There was a
discussion of the matter and upon motion of Mr. Mason, seconded
by Mr. Rawls -Mr. Manget was requested to present plans and
specifications for th-e -work he wishes to -do, and also the
permission of the property -owner on the north side of 11th St.
for the wall ,to be ,placed that -close to his property line,
and when these are -received the Council will consider.
Mr. George Bull who was present advised adatsad that if the
Town approves Mr. Manget 's -plans, that they will not object
to the work being done. - -
Mr. Ganzel thanked the Council forntheir co-operation and the
work which has been done on the ball field at the school, advis-
ing that they needed bases for the field, and when these are
secured it will be -ready -for play.
There was a discussion of fogging, and Mr. Mason advised that
he did not believe this method was the right approach and that
t should be done from the air_. - It was agreed that it might be
better if done from the air, but the Mayor advised that he did
not believe that the Navy would do any spraying, but will see
if he can find out anything further . Mr. Mason moved that
fogging be further delayed until can see if Navy will help.
There was no .second to this motion. There was further discus-
sion and upon_ motion of Mr. Rawls, seconded by Mr. Bremer
fogging was approved, not to exceed two times, between now
and the next regular meeting, the time of fogging to be left
to Mr. Miller of the Miller Fogging Co. who has to be governed
by weather conditions.
Mr. Rosborough recommended that a traffic light be installed
at Atlantic Boulevard and Sherry Drive due to the traffic condi-
tions at the new postoffice . There was a discussion and upon
motion of Mr. Mason, seconded by Mr. Bremer the matter was
referred to the Public Safety Committee.
The Town Clerk advised that certified copies of the Legislative
Acts passed by the Legislature during past session had been
received. Mr. Mason moved that they be referred to the Laws and .
Rules Committee, no second. It was brought out that the next
step is to set in motion the holding of a referendum election
for those acts which call for referendum approval.
Upon motion of Mr. Kirby, seconded by Mr. Rawls, Ordinance #126
covering wearing of masks , etc . was passed on third and final
reading.
Upon motion of Mr. Mason , seconded by MrBremer the Treasurer's
report was approved as follows:

A request from the Florida League of Municipalities for help
to-wards expenses of keeping open the office at Tallahassee
was received and upon motion of Mr. Mason, seconded by Mr. Rawls
approval was give). for payment of $25. as requested.

Upon motion of Mr. Rawls, seconded by Mr. Kirby the following
Resolution was adopted giving approval to the construction of
all the existing groins, etc . which were placed from the seawall
eastward on the beach for the protection of ocean front property:

Upon motion 'of Mr. Mason, seconded by Mr. Ralws the following
Resolution covering repairs to the Clifford Payne Seawall at
Lot 4, Block 33 Atlantic Beach was approved and the Town Clerk
instructed to send notice:

The Mayor reported on the Police Dept , advising that it was
functioning. There was a discussion of the deputy marshall,
and Mr. Bremer advised that he still does not agree on the
hiring of the new policeman, and does not think that he is
needed, and believes the department could be run on same
personnel as before . Mr. Mason thinks should give the new man
a chance, and Mr. Rawls advises he thinks it is one of the best
things we have done , and that we can leave the handling to the
Mayor 's discretion.
Mr. Ganzel read Mr. C.R. Frazier ' s resignation as Town Supervisor
to be effective not later than January 1, 1950. Mr. Ganzel advised
that Mr. Frazier had made it plain that he does not hold antthing
against any official, but he is needed in his son's business and
wants to be relieved to take an active part in that business. Mr.
Ganzel recommended that Mr. Frasier be given 3 months leave with
pay because of his long service to the Town. Upon motion of
Mr. Mason, seconded by Mr. Rawls Mr. Frazier' s resignation was
accepted and he is'Vo be replaced on October 1st, 1949 by new
Supervisor to be chosen, and that Mr. Frazier be given a 90 day
leave with pay to January 1, 1949. Also that a letter be written
to Mr. Frazier over the Mayor's signature expressing our good
wishes and appreciation for the long service rendered.
Mr. Frazier recommended that some form of pension and retirement
be put in for the benefit of Town employees. This matter was
referred to the Finance and Taxation Committee for study.
Mr. Ganzel advised that he would like to get started on the
1949 Tax Roll, and asked that the Finance and Taxation Committee
look into the matter of a Tax Assessor and make recommendations
as soon as possible .
Upon motion of Mr. Mason, seconded by Mr. Bremer the following
Resolution was adopted adding lots to be cleaned:
WHEREAS. the co-mingled and concerted growth of weeds , grasses
and underbrush upon the following lots , in the Town of Atlantic
Beach, to wit :
Lots 22 & 24, Block 4, Lot 32 & s of 33 , Block ABT
Lots 1,2,4, Block 3 Lot 27, Atlantic Beach Terrace
Lot $, Block 3 Lots 352 & 362 , Saltair
Lot 2 , Block 4 Lot 34 , Block 11
Lot 21 & W2 of 19, Block 5 Lot 26 , Block 6
Lots 5 & 6, ABT
amounts to and constitutes a nuisance endangering the general
health, safety and welfare of the community at large,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYO`. A.NT) TOWN COUNCIL
OF THE TOWN OF ATLANTIC BEACH , FLORIDA, that it hereby declare
Vhe condition on said lots a nuisance endangering the general
health, safety and welfare of the community at large and directs
the Town Clerk to forthwith notify the owner of the premises
upon which said nuisance exists to abate such nuisance within
30 days from date of notice.
The matter of laying the water to the new houses on Belvedere St.
in Saltair was discussed and it was brought out that authorization
is needed to purchase the pipe before the Town Su 'ervisor can go
ahead with the work. Mr. Frazier recomi ended that 3" pipe be
used, except that the last 200 feet be 2" pipe . There was a disd
cussion and upon motion of flr. Rawls, seconded by hr. Bremer
authorization was given for the purchase of the pipe and laying
of the line as recommended by lir. Frazier.
4110 iia'. George Bull advised that he has 2 lengths of new 3" pipe
that he will be glad to let the Town have at current price ,
and the amount to be applied against his Seawall Emergency
Account . Upon motion of Mr. Bremer, seconded by Mr. Mason
this proposal was accepted.
Mr. Rawls advised that he thought letters should be written
to the Naval Air Station, the Civil Aeronautic Administration,
and the National Guard relative to the low flying planes over
the beaches and residential areas. It was the unanimous opinion .
of all that such a letter be written over the mayor's •signa-
ture.

Mr. Bremer reported that tie had received complaints on Lot
Cleaning charges . -
oiI,Ir. Ganzel requested an opinion from Council as to our pursue-
ing the work on the Hotel Reservation Rd. Mr. Mason advised
that he feels it should be considered further, and it was agreed
by a1.1 that we go ahead with the plans .
Upon motion of Mr. Rawls, the meeting adjourned from day to
day. •

RESOLUTION OF THE TOWN COUNCIL OF THE TOWN /
CF ATLANTIC BEACH, FLORIDA /* ,tL 7�(/J 1
BE IT RESOLVED by the Layor and the Town Counsel of the Town
of Atlantic Beach, Florida :
SECTION 1. It is hereby found, _ determined and so declared
that the seawall abounding and abutting upon Lot 4 , Block 33
according to plat of Atlantic Beach recorded in Plat Book . 5 ,
page 69 , of the current public records of Duval County, Florida,
was damaged by storms in the autumn of 1947 and said wall at said
place has remained and now is in a state of disrepair and in a
weakened condition endangering the abutting property and the prop-
erty of others ; and that the said wall should be repaired and fixed.
SECTION 2. The Town Clerk of said Town of Atlantic Beach is
hereby directed to forthwith notify the owner of the lot hereinabove
described to repair the said wall so adjoining and abutting, the said
premises within thirty (30 ) days from the date of said notice by
doing or causin: to be done the following work:
Tie back wall with 1" or better rods
secured to an ample dead man and through
the wall securely bolted. Rods to be
20 feet long.
Close break in wall with a re-inforced
concrete slab vibrated. Rods sufficient
in number and 3/$" to 1/2".
SECTION 3. The Town Clerk of said town is further directed
to serve said notice upon the owner of said Lot in the manner pro-
vided by Ordinance No. 117 of said town and to attach to said notice
a copy of this resolution and a copy of said Ordinance.

RESOLUTION OF THE TOWN COUNCIL OF THE
TO'''WN OF ATLANTIC BEACH, FLORIDA
'`HEREAS, by act of the Florida Legislature enacted at its
regular biennial session in 1949, Chapter 10486, Laws of Florida,
Acts of 1925, was amended so as to authorize ocean front proprie-
tors to erect and maintain upon the ocean beach in Duval County,
Florida, groins and other defensive structures against the in-
roads of the sea butproviding that no such structures should be
erected within the corporate limits of any municipality without
authorization of such municipality; and
WHEREAS, ocean front proprietors have constructed at divers
places upon the ocean beach within the corporate limits of the
Town of Atlantic .3each, Florida, groins and other defensive struc-

tures authorized by said act, but the erection and construction of
the same have not been formally authorized by said Town Council;
WHEREAS, the Town Council of said town has found and deter-
mined and does hereby so declare that the maintenance of said
structures is to the best interests of said town and reasonably
necessary to the protection of the uplands adjoining said
beach.
NOW, THEREFORE, BE IT RESOLVED by the 1.Layor and Town Coun-
cil of the Town of Atlantic Beach, Florida :
Section 1. What all groins and defensive structures here-
tofore erected and placed upon the ocean beach within the limits
of said town and now existin ' are hereby expressly authorized and
the maintenance of the same is hereby expressly permitted .
Section 2. That no alteration, extension or enlargement
shall be made to any groin or defensive structure heretofore erected
and now existing upon said ocean beach without authorization and
permission of the `_'own Council of said town having been first had
and obtained .
Section 3. This resolution shall take effect immediately
upon its passage and approval by the Layor.

THAT AS A RESULT OF A PUBLIC HEARING HELD
AFTER 10 DAYS PREVIOUS NOTICE, THAT
THERE ET-InGER EXISTS SUCH A SHORTAGE OF
RENTAL HOUSING ACCOLa:ODATIONS AS TO RE-
VIRE RENT CONTROL IN THE TOWN OF ATLANTIC
BEACH, FLORIDA.
WHEREAS, the Town Council of the Town of Atlantic Beach,
Florida, did on the 1st day of July , 1949 , publish a notice
that there would be a public hearing held on the 11th day of
July , 1949 , to determine whether or not there no longer exists
such a shortage in rental housing accommodations as to require
rent control in the Town of Atlantic Beach, Florida; and
.THEREAS, such public hearing was duly held at a meeting of
the Town Council in the Town of Atlantic Beach, l'lorida, with all
citizens being allowed to present facts as to such question; and

testimony offered at such public hearing;

result of a public hearing held after 10 days notice, sworn
proof of publication of such notice being attached hereto and made
a part of this resolution, that there no longer exists such a
