The meeting was called to order by the President, Mr.
F.P. Ganzel, who called for reading of minutes .
Minutes of the Regular meeting of September 12, 1949
were read and upon motion of Mr. Mason, seconded by
Mr. Kirby they were approved as read.
Minutes of the adjourned meeting Bf October 3 , 194.9 were
_read and upon, motion of Mr . Kirby, seconded by Mr. Thames
they were approved as read.
The Council sat as an Equalization Board on the Salbai.r
Street Paying Assessment Roll in line with published notice
certificate of 'publication attached hereto and made a
part of these minutes . Tha- e were no objections, therefore
upon motion of Mr. Mason, seconded by Mr. Bremer the following
Resoluti on was adopted: The assessments on the preliminary
assessment roll have been reduced to 3 .39417 per front foot
cost.

A letter was read from Mr. W. K. Converse who thanked the
Council on behalf .of the Cub Scouts of Atlantic Beach for
the balldiamond which was constructed at the Atlantic
Beach School.
Mr. Ganzel recognized visitors present, and called for any L
business from the floor. There being none, the Council -
next went into the matter of Waterworks.
Mr. Ganzel reported that Mr. Gerry Adams had phoned him just
prior to the Council meeting and offered to let, the Town have
the use of the water plant located on the Hotel Reservation
for indefinite period for a rental of $1.40 per year, as he
does not feel that this is the time for the; Town to build a
plant and it was his desire to assist the Town. There ,was a
discus sion, and it was decided t_at5 go ahead with the passing
of the Ordinance and calling for election, in the meantime
making a study of Mr. Adam' s offer.
Councilman Mason called up for further consideration and caused
to be read in full a bill for an ordinance entitled
"AN ORDINANCE authorizing and providing for the issuance
\l of $150,090 Mater System Bonds of the Town of Atlantic
p Beach, Florida , and for the payment of same as to both
principal and interest from the levy of taxes, and in
addition, the net ipcome a.nd revenue from the operation
of the municipal water system of said town, "
which had been passed on first and second readings at the
meeting of the Town Council on October 3rd, 1949, whereupon
Councilman Mason moved that all rules be suspended and that
said proposed ordinance be declared passed on its third and
final reading, which motion was duly seconded by Councilman
Kirby and- salad motion having been duly considered the Presi-
dent put the questaon thereon, and upon the roll beinF called
the following voted:
Aye: Ganzel, Mason, Thames, Bremer , and Kirby.
Nay: None
Whereupon the President declared said motion duly carried
and said ordinance duly passed on its third and final reading.
Councilman Mason called up for further consideration and caused
to be read in full a bill for an Ordinance entitled

election in the Town of Atlantic Beach, Floridair ,
(l� in connection with the issuance of bonds of said
Town for water system purposes, "
which had been passed on first and second readings at the
meeting of the Town Council on October 3 , 1949, whereupon
Councilman Mason moved that all rules be suspended and that
said proposed ordinance be declared passed on its third and
final reading, which motion was duly seconded by Councilman
Kirby, and said motion having been duly considered the Presi-
dent put the question thereon and upon the roll being called
the following voted:
Aye: Ganzel, Mason, Thames, Bremer, and Kirby.
Nay: None.
Whereupon the President declared said motion duly carried
and said ordinance duly passed on its third and final reading.
Upon motion of Mr. Bremer, seconded by Mr. Thames Ordinance
#127 changing title of Town Supervisor to Town Manager was
read and passed on third and final reading. 410

Upon motion of Mr. Mason, seconded by Mr. Kirby Ordinance
#12.8 naming "Frazier Park", was passed on third and final
reading.
Upon motion of Mr. Thames seconded by Mr. Bremer Ordinance
#129 cove ring "Cigerette Tax" was passed -on third and final
- reading.
Upon motion of Mr. Kirby, seconded by Mr. Bremer the following
Resolution was adopted with all councilmen voting "aye" :
RESOLUTION APPROVING THE PRELIMINARY TAX ASSESSMENT ROLL FOR THE
YEAR 1949.
WHEREAS, The T own Tax Assessor has completed the Preliminary Tax
Assessment Roll of the Town of Atlantic Beach Florida , for the
year 1949, and has submitted the same to the T own Council, and
WHEREAS , It appears that all property, real and personal , in the
Town of Atlantic Beach, subject to taxation has been assessed on
said Tax Assessment Roll, arra the Tax Assessment Roll is in due
form,
NOW THEREFORE BE IT RESOLVED BY THE TOOIN COUNCIL of the Town of
Atlantic Beach, Florida, that the said Preliminary Tax Assessment
Roll , be , and the same is, hereby approved.
BE IT FURTHER RESOLVED That the Town Clerk shall post at the T own
Hall and at two other public places in the Town and shall also
cause to be published daily for four consecutive days in a news-
parer published in the City of Jacksonville , Duval County, Florida ,
notice that said Tax Assessment Roll has been submitted to the T own
Council and approved, and also requiring all persons desiring to
have corrections thereof made , whether in listing, valuation of
property or otherwise , to file with the T oanT ax Assessor on or
before the /)tL-- day of1949 at $ P.M. their
petition to the Town Council setting forth their objection to said
assessment roll and the correction they desire made , and that also
on the a. a. day of 1e -L ,1949 at $ P.M. the T oWn
Council shall meet at the Town Hall for the purpose of equalizing
.said assessments and making proper correction therein.
Upon moti on of A.Ir , Mason, seepnded by Mr. Thames the Town
Clerk was directed to post the following notice setting the
date for the Toir;rn Council to meet as a Board of Equalization,
the date being fixed at 8 P.M. , October 24th, 1949:

OF T1-E TOWN OF ATLANTIC BEACH , FLORIDA FOR THE YEAR 1949:
"TO WHOM IT MAY CONCERN: You are hereby notified that the
Preliminary Tax As8essment Roll for the Town of Atlantic
Beach , Florida , for the year 1949, has been completed and
submitted to and approved by the Town Council. All persons
desiring to have correcti ons made thereof, whether in listing,
vailuation of property or otherwise, are required on or before
the 24th' day of October, A .D. , 1949 at 3 P.M. , to file with
the Town Tax Assessor of the Town of Atlantic Beach, their
objections and corrections they desire made.
The Town Council will meet at the Town Hall in the Town: of
Atlantic Beach, Florida, on the 24th day of October, A.D. ,

Mr. Panton reported that the Duval Engineering Co. had put a
tie-back on the seawall at 1st St. when they were repairing the wall
to the south of the street, and that there is already a tie-back
on the seawall at the 2nd St. street-end.
Mr. Panton reportedtthat, he had met with the Colored: Chamber of
Commerce and> diwcussed their playground with them. He promised
to go in with the motor grader when the ground is dry enough,
and clear space for them to have basketball court, etc. Mr.
Ganzel feels that we should do something immediately to help
them get the ground cleared and lightd, and that at least '$200.
should be appropriated to assist in getting the playground
in operation out there. Upon motion of Mr. Kirby, seconded by
Mr. Thames, approval was given for the eApenditure of not more
than $200. for the colored playground for clearing and putting
up court, etc . .

- The question of giving assistance to the children and families
of Atlantic-Neptune school was discussed and it was brought out
that tie have no authority to spend the Town's monies on projects
of this kind , and upon motion of Mr. Mason, second ed by Mr. Kirby,
the Town Clerk was directed to write Mrs. Weiss that Town not in
a position to help, and give reason .

Mr. Ganzel advised that Mr. Young had requested help
to-wards sending the Fletcher band to Miami. There was
a discussion, and it was brought out that the Counc it
has no authority to donate any money
It is expect ed that the budget will be ready by the next
res eting, if possible.
Mr. Ganzel announced his resignation to be effective
if possible 30 days from date, as he has his house up
for sale , and they plan to move out of the Town, if it
is sold . There was a discussion, but no action was taken.
The matter of a dump truck was discussed, and referred to finance
public works committees to report back at next meeting.
Upon motion of Mr. Mason the meeting adjourned from day to
day .

NOW, THEREFORE, be it resolved by the said Town Council
that:
Section 1: Each and every, all and singular, the said special
assessments contemplated and set out in the said special assess-
ment roll prepared and published as aforesaid as equalized and
adjusted as hereinabove set forth, hereby are , and so stand ,
finally approved and confirmed, and are now declared to be and
shall remain legal, valid and binding liens upon all the said
property against which they are made until paid.
Section 2: The said actual total cost of said improvements
having been ascertained and determined as hereinabove set forth
and the said special assessments as herein adjusted , approved and

confirmed, being based and levied upon said actual cost and not
the estimated cost, there is, therefore , no necessity of nor
shall there be any rebate by the said Town of Atlantic Beach to
the owners of any property which is specially assessed for said

RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF ATLANTIC BEACH, FLORIDA
WHEREAS, Mr. Gerry AdHms did offer to the town the use of
his waterworks system located on the Hotel Reservation by a commu-
nication addressed to G. L. Rosborough, Mayor and F. P . Ganzel,
President of the Town Council of said town, dated October 12 , 1949
and reading as follows :
"Mr. G. L. Rosborough, Mayor,
and
Mr. F. P. Ganzel, President of the
Town Council
Town of Atlantic Beach, Florida
Gentlemen:
I am advised that the Town Council has passed and
certified to the Mayor for his consideration ordi-
nances providing for the issuance of tir150,000 of
water bonds and for a referendum election on the
question of the issuance of such bonds .
It is my considered opinion that it is unwise for
the Town to bond itself to this extent at this time.
The interest approximately 0,000 annually, decreas-
ing only slowly by reason of annual curtailments of
principal, andin addition to the interest the aver-
age annual curtailment of principal would amount to
7500. It seems to me there is no prospect whatever
that these debt service requirements could be met
from water revenue . Thus only a case of absolute
necessity could justify the issuance of the proposed
bonds and the building of the proposed system at
this time .
The Town is presently enjoying the use of my well ,
pumping station, mains , tank and other facilities
located on the Hotel Reservation for the supplying
of water to the town under the agreement between
myself and the town set out in Ordinance No. 102 .
Under this agreement the use of these facilities is
leased to the town until December 31, 1947, the town
paying therefor the sum of $250 a year. In order to
further assist the town and to make it unnecessary
to construct the proposed system at this time , I am
willing to an d hereby offer to grant to the town the
right to continue the use of the facilities on the
Hotel Reservation until such time as the t am is in
better condition to build its own plant , or if you
desire to continue such use until such time ae I
shall have given the town two years ' prior notice
of termination of such right of use . For such extended
use I would expect and require that the town maintain
